BANGKOK, 19 July 2012 -Defense Minister Air Chief Marshal Sukumpol Suwanatat has indicated that there is ample evidence of illegal encroachment by Cambodian villagers on the disputed border areas, adding that a negotiation between the two countries is needed to solve the issue.

According to the Minister, the situation around the border has been peaceful since border police have been deployed in the areas replacing soldiers who pulled out yesterday. However, he said some Cambodian nationals have been seen in the compound of Sikhakirisawara temple, which is located in the vicinity of the Preah Vihear temple.

Their presence would constitute an illegal entry. He said further discussion with Cambodia would be required since both sides claimed the area around the temple belonged to them. Meanwhile, the removal of landmines around the overlapping territory would proceed as planned, adding that Thailand will continue to work out the issue with Cambodia in a timely manner, said the Minister.

The new culture minister, Sukumol Kunplome, said yesterday that her first mission in office would be to reclaim for Thailand recognised ownership of a graceful hand position called jeeb - part of traditional dance - and shadow plays, both of which have been listed as part of the cultural heritage of Cambodia.

The jeeb hand position has the thumb and index touching and the three other fingers fanned out.

In 2008, Cambodia had the Sbek Thom, or Khmer shadow theatre, included on Unesco's Representative List of the Intangible Cultural Heritage of Humanity, along with the Royal Ballet of Cambodia, also known as Khmer Classical Dance. The listings incorporated graceful hand gestures, including the jeeb hand position.

Advice from the Foreign Affairs Ministry suggests that Cambodia's proposing of such things to the Unesco List of the Intangible Cultural Heritage of Humanity will not affect Thailand's right to register them also.

Three Thai villagers suspected of spying on Thai soldiers and passing information to Cambodian forces were arrested on Thursday for interrogation, 2nd Army spokesman Col Prawit Hukaew said.

The three were apprehended near Ban Don Nam Tan in tambon Bak Dai of Surin's Phanom Dong Rak district.

They are suspected of reporting the locations of targets by mobile phone to Cambodian soldiers for attack.

They were identified as Thanit Srisa-nga, of tambon Khok Klang, Sanit Pinkao, of Ban Nong Khanna, and Sermsuk Phochaiserm, of Ban Don Nam Tan.

Col Prawit said the three were still being questioned and it was not yet confirmed they were spying for Cambodia.

Cambodian Prime Minister Hun Sen and his son, an army commander, have broken a gentleman's agreement for a truce, leading to the latest border clash and damage to both Thailand and Cambodia.

Cambodian soldiers opened fire at Thai troops who were warning them not to build a base and bunkers in a disputed area 400m west of the Ta Kwai temple on Friday morning as they were violating the Thai-Cambodian 2000 memorandum of understanding that prohibits any modification or building, especially of military facilities, in disputed areas pending demarcation.

Thai soldiers expected their Cambodian counterparts to honour the gentleman's agreement for a truce, so they trusted their counterparts and sustained many deaths and injuries from the unexpected opening of fire.

The Thai-Cambodian border seemed peaceful over the past two months, after the truce had been agreed by Thai soldiers led by army chief-of-staff Dapong Rattanasuwan and Cambodian soldiers led by Cambodian army deputy commander Hun Manet in Cambodian territory next to Chong Sa-ngam border pass in Phu Sing district of Thailand's Si Sa Ket province.

Cambodian Prime Minister Hun Sen might have had ulterior motives for being so tough against the seven Thais who were arrested by Cambodian authorities for allegedly trespassing into Cambodia. The arrested include Democrat MP Panich Vikitsreth, a former vice minister for foreign affairs who is now a member of the House committee on boundary affairs, and well-known political activist Veera Somkwamkid.

The seven Thais were arrested last Wednesday near the border in Sa Kaeo, which is opposite the Cambodian town of Banteay Meanchay. They were taken to Phnom Penh and detained in a central prison there pending trial. If found guilty of illegal entry, the seven Thais may face up to 18 months in jail.

The accused have only themselves to blame for not having contacted the Thai army or the Border Patrol Police, who could have provided a team of soldiers or BPP personnel to accompany them into the disputed area. Both Thailand and Cambodia claim sovereignty over this portion of the border.

Nonetheless, I think the Cambodian soldiers were wrong in taking Mr Panich and his companions into custody. They may have been instructed to do so by a higher authority.

I suspect Hun Sen is using this incident to bargain for something from Thailand in return for freedom for the seven men. The Cambodian leader is well aware that his Thai counterpart, Abhisit Vejjajiva, will do anything to secure the release of Mr Panich. He cannot let his fellow party MP languish in jail. I hope PM Abhisit will not let Hun Sen take advantage of Thailand over this pol itically sensitive issue.

On Monday, a group of Cambodian officials issued a new warning on the violation of Cambodia’s airspace by Thai planes. The officials indicated that, in the future, these airplanes will no longer be lucky as they were in the past if they continue to violate Cambodia’s airspace. The following is Khemara Sereyrath’s report from Phnom Penh:

This is a new reminder issued to Thailand, in spite of the fact that Thailand sent in a written clarification regarding its airplane flying into Cambodia’s airspace in Pailin province at the end of last week.

Koy Kuong, spokesman of the Cambodian ministry of Foreign Affairs, indicated that Cambodia just received the official apology letter explaining the violation of Cambodia’s airspace [by Thai plane]. In its explanation, Thailand claimed that the violation was due to the presence of dark clouds, that was why the plane violated Cambodia’s airspace, and Thailand also claimed that this technical mistake was due to the fact that maps were not consulted properly only.

Nevertheless, Koy Kuong expressed Cambodia’s concerns for the pilot’s safety, because of this lack of attention, the pilot could face danger when he violates Cambodia’s airspace again in the future.
