On 25 October, a high ranking government official considered the lawsuit brought up by a group of Nuon Chea’s defense lawyer as a useless joke.

The government official’s mockery came after Nuon Chea’s defense lawyers filed a lawsuit on 24 October to the Phnom Penh municipal court, accusing a number of high-ranking government officials of interfering with the KR Tribunal progress.

Hor 5 Hong, the minister of Foreign Affairs, told reporters at his ministry that the government does not care to reply to Nuon Chea’s defense lawyers’ accusation, claiming that the government interferes with the KR Tribunal: “This is a joke that we don’t need to reply back.”

Nuon Chea’s defense lawyers accused Hun Xen and a number of high-ranking government officials of violating the law by preventing witnesses from testifying at the KR Tribunal and by preventing the court from bringing additional suspects to try. These defense lawyers consider these actions as being joint criminal plan in order to interfere with the judicial system and the rights of the accused to receive a fair trial.

The accusations leveled by Nuon Chea’s defense lawyers are very similar to the accusations leveled by the international Co-Investigating Judge Siegfried Blunk who resigned from his position on 09 October.

Blunk indicated that the reason he resigned was because in May 2011, Khieu Kanharith, the minister of Information, claimed that if the KRT wants to try Case 003/004, it should pack and leave Cambodia. Furthermore, Hor 5 Hong indicated that the decision to arrest additional suspects is the Cambodian government’s rights. Blunk added that these were the reason why he cannot work independently and without pressure.

On 20 October, the UN told government officials not to talk about the KRT work, in particular, in regards to Case 003/004 in which 5 other suspects would be brought to trial.

Last Thursday, the KRT issued a statement indicating that Patricia O’Brien, the UN legal counsel, told Sok An, the minister of the Council of Ministers, to prevent government officials from issuing any statement that affect the progress of the KRT, in particular, in Case 003/004, as well as in other judicial matters. She indicated that the Cambodian government has the duty to cooperate with the KRT during the trial of the suspects.

To Hun Sen and Hor Namhong it is a joke .

But to million Cambodian it is a clear confession of CPP in the interferences into this ECCC so the full and open public hearing of Case 002 never take place under CPP.
