The man accused of shooting the man who shot environmental activist Chut Wutty last April had been summoned to the Koh Kong Provincial Court to stand trial next month on charges of unintentional homicide, a court official said yesterday.

According to deputy prosecutor Srey Mak Ny, Timbergreen security employee Ran Boroth will appear in court on October 4 to face allegations that he shot military police officer In Rattana while attempting to disarm him after he purportedly gunned down Wutty, a widely admired forest advocate, on April 26.

“[We] have sent [citations] already,” Mak Ny said, adding that the court had called as witnesses “all who have ever been involved in this case”.

The facts surrounding Wutty’s shooting have been muddled from the start, with the government’s official version of events changing at least three times.

Murder Case Surrounding Death of Environmentalist Ready for Court

Chut Wutty was a prominent environmental activist whose work to stop illegal logging and deforestation earned him powerful enemies in the lucrative, illicit industry.

Chut Wutty was shot in the western province of Koh Kong, near an environmentally sensitive forest area he had spent much of his career trying to protect.

PHNOM PENH - Koh Kong provincial court will open a hearing early next month into the shooting death of environmentalist Chut Wutty and a military policeman in April.

One suspect, Rann Borath, the chief security guard for a logging company, has been charged with the accidental murder of Chut Wutty’s alleged killer, in a improbable scenario.

The court, which will open the hearing Oct. 4, says Rann Borath accidentally shot to death a military policeman, In Rattana, who was responsible for shooting Chut Wutty at a checkpoint in a remote forest of the province.

It’s useful once in a while to recall that I am not a politician and have no desire to be one. I am not here to tell people what they like to hear nor to disparage. I believe in the principles and ideals of republicanism; and I write about subjects I believe I am qualified to discuss. Readers’ actions and reactions are their own. While disagreements can provide the fodder for healthy debate, those engaging in debate should not display arrogance or intolerance. Passionate opinion can be expressed with civility.

My last article, "Khmer diplomat dubs Hun Sen a fabricator of Khmer history," appeared on the day of the late Srey Pheach’s funeral, attended by so many. It brought e-mails from Pheach’s friends and acquaintances from different places and from Phnom Penh where sits the dictator against whom Pheach fought until his last breath.

Validation

Pheach’s writing was validated by a high ranking member of the Khmer elite in Phnom Penh, whose credibility I have never doubted. I knew him when he was in the thick of the political events examined in the article. He referred to my article as "the most well written true story of Cambodia’s bloody past by the late Srey Pheach."

But he also added to the story Pheach shared. My friend wrote that Pheach did not mention the cessation of US bombings in 1973, followed by the "fast reduction of US forces from Vietnam," which hardened the "stubborn position" of the Vietcong and the North Vietnamese at the Paris conference. The war dragged on "for two more years until the total collapse of . . . Cambodia, Laos and South Vietnam"; and though Prince Sihanouk was assured by the VC/NVN they would help him return to power, they "preferred to deal with the Khmer Rouge for tactical and political reasons rather than with the . . . too independent minded" Prince Sihanouk.

A week earlier, a former US foreign service officer who had been attached to the US Embassy in Phnom Penh, told me he rejected "the old leftist allegation that US bombing was responsible for causing many Cambodian peasants to join the Khmer Rouge . . . used as an excuse for the atrocities perpetrated by the KR, a sort of ‘the bombing made them do it.’" He reiterated, Cambodians joined "the fight" called by Prince Sihanouk because they thought it was to restore the monarchy, rather than to support the Khmer Rouge. "Those allegations that the bombing caused people to join the KR are not based on any clear evidence as far as I know," he wrote. "This is an idea concocted mostly by Western intellectuals who then attempted to attribute it to the Khmer peasants."

Under a proposed 2011 development, dubbed AZ Town, roads, including the 60-metre Hun Sen Boulevard, would cross the lake or pass near it.

Villagers living in raised houses on the capital’s Boeung Tumpun lake fear their eviction is on the horizon as sand pumping increases at the site, they said yesterday.

“I do not know why they are pumping sand into the lake,” said Kong Sopheak, 31, a resident of Thnout Chrum II village in Meanchey district. “But I have just overheard that they plan to build a supermarket and department store and construct roads.”

In recent months, heavy machinery has been at work at the Boeung Tumpun site. Sand pumping has increased, and workmen, including one yesterday who said he was from Vietnam, have been regulars at the lake.

“I’m very concerned about eviction,” Keang Sok, a resident of nearby Chak Angre Leu commune’s Prek Takong village, said.

Free of the police resistance that thwarted their march the previous day, about 65 Borei Keila and Boeung Kak community supporters marched to the Ministry of Justice yesterday in another effort to have land dispute activists Tim Sakmony and Yorm Bopha freed from pre-trial detention at Prey Sar prison.

“We need justice,” the residents chanted as tourists at the nearby Royal Palace looked on. Bopha was arrested last week and charged with intentional violence.

Motodop group Cambodia for Confederation Development Association members have said the 29-year-old was involved in beating two motodops at Boeung Kak lake.

Borei Keila evictee Sakmony, 65, was arrested separately and charged with making a false declaration.

Dear friends,

The Asian Human Rights Commission (AHRC) is deeply concerned about the recent arrests and detention of two land rights activists consecutively in just two days. They are currently being held in pre-trial custody for their involvement in land protests. Ms. Yorm Bopha (29), an outspoken Boeung Kak Lake village representative, was arrested on September 4 and was sent to Prey Sor (CC2) Prison on the charge of intentional violence. This was followed by the arrest and detention of Ms. Tim Sakmony (65), a prominent land activist from Borei Keila community, on the charge of making a false declaration under article 633 of Cambodia's Penal Code.

These two well-known land rights activists have been advocating for land rights on behalf of hundreds of residents in high profile land disputes in the two communities in Phnom Penh. They have organized numerous peaceful demonstrations demanding fair compensation in exchange for their lands in Boeung Kak Lake community and Borei Keila which have been granted by the government to two private development companies: Shukaku Inc. and Phan Imex respectively.

The arrest and detention of the two land rights advocates have been condemned by local civil society organizations as a means to silence victimized communities and to halt demonstrations against the companies as well as the government.

CASE NARRATIVE:

In the past few years, there have been a number of development projects between the government and private companies to modernize Phnom Penh as globalization has been felt throughout the country. Development plans include constructing high-rise condominiums, modern shopping malls, and sports centers, which requires massive areas of land in Phnom Penh and the surrounding areas. As a result, many slum and under-developed areas have been targeted for these development projects, including Boeung Kak Lake and Borei Keila.

More than 200 residents of Boeung Kak Lake and Borei Keila marched to the office of Xok An, the vice-prime minister and minister of the Council of Ministers, to hand over their petitions asking for intervention for the release of two residents.

The two residents arrested are: (1) Yorm Bopha, a Boeung Kak Lake activist protesting against land-grabbing by the Shukaku Inc. Company, and (2) Tim Sakmony, a Borei Keila activist protesting against the Phanimex company which reneged its promise to build two additional buildings for the evicted residents.

Today’s protest took place after 2 of their representatives were summoned by the court and they were subsequently arrested 3 days ago.

A 65-year-old woman who has spent months sleeping under a staircase at Borei Keila yesterday became the second land-rights activist sent to Prey Sar prison in little more than 24 hours.

Phnom Penh Municipal Court investigating judge Ly Leabmeng questioned villager representative Tim Sakmony for almost five hours before charging her with incitement and ordering her to be locked in pre-trial detention, her defence team said.

“This court doesn’t offer any justice for the poor,” fellow Borei Keila resident Ath Samnang, one of about 100 supporters outside the court, said as she watched her friend being driven off in the direction of Prey Sar.
