Cambodian political observers say that opposition leader Sam Rainsy, who was removed from the National Assembly last week, will need to look for concessions with the ruling party if he is to return to politics.
Sam Rainsy is facing several criminal sentences related to the uprooting of markers on the Vietnamese borders and the publication of a map on his website alleging Vietnamese encroachment into Cambodian territory.
Kem Sokha, the president of the minority opposition Human Rights Party, said Sam Rainsy must now “apologize” or make other overtures beneficial to the ruling party if he is to return ahead of 2012 and 2013 elections.
“That’s what we see so far as political compromises,” he said.
Similar concessions were made by Prince Norodom Ranariddh ahead of his return from exile on graft charges ahead of the 2008 national elections, he said.
Such concessions can include a written apology or clarification to Prime Minister Hun Sen, he said.
The National Assembly ousted Sam Rainsy from his seat as representative of Kampong Cham province last week, after the Supreme Court upheld a criminal conviction against him. He still faces a court battle for disinformation after publishing a map on his website lower courts have found were fabricated.
Sam Rainsy has said the maps accurately show Vietnamese encroachment, a politically volatile accusation. Vietnamese officials have denied any encroachment has taken place.
Independent analyst Chea Vannath said political reconciliation is still possible, although she did not specify what that might mean.
Nhiek Bun Chhay, secretary general for the royalist Funcinpec party, said an apology would allow Sam Rainsy to return.
Sam Rainsy told VOA Khmer recently he will not apologize and that he feels justified in his claims that Cambodia is losing land to Vietnam. However, he said he is still looking for national or international solutions.
“I took the lead to defend the national interest, so the national interest is political,” he said.
Hun Sen has said Sam Rainsy’s case is a legal matter for the courts, not a political matter for the executive branch.
Cambodian People’s Party lawmaker Cheam Yiep echoed that position in an interview, saying the charges against Sam Rainsy are legal, not political. And his removal from the Assembly was done on legal grounds, Cheam Yiep said.
He reiterated claims that Sam Rainsy would have to write Hun Sen, who has the power to request a royal pardon for crimes.
Sam Rainsy said in an interview his removal from the National Assembly was a breach of the law, because he was voted in by his constituency. The move will likely bring international condemnation, he said, and ultimately strengthen his party.
Ruling party officials have “openly exposed themselves as people who don’t understand the law, who don’t understand democratic principles and who are suppressing the constitution,” he said.
He said he was similarly removed from the Assembly in 1995, but his party garnered even more support in subsequent elections.
“I believe that in 2013, there will be a change, and the Sam Rainsy Party will be stronger and stronger,” he said.
The Sam Rainsy Party currently holds 26 of 123 seats in the National Assembly. His removal from the National Assembly has prompted little international reaction so far.

It is so obvious that Sam Rainsy recently said he will not apologize to the Cambodian government because he knew that even though, he wrote a letter to ask PM Hun Sen for forgiveness, the Prime Minister won't agree to do so. In contrary, if there is a sign that PM Hun Sen will agree to pardon him, Sam Rainsy will write apologize letter to PM Hun Sen within second and he will do it without thinking twice by using the so-called "National Reconciliation" as his pretext to cover up his ugly face.

Recent sacking of convicted criminal Sam Rainsy from national Parliament has raised many eyebrows among SRP's supporters who until now advocated insulting and appeal for uprising against Cambodian government to resolve the so called national political and social issues. The sacking which is according to Cambodian laws, but opposition seen as unjust and political motivated, and who care about Arab countries are bracing for widespread people rebellions.
Not so long ago PM Hun Sen publicly stated that he wants opposition not just weakened but dead. It is really clear he intends to achieve his wish, and he even has the means to carry it out. However, one thing we are all clear about is no matter what the opposition crying out for help, the government will never care about it. The Prime Minister is making a right decision which regards Sam Rainsy is no longer has any value in Cambodian politics.
What PM Hun Sen should worry is not about the absence of Sam Rainsy from politics, but is about rebuild the country. Most political analysts or observers would agree that Sam Rainsy's leadership and approach over the years have been very personal, too personal indeed. Many his extremely supporters would prefer to see him adopt a more aggressive stand toward the government, which includes the establishment of a government in exile or underground movement for armed confrontation.
Barring Sam Rainsy from politics is not difficult to predict and good for the country. There is no doubt that Sam Rainsy already faded away from his current role, a new generation of young leaders will definitely emerge to replace him. Any young leader at the helm of the opposition is likely more keen to take more liberal approach and pursue a more dialogue path.
PM Hun Sen is well aware that his government has managed to maintain the current level of stability in the country mainly because his party got more than 2/3 of votes in the last general election and up to now his government makes enormous progress in society, but opposition has never seen it. All they want to see is the social unrest and chaos.
Despite opposition invented that lack of transparency on the Eastern border demarcation, the ongoing land grabbing and forced eviction, and the mistreatment of the opposition leader...etc won't hurt anything to the government but at the same time, it will put themselves enormous pressure to existing in the next election and beyond.
The current social uprising in the Arab countries definitely creates a good excuse for the opposition to lie the people in the coming weeks and months, but the government will have a lot of key options to evaluate and crash down of any protester. As for the opposition, it would be wise and prudent to revisit their decision, and don't ever dream about the reinstatement of Sam Rainsy's parliamentary status, let alone come back to Cambodia. In the present situation, the Royal Palace is the best venue for neutral and out of politics. The opposition should not use the Royal Palace to clean up its political mess.

The fact is who nobody give a fuck who rule Cambodia whether AH HUN SEN, Sam Rainsy, or whoever...the U.S., China, South Korea, and Japan... will deal these Cambodian leaders the same way!
Whoever replace AH HUN SEN and they will inherit the same dirt-poor and corrupted for the past 30 years by the Vietnamee! So they shouldn't waste no time in rebuilding Cambodia and there is no time for political bickering or make Cambodia go through another war!
Mr. Sam Rainsy was precise about the Vietnamese encroachment.The real liar is the ruling party (CPP)who live under Vietnamese's skirt.
