Tribunal Announces International Judges After Some Delay

WASHINGTON DC - Mark Harmon, a US judge, and Olivier Beauvallet, a French judge, have been named to the UN-backed Khmer Rouge tribunal to the controversial office of investigating judges, the court announced Monday.

Harmon will be placed as international co-investigating judge, with Beauvallet in reserve, the court said in a statement.

Harmon comes in amid ongoing scandal at the office, which is supposed to be dealing with two cases that are opposed by the government, and amid a budget shortfall.

The office has seen the resignations of two international judges who said they could not do their jobs there, as well as a massive walkout of international staff last year.

In spite of the recent hurdles faced by the ECCC – ranging from the resignation of international prosecutors and judges and a lack of salary for its staffers – the recent appointment of a prominent academic expert on world war crime as a special expert to the tribunal by United Nations Secretary-General Ban Ki-moon promises the continued success of the court’s efforts.

David Scheffer, professor at the Northwestern University School of Law and former U.S. Ambassador-at-Large for War Crimes Issues, expressed strong determination in his mission to the ECCC in trying the surviving leaders of the Khmer Rouge regime.

Through ECCC’s international prosecutors and judges have resigned one after another, Scheffer expressed optimism to VOA Khmer in June.

Lawyers representing Case 004 suspect Ta An said yesterday they had received instructions from their client to take “the necessary action to have the investigation against me dismissed”.

In a statement, Richard Rogers and Mom Luch said the investigation into the government-opposed Case 004 had reached an impasse.

“In the current circumstances, it is difficult to see how the ECCC can provide the suspect with a meaningful opportunity to clear his name,” the statement says.

Speaking to the Post yesterday, Rogers said ongoing turmoil in the Office of the Co-Investigating Judges had affected his client’s rights.

“We are not taking a position on who was right or who was wrong; our concern is that there is an investigation and that it functions properly, and there certainly hasn’t been that for at least six months,” he said. “There have been different approaches between the investigating judges and also the pre-trial chamber judges, and it seems to be disagreement about how this case would move.”

“We’re still waiting for a new appointment of new judges [to see] whether this can move on.”

Swiss judge Laurent Kasper-Ansermet is expected to leave the Khmer Rouge tribunal Friday, following a turbulent run as international investigating judge that critics say underscored high-level political interference at the UN-backed court.

Before leaving, however, the judge issued his own decisions on two suspects of a potential third case at the court, saying former navy chief Meas Muth and former air force chief Sou Met were among those “most responsible” for the crimes of the Khmer Rouge and should therefore be prosecuted by the court.

The widely publicized names were redacted from the official decision, which was not signed off on by his counterpart, judge You Bunleng. The court’s mandate is to pursue only those suspects considered “most responsible” for the crimes of the Khmer Rouge. Kasper-Ansermet said in his decisions the tribunal had the duty to bring the two men to justice.

The Pre-Trial Chamber can hear motions and appeals against orders issued by the Co-Investigating Judges while a case is still under investigation. There are three Cambodian judges and two international judges, and any decisions requires an affirmative vote of at least four out of five judges.

If a case following the conclusion of investigation is being sent to trial, the trial hearings will be conducted before the Trial Chamber. The Trial Chamber will decide whether an accused person is guilty or not guilty based on the witness testimonies, evidence and arguments presented by the parties during the trial. Three Cambodian judges and two international judges comprises the Trial Chamber, and a guilty verdict requires the affirmative vote of at least four out of five judges.

The Supreme Court Chamber can hear appeals against decisions and judgements issued by the Trial Chamber. Four Cambodian judges and three international Judges comprises the Supreme Court Chamber. Any decision by the Chamber requires an affirmative vote of at least five out of seven judges.

Civil Parties and Appellants in Case 001 Participate in the Announcement of Appeal Judgement in the case against Kaing Guek Eav alias Duch

The Victims Support Section (VSS) of the Extraordinary Chambers in the Courts of Cambodia (ECCC) is holding a victim’s participation program in cooperation with Intermediary Organizations to facilitate the participation of the 90 victims who are the Civil Parties and Appellants of Case 001 in the announcement of appeal judgement against Kaing Guek Eav alias Duch.

The Supreme Court Chamber of the ECCC has announced that it will pronounce the appeal judgement in the case against Kaing Guek Eav alias Duch on Friday, 3 February 2012, at 10am. After participating at the ECCC, Civil Parties and Appellants will participate in a Buddhist Ceremony (Bangskol) at Choeung Ek Genocide Center at 2:30pm, get emotional support and counselling, and discuss with their respective expectations with their lawyers.

At 2:00pm on Thursday, 2 February 2012, the day before the hearing, a meeting will be facilitated between all Civil Parties and Appellants and their lawyers at Tuol Sleng Genocide Museum in order to reflect on the history of Case 001.
