Excerpts from a book written in French by Ong Thong Hoeung, titled “I believed the Khmer Rouge,” published in 2003 by Buchet/Chastel.
Ong Thong Hoeung, who now lives in Belgium, was a prisoner of the Khmer Rouge from 1976 to 1979. He was notably incarcerated in the famous Boeng Trabek re-education camp (the “prison without walls”) where Hor Nam Hong, the current Minister of Foreign Affairs of the Phnom Penh regime, was also.
My interlocutors [co-prisoners at the B32 camp where Ong Thong Hoeung just arrived] detailed that Hor Nam Hong and Van Piny [the former president of the B32 camp, right before Hor Nam Hong] were docile instruments of Savorn [the Khmer Rouge chief who supervised, under Ieng Sary’s direction, the Boeng Trabek prison complex which consisted of the B30, B31 and B32 camps], and that they mistreated those who were under their responsibility. This, no one seems to forget about it easily. [Page 221]
At the end of October [1978], a meeting was held under the presence of Ieng Sary to provide the B32 camp with a new management team. (…) Hor Nam Hong was maintained in his duty as president, heading a committee consisting of five members. [Page 221].
I was intrigued by the good relationships between Ieng Sary and Hor Nam Hong. [Page 221].
Almost all the other moderate members [consisting of intellectuals and diplomats from the old regime] have disappeared [killed by the Khmer Rouge]. Only Chan Youran and Hor Nam Hong remained, they became faithful servants of the Angkar [Khmer rouge organization]. [Page 222].
People talked about it [a “black book,” for external use, regarding the “Vietnamese criminal schemes” which was written in French and published by the Pol Pot regime], as Hor Nam Hong and Pech Bun Tong spent almost one day to translate this book into Khmer. [Page 223].

Ong Thong Hoeung who was successively jailed in the B30 and B32 camps, described the plots among the prisoners who wanted to become the president of the camp. This is what he wrote about the case of the B30 camp:

5 juin 08 - En général les juges sont nommés afin de garantir leur indépendance. La Suisse, le Japon et les États-Unis font exceptions en permettant à des juges locaux d’être élus par le peuple. Un choix pour prévenir le népotisme.
Pamela Taylor / Tribune des droits humains – "Dans les pays que j’ai visités, en particulier les pays les plus pauvres, les juges sont choisis par le pouvoir exécutif et il appartient à l’exécutif de les sanctionner si nécessaire », souligne d’emblée Leandro Despouy, rapporteur spécial des Nations unies pour l’indépendance de la magistrature (dont le mandat onusien n’inclut pas cette problématique).
Et l’expert indépendant de poursuivre : « En général, je ne suis pas en faveur de l’élection des juges. Ils doivent être choisis pour leur mérites, leurs connaissances et leur indépendance, de manière à résister aux pressions des politiciens. "
De fait, cette opinion prévaut dans la plupart des pays où le choix des juges est fait par l’exécutif. C’est le cas aux Etats-Unis pour les juges de la Cour suprême. Par contre dans quelques Etats, les juges sont désignés par scrutin populaire.
"Ce système a pu apparaître comme raisonnable dans le New Jersey de 1795, déclare Mitchel Lesser, professeur de droit à l’Université de Cornell à Ithaca, dans l’Etat de New York. Mais étant donné les réalités d’aujourd’hui, notamment le financement des campagnes politiques, ces élections judiciaires font l’objet de graves abus. »
Le professeur assure que la plupart des électeurs n’ont aucune idée pour qui ils votent quand il s’agit de juges. Ils se déterminent donc selon leur préférence politique.
La Suisse permet un système similaire dans certains cantons comme celui de Genève où le mois dernier les électeurs se sont déterminés sur deux candidats au poste de procureur général du canton.
Philip Grant de l’ONG genevoise TRIAL (Track Impunity Always) souligne que c’était la première fois qu’un procureur sortant avait un candidat qui lui était opposé.
"Il en a résulté une campagne médiatique où s’affrontait la droite défendant le candidat sortant et la gauche avec son propre candidat, raconte Philip Grant. La campagne comprenait des questions qui ne relèvent pas du mandat d’un procureur indépendant, comme celle de savoir s’il faut ou non expulser les criminels étrangers. »
Au final, le procureur sortant - Daniel Zapelli – a obtenu un nouveau mandat. "Notre système est un peu bizarre mais ça marche et aucun juge à Genève a manqué à son indépendance », explique Philip Grant qui n’a pas voté pour Zapelli.
Mais Philip Grant admet bien volontiers que le gros problème de ces élections de juges tient à l’ignorance des citoyens quant à la valeur réelle des candidats. « Ce n’est pas une démocratie très saine lorsque les gens ignorent tout du système judiciaire et des juges qui le composent."
Mais, bien sûr, dans les pays où les juges sont nommés, les gens en savent encore moins à leur sujet.
De son coté, Mitchel Lesser ne recommande pas l’élection des juges pour la plupart des pays. Mais il convient que la Suisse peut gérer un tel défi.
"La seule raison pour laquelle ça marche dans un pays comme la Suisse tient à la petite taille de ce pays et à sont électorat, le plus informé de la planète", souligne le professeur.
Mitchel Lesser estime que l’élection des juges en Amérique remonte au président populiste Andrew Jackson (1829-1837) et à sa méfiance envers les élites dans leur capacité de prendre de telles décisions. "Le sentiment qui s’est développé était que les juges pouvaient être achetés selon les préférences personnelles de ceux qui faisaient la sélection. De nombreux États américains ont estimé que des élections ouvertes et démocratiques seraient plus justes. "
Les partisans de l’élection des juges estiment que cela les rend plus responsables devant le peuple. Par exemple, les électeurs dans de nombreux États des États-Unis pensent que la justice est trop clémente avec les criminels et ils exigent des peines plus sévère. Ils préfèrent donc que le juge qui ne tient pas compte du sentiment populaire puisse être remplacé au travers des élections.
Ce scénario inquiète Leandro Despouy. « Les juges doivent suivre la loi - pas l’opinion publique. Le fait est que les juges doivent être professionnels, objectifs et indépendants. Ils doivent résister aux pressions et aux médias."
Mais les choses sont peut-être en train de changer aux États-Unis. Au cours des 15 à 20 dernières années, une pression s’est fait jour pour appler à une réforme. Un mouvement, pris très au sérieux dans les cercles judiciaires, s’est développé sous le nom de « Missouri Merit Plan ».
En 1940, les électeurs du Missouri ont adopté un nouveau système après plusieurs contentieux judiciaires liés à des élections fortement influencées par la machine politique de l’époque. Cette nouvelle procédure est considérée par beaucoup comme le moyen le moins partisan de fournir aux tribunaux des juges de qualité tout en donnant aux électeurs le dernier mot.
Le plan Missouri est actuellement utilisé dans 11 États américains et une variante est également en vigueur dans plusieurs pays.

Whore Namhong can deny his role in the KR regime, but he must remember that there are documented evidences proving his role in KR regime. Thong Hoeung and other Boeng Trabek's prisoners should lodge a law suit against Namhong in the Belgian court because in Belgium they allow victims of crimes, no matter where the perpetrators live, can lodge their suit in the Belgian court. Le peuple khmer veut savoir la vérité de ce crime contre l'humanité commis par le régime de Pol Pot.
