Chinese, Cambodian legislators meet to enhance bilateral ties [-Will Hanoi tolerate this?]

Cambodian and Chinese legislators met here on Wednesday to exchange views and experience in environment protection and resource preservation.

The Chinese delegation of the National People's Congress (NPC) is led by Huang Xianzhong, vice-chairman of NPC Environment Protection and Resource Conservation Committee.

Meeting with Acting-President of Cambodian National Assembly Nguon Nhel, Huang said the visit was to study Cambodia's measures and legal frameworks in protecting environment and resource management.

He also hailed Cambodia for its efforts in protecting environment and cultural heritage.

In one of the stranger exchanges leading up to the speech, the prime minister’s office issued a letter yesterday denying the authenticity of a document posted on KI-Media only hours before. [Hun Xen's office sneaked and read KI-Media which is blocked in the Banana Kingdom?]

Prime Minister Hun Sen is primed to appear in the National Assembly tomorrow to clarify the country’s border demarcation policy with Vietnam, but opposition lawmakers are calling for a debate rather than a lecture.

In a letter sent to National Assembly president Heng Samrin yesterday, nine SRP lawmakers asked for an opportunity to pose questions in a forum-style setup, instead of sitting back and listening to what Hun Sen has said will be a four-hour speech.

“During this clarification, we request to have a debate, and exchange each others opinions between parliamentarians and governmental representative,” the lawmakers’ letter stated. “This debate will offer clearer information over border posts” dividing Vietnam and Cambodia.

About 200 people, including activist monk Loun Savath, rallied outside the National Assembly in Phnom Penh yesterday in support of the 13 Boeung Kak women sentenced to prison in a three-hour trial last Thursday.

Supporters of the women, including villagers, unions and human rights groups, called for the government to release the women as well as two more villagers, Ly Chanary and Sao Sareoun, the group’s only man, who were detained outside the women’s trial.

Demonstrators, who had pieces of paper stuck to their shirts saying, “Land robber is free. Landowner is jailed”, joined hands yesterday to sing songs about losing their houses to make way for CPP senator Lao Meng Khin’s $79 million development at the Boeung Kak lake site.

Prime Minister Hun Sen said yesterday he had rejected calls from opposition Sam Rainsy Party lawmakers to enter negotiations with him over the national budget bill, telling them instead that they were welcome to resign from the National Assembly if they did not want to debate the bill there.

Speaking at a public and private sector forum, Hun Sen also said he would not negotiate with SRP lawmakers even if they all resigned, saying that a minority party cannot force a ruling party to do its bidding.

He said that SRP parliamentarians had told him that if he did not negotiate with them, they would boycott the National Assembly or resign.

“I have written to them to tell them if you are crazy, only you are crazy. I will not join in the craziness with you, and it is better for all 26 [SRP] MPs to resign to avoid difficulties,” he said. Their seats would be divided among other parties, Hun Sen said, adding that he hoped they would attend today’s session at the National Assembly.

Synopsis: In the morning of 23 November, Hun Xen pushed all 26 SRP MPs to resign rather than just the four who had resigned recently. He said that the resignation of opposition MPs will not block the National Assembly sessions. "I would like to send my words to them: Don't be dumb, if you want to be crazy, be crazy by yourself, don't make others be crazy, I will not be crazy with them. There is no way for the minority to force a veto on the majority. The opposition has no veto rights."

All 26 opposition Sam Rainsy Party members are on the verge of resigning “any day” from the Cambodian parliament, SRP lawmaker Mu Sochua said yesterday, after three of the party’s MPs announced their official resignation.

Fresh from a recent trip to meet with pro-democracy icon Aung San Suu Kyi, Mu Sochua said it was striking that even in heavily oppressed Myanmar, the government understands the need for an opposition.

Whereas Suu Kyi has announced plans to contest Myanmar’s next election after boycotting the national ballot in 2008, in Cambodia, the opposition is on the verge of completely resigning from a parliament that does not allow their input, she said.

FROM THREE NATIONAL ASSEMBLY MEMBERS FROM THE SAM RAINSY PARTY

The three SRP National Assembly members who resigned today are Ms. Ke Sovannroth representing Siem Reap province, Ms. Thak Lany representing Kampong Cham province and Mr. Nuth Rumduol representing Kampong Speu province.

Here is the substance of the resignation letter each of them sent separately today to National Assembly president Heng Samrin:

Samdech President,

The purpose of this letter is to inform you of my resignation, effective today, from my current position as Deputy for the province of … (see name of constituency above).

The reason for my decision to resign is related to the fact that I can no longer stand the way the Government looks down on the National Assembly. While the Government policies have been causing destruction for our country and suffering for our people the National Assembly is only a rubber-stamp parliament that has never been able to help any victim of dictatorship and corruption.

My resignation is the final gesture on my part intended to awake our country leaders and push them to solve two most important problems that determine the life of our people and the future of our country:

1- The Government must stop confiscating land from the people and stop forcing people out of their homes. [Stealing our land is stealing our life].

2- The Government must overhaul the National Election Committee (NEC) so as to stop tempering with ballots and stop distorting the will of the people. [Stealing our vote is stealing our hope and our future].

My first demand is in line with a recent appeal by the United Nations to stop land grabbing and forced evictions. My second demand is in line with the recommendation by election observers from the European Union wishing to ensure cleaner and more acceptable elections for Cambodia in the future.

Even though I am leaving the National Assembly today I will remain active and socially engaged, using other means to defend our people’s interest and to help save our country.

THREE OPPOSITION NATIONAL ASSEMBLY MEMBERS

Members of Parliament from the Sam Rainsy Party (SRP) have the pleasure to invite journalists, members of the diplomatic corps and interested observers to a Press Conference to be held today, Monday, November 21, at 11:00 am at the SRP Headquarters located at 576 National Road Number 2, Chak Angre Leu, Phnom Penh.

Following the resignation this morning of three Deputies from the Sam Rainsy Party – Ms. Ke Sovannroth, Ms. Thak Lany and Mr. Nuth Rumduol – the National Assembly now consists of only 119 members, which puts its composition at odds with Article 76 of the Constitution: “The National Assembly consists of at least 120 members.”

At the Press Conference the concerned Deputies will elaborate on their motivation and the implications of their resignation.

SRP President Sam Rainsy, whose name was deleted from the list of Assembly members last March, will also intervene through a video conference.

Plans by the Cambodian opposition to withdraw deputies from the country's national assembly are set to trigger a constitutional crisis that will create risks for current and future lenders to the corrupt Hun Sen government.

The opposition Sam Rainsy Party (SRP) will reduce membership of the national assembly below the necessary quorum of 120 by resigning some of its deputies. The move will leave the government unable to legally validate the country's budget or to ratify loans.

Cambodia's constitution demands that international government borrowings must be subject to the scrutiny of the national assembly. The government has already overridden this principle by pushing authorizations to borrowing through the assembly en bloc rather than on a loan-by-loan basis, so effectively writing itself a blank cheque amounting to US$1.1 billion, or 10% of GDP, for 2011 alone. Details of the actual loans contracted are kept secret from the assembly, undermining its prudential role and making international lenders complicit in violating the country's constitution.

External borrowings allow continuous fiscal and monetary irresponsibility by the Cambodian People's Party (CPP)-led government, rampant government corruption, an undemocratic patronage system and the practice of buying votes. State misuse of funds greatly diminishes the beneficial impact of loans on the country’s population, but not the costs of repayment.

Article 76 of the country’s constitution states that the National Assembly consists of at least 120 members. Article 90 states that the Assembly shall approve the national budget, state planning, loans, financial contracts, and the creation, modification and annulment of tax.

The SRP solemnly warns current and future international lenders to the Hun Sen government that borrowings contracted without the necessary ratification are illegal. A future legitimately elected government would reserve the right to cancel such loans.

5 SRP MPs volunteer to resign

5 SRP MPs have volunteered to resign from their MP positions in order to put into application the strategy of forcing the National Assembly to become illegal in its upcoming ratification of the 2012 National Budget law. Mrs. Ker Sovannroth, the secretary-general of the SRP, told a local website that the five SRP MP volunteers include: (1) Mrs. Ker Sovannroth, (2) Men Sothavrin, (3) Ho Vann, (4) Nuth Rumduol, and (5) Mrs. Thak Lany. Ker Sovannroth said that in a first phase, 4 of the SRP MPs will announce their resignations, among them are 3 MPs currently occupying seats at the NatAss and the fourth one being Sam Rainsy.
