General director of Nokorwat newspaper Touch Kongkea has appealed a court decision that rejected his accusations media baron Soy Sopheap defamed him and stole personal emails.

Touch Kongkea sued the Deum Ampil Media Centre general director last year for allegedly accessing private emails between himself and Lim Bunheng, president and CEO of rice-milling company Loran Import-Export Co Ltd.

The emails, which have been seen by the Post, pertained to a planned takeover of a radio station run by Soy Sopheap.

Phnom Penh Municipal Court threw out the charges three weeks ago, but Touch Kongkea’s lawyer, Chan Vichet, said yesterday that his client had appealed this decision on February 29.

Phnom Penh Municipal Court yesterday dropped two complaints against prominent media personality Soy Sopheap, who was accused by Nokorwat newspaper general director Touch Kongkea of defaming him and breaching his privacy by accessing his personal emails.

Kor Vandy, municipal court vice president and judge, said the complaints were dropped because no real evidence was brought before the court.

“There is no proof to express that Soy Sopheap stole secret correspondent letters via the emails of Touch Kongkea as accused,” Kor Vandy said.

Television personality and website owner Soy Sopheap will not attend a scheduled court hearing this morning to answer charges that he defamed another media personality early last year and breached his privacy by accessing private emails, his lawyer said yesterday.

The hearing against Soy Sopheap, a high-profile TV pundit and operator of popular news website Deum Ampil Media Centre, will begin at Phnom Penh Municipal Court this morning, deputy prosecutor Hor Lina told the Post.

Soy Sopheap was sued by Touch Kongkea, managing editor of Nokorwat newspaper, on April 28 last year, Hor Lina said.

Chan Vicheth, Touch Kongkea’s lawyer, said that his client was seeking US$5,000 in compensation for defamation and breach of privacy. He accused Soy Sopheap of defaming his client by saying Touch Kongkea had threatened to have him arrested, and that the accused had also accessed his client’s private emails.

Synopsis: In a fit of rage against opposition leader Sam Rainsy who questioned the celebration of 07 January - a date that marks the invasion and occupation of Cambodia by Vietnam - Soy Sopheap, the editor of DAP-news, a mouthpiece of the ruling CPP regime, retorted by calling Sam Rainsy crazy and by accusing Sam Rainsy of following Nuon Chea's doctrine. Soy Sopheap miserably failed to remember that his boss, Hun Xen, was a Khmer Rouge who had faithfully followed Pol Pot and Nuon Chea. He also failed to remember that the CPP was itself a communist party.
