It has been 3 days that opposition leader Sam Rainsy lost his parliamentary immunity. Recently, Sam Rainsy sent a letter to Heng Samrin, president of the National Assembly (NA), asking him to cancel the suspension of his parliamentary immunity.
Up until Sunday morning, the NA has maintained the decision to lift Sam Rainsy’s immunity even though the National Election Committee (NEC) had already withdrawn its lawsuit against the opposition leader in this case.
Sam Rainsy considers the lifting of his parliamentary immunity a threat to shut down the opposition voice: “What they did was illegal, they did it in haste to threaten the opposition spirit.”
Sam Rainsy gave this reaction after he sent a letter to Heng Samrin to request for the cancellation of the decision to lift his parliamentary immunity.
On 26 Feb, based on the request made by the NA permanent committee, Heng Samrin agreed to lift Sam Rainsy’s parliamentary immunity.
The request to lift Sam Rainsy’s immunity was aimed at bringing him to court to face a NEC lawsuit in regards to the NEC fine imposed on Sam Rainsy for his disparaging remarks on Hun Sen during the 2008 election campaign.
A few hours following the decision to lift Sam Rainsy’s immunity, the SRP had decided to pay off the 10 million riels fine as imposed by the NEC. After this pay off, the NEC decided to drop its lawsuit against Sam Rainsy, all that remains now is for the NA to cancel the lifting of his parliamentary immunity.
On Satruday, Sam Rainsy said that he wrote a letter to Hen Samrin regarding this issue. Sam Rainsy said: “I saw a letter issued by Mr. Im Suosdey, NEC president. Mr. Im Suosdey wrote a letter to the prosecutor of the Phnom Penh municipal court to withdraw the NEC lawsuit against me. Therefore, the NEC considers this case closed, and it asked the court to end this lawsuit. So, I also wrote to Samdach Heng Samrin telling him that, since the NEC withdrew its lawsuit, the NA also must urgently give me back my immunity.”
On Saturday, and again on Sunday, Heng Samrin could not be reached, and neither are the officials involved in the decision to lift Sam Rainsy’s immunity.

What is the future of SRP? It will be very difficult for SRP to topple the CPP. IF it won the next election this Hanoi-backed impunity government will reluctant to handle the power, nonetheless. SRP must have a strong tie with the US to sustain its existent to CPP.The European country are powerless since they don't have a great interest in Cambodia like the US does. The hope for to rescuing Cambodia from falling to Vietnam will disappear if SRP failing to secure the majority vote in 2012 election. Poor Khmer race!!!!

Ah Scam Rainxy has to face a defamation charge against Hor Namhong yet. Therefore, the immunity must not be restored until all case has been addressed because the court will required the lift of the immunity before they can process the case.

I felt that Mr Sam Rainsy political future is at risk now for not be able to argue for his illegal lift his immunity. He should work strongly with all NGO and medias to support him that his immunity is not getting through Cambodian Parliament at all. His immunity was given to him by NATIONL GENERAL ELECTION. Only NATIONAL GENERAL ELECTION in 2013 can lift his immunity by rejecting his membership as future of member of Parliament. He can fight with NEC in court as long as the court cannot settle the dispute between Nec and Mr Sam Rainsy. The Court cannot propose to National Assebly to strip his immunity at all if Mr Sam Ransy hasn't committed a crime like Killing or stealing. Areak Prey

Don't listen to Ah Pleu (3:26). If everyone is immune from the law, there is no need to have a court or lawyer. It's just a waste of money.
Therefore, for the court to process any litigation, no one should be immune from the law. This is not the court decision, but the rule of the court.

The court is where peole can get their justice. The court shouldn't work in favour to anyone in power at all. In all democratic countries, their leaders won't hear for loosing court battle. Indeed they will be prouded if their citizen can win battle with them because it proves that their country has good justice system for all citizens and proves that their citizen are very mature citizen. If I am Mr Sam Rainsy, I would contest with the court and worst come to worst, I would be one of the Mr Mam Sonando.Areak Prey

I am fully agreeing with your comment. I have written all of these to many government around the world. Sometime I have made request to Chinese international television chanel CCTV9 to interview with Hun Sen for all chainese aids to Cambodia and to ask him what he has done to cut done poverty in Cambodia. Cambodia is needing a strong opposition leader to succeed Mr Sam Rainsy in the next election. I can forsee that next election will be also a hard one. I have written to comfrel about my opposition to may election for local election which is going to be a flaw one. It will be an undemocratic local election where ordinary people will be banned from voting for local representative. I think SRP and HRP should be boycotting that election if they want Cambodia to move forward with full democratic country. Areak Prey
Ah Pleu (7:14) is talking nonsense here. There is nothing to contest. The court can't render any verdict to anyone if they are immune from the law. So why have a trial. It's simple 3rd grader common sense, which is something that Ah potato digger (7:14) lacking off.
