Sam Rainsy uses King-Father to shield himself after Hor Nam Hong’s lawsuit

Phnom Penh – On 25 April, opposition leader Sam Rainsy pushed vice-prime minister Hor Nam Hong to sue Hero-King Norodom Sihanouk who is currently residing in Siem Reap province, saying that he is only repeating what King Norodom Sihanouk said only, therefore, if Hor Nam Hong sues him, he should sue King-Father instead.

From Vancouver, Canada, where he is drumming support from overseas Cambodian people, Sam Rainsy told Rasmei Kampuchea over the phone that: “I only repeated what the former monarch said only. Therefore, if I am sued, he should sue King Norodom Sihanouk instead.”

He added that: “This is not my problem. I have sufficient document. This is not Sam Rainsy’s issue.”

Sam Rainsy involved this issue on former Hero-King, by basing on the event which took place 18-year ago in Paris, when King-Father accused Hor Nam Hong as the Boeng Trabek jail chief, and then, Hor Nam Hong sued the king back at the French tribunal. Sam Rainsy reminded that that in 1990, he helped find a lawyer to defend King-Father against Hor Nam Hong’s lawsuit. He added also that, at that time King-Father lost the case in the first trial, however, he could have won if he decided to appeal the case and he would gather witnesses from Cambodia to oppose the case in the French tribunal. But, King-Father did not want to see the case lengthened, and he decided not to appeal the case.

At the same time he is pushing Hor Nam Hong to sue the Hero-King rather than him, Sam Rainsy also said that he will help King-Father to clean up the former monarch’s honor. He said that he has witnesses whose relatives, parents died at Boeng Trabek. He will bring these witnesses to the court to confirm that what King-Father said was true. He said that any lawsuit brought up against him will help him receive more support from the Cambodian people. He said: “If they sue me, they help provide advertisement for me, therefore, I thank them.”

Beside this, Sam Rainsy said that this lawsuit against him at the Phnom Penh municipal court is not correct. The lawsuit should be brought to the KR Tribunal which includes the UN participation because this issue is related to the Pol Pot regime.

On 22 April, Hor Nam Hong sued Sam Rainsy for diffusing false information and defamation, after Sam Rainsy accused him (KI-Media note: in fact Sam Rainsy did not name Hor Nam Hong by name) of being the Beong Trabek jail chief during the SRP commemoration for the victims of the KR regime held on 17 April 2008, at the Choeung Ek Memorial killing field. However, besides saying that he was only repeating King-Father’s words, Sam Rainsy also said that, at the time, he did not name Hor Nam Hong explicitly.

According to the Cambodian law, Sam Rainsy could face jail sentence if the court find him guilty of diffusing false information insulting Hor Nam Hong. The lawsuit against Sam Rainsy creates concerns that it could block the political life of the opposition leader, and it will mar the political atmosphere just before the upcoming 27 July 2008 election. However, Hor Nam Hong said that he will end the lawsuit in order to lighten up the atmosphere, should Sam Rainsy apologizes to him and he recognizes that he misspoke. However, Sam Rainsy plans to return to Cambodia on 29 April, and there is no apology given by Sam Rainsy at this time.

Oh enough rhetorics already, this is certainly ain't going to bail him out of libel charge. Moreover, it's stupid to suggest Hor Nam Hong to file a civil case with the ECCC. He's bluffing. If there is such witnesses Hor Nam Hong would have been arrested long ago. And if Sam Rainsy got such witness and not provided their names to the ECCC, that will make him part of an accessory to criminals.

The bottom line is Sam Rainsy isn't smart enough to throw our court a curve ball. The truth will come out, and he'll get the max for sure.

In country such as Australia and NZ, if a minister of the government is being alleged by opposition leader, that minister should be resigned from his post for a full investigation for his crime. He cannot sue anyone yet while he has still to defence his allegation. Until his is cleared from his allegation, the Prime minister can then decide to re-instate him back to his post. If during his investigation, he has found a crime, then, he has to resign completey from his member of parliament and be sentenced for his crime. But if after the investigation, he found no crime, then he can sue back for his lost of his salary during his resignation. According to this story, Hor Nam Hong should resign from his ministerial position and stay as a back bencher and allow all investigation aganist him. Areak Prey

In fact the King Father did not present himself in front of the tribunal nor did he appealed the decision of the first instance Paris tribunal because he feared that the Peace Process for Cambodia would be derailed by such legal case and he felt that the end of the Vietnamese occupation of Cambodia and the return of peace and independence to Cambodia was more important that the legal case in Paris.

However, Princess Sisowath Ayravady, whose mother Neak Moneang Plous (wife of HRH Prince Norodom Phurissara) was killed together with the Prince by the KR, issued a written statement pointing out that a number of people had disappeared from Bang Trabek while Hor Nam Hong was "Head of Prisoners". So did, the late Madame Ieng Kounsaky and others. In fact most of the families of "Sihanoukist" Ambassadors who had rallied to Sihanouk after the 18 March 1970, people like Huot Sambath, Chea San, Chak Sarik, Isoup Ghanty and Nou Pech, to name a few, until this day blame Hor Namhong for the death of their respective husbands, fathers, mothers and relatives at the Bang Trabek Concentration Camp under the direction of Ieng Sary and with Hor Namhong as "Head of Prisoners"

Many posters here always claim for law and order and respect for the rule of law. Then this case must viewed in the context of applicable legal procedures. First, this case is full of inconsistencies. Obviously, the lawsuit in France is the last legal word on it. It is significant that Sihanouk did not appeal. By not appealing he accepted and acknowledged the verdict. He was wrong in naming Hor Nam Hong in the first place if he was afraid the entire affair would derail the peace process. If Sam Rainsy now moves Hor Nam Hong into the proximity of the prison warden, or jail chief, or insinuating that he was instrumental in killing people in Boeng Trabek, even if not mentioning his name directly, but indicating his person as a possible accomplice in view of that French verdict he must realize that he may be subject to a libel lawsuit. He always proclaims everybody must abide by the law. But he must be the first to do so. He can't just except himself at will. Now he is risking being immobilized before the election. He may not have thought through his remarks when he made them, as he is often prone to do. He just seems a little too impulsive. This is something the leading opposition politician can't afford under the circumstances. Given the French verdict it must be assumed he will be found guilty under the current Cambodian judicial system. Let's see what happens. An interesting case.

As I have said before in every advance countries, all elected position must have their manuals. So all ministers must have their ministerial manual too. So all the members of Parlament must also have their manual with full description for what they can and what they cannot. All the information included their salary, their allowance and their full political right. All alleged persons cannot sue their plentif without making a defence first. To defence their allegation all alleged person must resign from their position for a full investigation. Until this person be cleared from investigation, that person can be re-instated to their old position from PM. Without having cleared from investigation, that person cannot even entering their name for another election. Without having his name during election that person will not be able to work in the parliament as an MP at all. You can ask this problem to Mr Meng LYQSM at mengly.org

During Pol Pot, you know, many people died because other people who were in a position of power, be big or small, had the urge to abuse their position. Often just to show to Pol Pot KRs that they were with them in order to survive themselves, so in the process they victimised other people around them. This happened to a lot of arrests and killings throughout the country. Those local leaders too it into their own hand. The word Khmang was so general, up to local leaders to interpret.

Hor Nam Hong , I believe, was in the same position. Madam Keo Bunthurk, before she died, said the same thing about Hor Nam Hong, that he caused the death of her husband. Not just the father, even his son, Hor Nam Bora, was a powerful figure in the yough group, at Boeng Tra Bek. One day he accused Chem Snguon' son of doing something wrong, which caused the later to be arrested. Chem had to go and beg all the KR people he knew in order to get his son released. Otherwise he almost have been killed. To the last day before his death, Chem never forgave Hor Nam Hong, although they bother were serving as yuon puppets together. Having observed how Hor survived, always at the top, one has to wonder how he managed to do this while people around him had met their ill fate. He is very cunning and resilient. He knew, and still does, how to use and abuse in order to survive.

Believe it or not! The whole Cambodia is like a giant prison and all Khmer Rouge prisons are designed to kill Cambodian people whether the prison is Toul Sleng or Boeng Trabek prison or any Khmer Rouge prison because all prisoners are consider the enemy of Angkar!

Just remember the Khmer Rouge achieved zero crime rates because criminals are killed right on the spot!

If AH HOR NAM HONG found to be affiliated with the Khmer Rouge prison in any way shape or form and that is enough to convict him as a killer just like AH DUCH!

There are those witnesses who still alive and live to tell their story of their love one who die at Boeng Trabek prison and now it is the time to listen to their story!

KR prison would be under the control either army or secret police of the region.leaders of the particular region would mainly aware of what happening in prison, apart from those were killed by hatred or personal clash.

I stronger believe that Boeung Trabaek prison had a closed link to Tuol Sleng, where Duch was in charge.Duch can be witness if needed, along with other leaders that could be traced. khieu Samphorn can possibly expose a lot of how hiarrachy consisted of.

For sure , the truth will come out. As it was commented that it is interesing to know how these two every regime ministers survived, but those innocents and khmer compatriots were killed.

The Khmer Rouge that is in court today are the Khmer Rouge on the Chinese's side. How can one get punished and not the other? is beyond anyone's imagination. Justice will not be fully served until both of the criminals are in court. MR. HOR NAM HONG IS NO LESS AND SHOULD BE INCLUDED. GET THEM ALL DOWN TO THE COURT ! May be they will get less sentence for NOT fully stayIing in the regime, but all should be punished at some degrees and be removed from all the government seats.
