Temple dispute and ASEAN conflict settlement

While all eyes are directed towards affairs in Tunisia and Egypt, another urgent situation stemming from a rather neglected issue is occurring in our own backyard. A scuffle between Thai and Cambodian forces occurred along the border between both countries, near the Preah Vihear Temple, on Feb. 4.

The origin of the conflict over Preah Vihear is a century old. According to a border settlement between Cambodia’s French colonial government and the Kingdom of Siam, the temple and the area surrounding it was Cambodian territory. Yet, in 1938 the Thai government reclaimed the area and occupied it until 1958 when both sides held a series of negotiations to resolve the issue. They did not come to an agreement. In 1959, the countries brought the case to the International Court of Justice.

The Court decided in 1962 that the temple belonged to Cambodia and that Thailand should withdraw its forces and return any objects to the temple that might have been removed. The decision was accepted by both parties and became the status quo.


Meanwhile, the recent incidents have basically been driven by domestic pressures for a firm policy on Preah Vihear. In 2008, Thai Prime Minister Samak Sundaravej supported the temple’s nomination as a UNESCO World Heritage Site, a policy that soon drew strong criticism from opposition parties that argued that it would weaken Thailand’s claim to the territorial border near the temple. Cambodia, on the other hand, was about to hold an election, leading Prime Minister Hun Sen to take a firm stand on the issue in order to obtain support from his people. Since that time, a fresh series of disputes over the temple have occurred, remaining unsettled until now.

From a regional perspective, the Thai-Cambodian dispute is only the tip of the iceberg. There are plenty of other territorial disputes among Southeast Asian countries and most are handled through bilateral mechanisms. However, the Thai-Cambodian conflict is a particular blow for ASEAN for two reasons. First, the exchange of fire clearly violated ASEAN’s principle of not using force and settling disputes peacefully. Such principles have become the basic code of conduct for many regional organizations, particularly ASEAN. Second, Cambodia’s plea to the UN Security Council for a peaceful settlement undermines ASEAN’s role as the group that maintains regional security, whether or not Cambodia realized it.

From a regional perspective, the question should be: Where does ASEAN stand? And more broadly, what can be done by the group to resolve this case and other similar cases among its member states?

These questions are not really new, but have always been the main concerns of experts regarding the development of the organization.

For decades ASEAN has remained passive when it came to conflicts involving its member states. This is partially due to the lack of adequate regional mechanisms for resolving conflicts. The 1976 Treaty of Amity and Cooperation (TAC) does mention that the organization can, when needed, form a High Council to work under the mandate of the disputing parties to settle conflicts. However, this mechanism has never been employed by any ASEAN member due to several limitations in the treaty and for the council itself. The treaty is limited because there are no proscriptions for how the council may act in disputes. Further, the parties are not required to accept the mediation of the other members of the High Council.

There are other weaknesses that make the treaty ineffective. First, the treaty does not specifically note that members of the council should be lawyers, which would ensure that dispute solutions were legal. Members would not trust a council that consists of politicians because they distrust each other regarding borders because almost every country has a border problem with its neighbor. Second, the council can only be empowered if the parties have failed to reach a solution after direct negotiations. Last but not least, the disputing parties are not obliged to use regional mechanisms as a means to resolve conflicts; they can always choose other mechanisms.

Regardless of the treaty’s weaknesses, a new prospect for regional dispute settlement mechanisms may come from the signing of the ASEAN Charter. The charter provides other mechanisms such as good offices, conciliation, mediation and arbitration. But, the charter still seems to emphasize political solutions for disputes, as seen in Article 26, which says that whenever a case cannot be resolved through other mechanisms, it “shall be referred to the ASEAN Summit for its decision”.

That article can be considered a setback for the charter, which already provided many alternatives because the use of a summit as the ultimate mechanism to resolve conflicts does not guarantee a legal solution for the disputants. What is needed by the member states in the long run is to form a permanent mechanism, preferably in the form of an arbitration body, which can handle the many disputes among them.

A permanent dispute settlement body will better serve the interests of the member states rather than ad hoc mechanisms, because it will be more established and will have a more rigid set of rules compared to the ad hoc ones. This, in turn, may also increase member trust in the regional mechanism and increase ASEAN’s institutional capacity in the eyes of its member states.

Indonesia’s effort as the current ASEAN chair by sending the foreign minister to open the path towards peace talks between Thailand and Cambodia through “shuttle diplomacy” is a positive sign.

Historically, the chair has acted as the initiator of settlement efforts many times.

However, institution wise, it would be better if in other cases the responsibility was given to the ASEAN Secretariat or to a permanent arbitration body to guarantee the sustainability of such mechanisms. As a regional political entity, ASEAN must provide a formal regional instrument for settling conflicts that really functions, despite the fact that ASEAN members are allowed to choose any peaceful settlement mechanism that suits them. By providing formal settlement mechanisms, ASEAN would be making another step towards a politically secure community.

Everywhere, I walk in Cambodia I see Vietnamese speak Vietnamese every where, why? Why?

Don't you and your families scare of hell for eternity?

When you die can you bring all of your power and money with you?

How come only real Khmer with dark skin, skinny with no big land and property willing to go to the frontline to defiance Cambodia land but Chinese Cambodians are hiding and waiting to take the lands and benefit after war, Is that fair to real dark skin Khmer, Dr. Hun Sen???? When the country in trouble only Khmer with dark skin willing to die to protect Cambodian nation but rich fat Chinese Cambodian abuse dark skin Khmer as stupid after the war over, why Dr. Hun Sen??? Why??? Most Chinese Cambodians are prejudice toward dark skin Khmer and they always look down to real Khmer as stupid. They are very hardly let’s dark skin Khmer married their children. Can Dr. Hun Sen please explain to all dark skin military of Cambodia? Where is the Chinese Cambodians at frontline? Is it really unfair to Khmer army?

If Dr. Hun Sen and Dr. Hun Manet remove the tablet it is show they are extremely coward and his star are just joy stars given by his daddy not by patriotism. Dr. Hun Manet is very coward as his daddy they only aim to kill innocent Cambodians that all. Dr. Hun SEn and Dr. ten stars Hun Manet are very great at bullying Cambodians and killing Cambodians but cowardly toward Thai and Viet.

CPP are not just corrupted, CPP are extremely corrupt. They are even sell the country such as Kos Trol, Seas, lands, Cambodian people, Cambodian health and well being, all resources in the Cambodia…with lost count. You name it!

Seriously where is the win win policy of Dr. Hun Sen represent? The country is getting smaller and smaller and shame by Dr. Hun Sen and Dr. Hun Manet and his families, his relatives and friends.

A fair assessment. However, one point regarding our government not asking ASEAN for help in term of intervention, the article is off base. The Cambodian government had sought for help numerous times since the listing of the Preah Vihear temple as UNESCO world heritage site. And as you guess it, ASEAN has been passive and brush the issues aside hope diplomacy and peaceful negotiation would work things out without resort to deadly force. This mechanism has been in tact for awhile until Thailand internal conflict arises. The Thai goernment are so weak that it move base upon emotion and demand by the extremist group. Pretty sad ordeal. Most Western and ASEAN doesn't see Cambodian as a victim due to Thai spewing out the blame on Cambodia of starting the conflict. Pretty dirty tactic.

What a shame Thai people! when will take in the morality of humanity? why used force to take what is not yours in the first place? Khmers have suffered enough already from the killing and the oppressors, instead of having some compassion, you took advantage of our down fall. Remember there is God above all and he is watching everyone in every move you make. The righteous will live forever and the wicked will be terminated simple as that. So, wake up do the right thing! be on God side that love, compassion, respect and understanding. Love is the power for eternity not just for this moment in time. Don't let history repeat itself, enough is enough! the medievil period is over! since world war I and II. so ,let beat it by the power of love. Let promote unity and that everyone is equally important, being respect as "we are only human", together we can learn to improve our way of life that is one for all and all for one :)

some light white yellow skin cambodians always say they are chinese but when they go to real chinese community the real chinese are prejudice and discriminate to them beacsue the real chinese from china think that chinese cambodians are real traitor of Khmer, dark skin khmer must stand up for our nation!

Chinese cambodians always look down on real dark skin khmer and they always say dark skin khmer are stupid and poor. They abuse dark skin khmer for too long!

When the country in war they are hiding their children but after war they like to take advantage over dark skin khmer. That isn't fair. Only dark skin khmer are at the frontline protect khmer nation, chinese cambodians like to hide and abuse dark skin khmer after the war.

Chinese-khmer are also khmer. viet- khmer are also khmers. Right now I'm Australian-khmer also Australian because I am living in Australia. So, whoever live in our country they are also our people. The more people we have the better for our nation and our country, e.g. there are two billions chiness, two billions Indian and now they are the leading nations. They have nuclear bombs their cities are improving dramendously. Viets 80+millions, Thai almost there as well. So, the more people we have the better. The only thing we need is good governant and support all citizens, by having laws to have their right and say based on what their want and need. So, this is what lacking right now. Just look at Aust, it is only two hundred years old and they have like 10s different PMs over the past decate like every 4 to 8 years if re-elected. So why is Hun Sen still in power, for like 30 years. This is clearly a sign of oppression. Something like this needs to change for good outcome. It is a time to change our leader..or else it will go down just like Abganistain, Barack (egype), Iraq etc...

Kos Trol, seas and alot of land have been given to Vietnam and Thail by Hun sen. Where is justice for Cambodians?

Chinese cambodians try so hard to be chinese but the real chinese from Hong Kong and china don't reconized them at all. That is real shame! They can't even mix in real chinese community at China Town. They go to Hong Kong \, Hongy people can't even understand their chinese and they racist to chinese cambodian very badly.

At frontline there is no china cambodian born at all. They are real traitor! Dark skin khmer will fight to death to defence Khmer Nation!

Thanks for the info but as I reseach on the God stuff my scientific point that Gods are alien visiting earth UFO as their vescles. alot of evidence in bible as well as fact. We found giant race too, they are from another planet. UFO is real but at that time mankind think alien and UFO as God and magic super power. Yes there are alot of evidence about flood that is why many ancient cities are still under water at the moment. also the atlantic legent is also real.

Plus mankind did walk with dianosours. The revolution theory is fail by real fact evidences.
