Auditing agents who are in charge of reviewing the budget expenses of the Extraordinary Chambers in the Court of Cambodia (ECCC) for judging the former Khmer Rouge leaders, released, on 8 May, information related to the budget for the operation of the joint UN-Cambodian tribunal which has an original funding of almost $60 million for a three-year operation.
As for the composition of justice officials for this special tribunal, observers do not believe that the Cambodian side had selected partial, fair, and independent officials to work with the tribunal.
Dr Lao Mong Hay, from the Asian Human Rights Committee, told RFA about his observations which could place this special tribunal to be under the influence of politicians without the UN ever noticing about this fact.
Dr Lao Mong Hay said: “By what I remember, Cambodian officials [in the tribunal] were selected from among Cambodian government officials, therefore, they were moved from various government departments to work at the tribunal. This is entangled with the legality on the selection of civil servants of the Cambodian government also. Therefore, I want to ask whether the agreement with the UNDP for the expenses, can it extend all the way to the selection of employees [for the tribunal] also or not? For example, if there is accusation about corruption, there are several types of corruption possible, such as only acquaintances, relatives, or group members can work [for the tribunal], then this is a form of corruption also. Paying bribes to obtain a position, or paying a kickback from the salary earned to the people who select [the tribunal employees], these are all corruption, there are many forms of corruption. Does the UNDP or the auditing agents can put their hands on these issues?”
