The defamation trial opposing Hun Sen to SRP MP Mu Sochua took place in the morning of Friday 24 July in the Phnom Penh municipal court.
The Kampot MP showed up in court without defense lawyer and she chose to use her right to remain silent during the trial. She did not answer to the judge’s questions. Ky Tech, Hun Sen’s lawyer, who was present during the hearing, asked the tribunal to sentence Mu Sochua according to the law while asking 10 million riels ($2,500) in damage compensation. At the end of the hearing, Mu Sochua asked the tribunal to judge the case according to the spirit of the law and not based on the court’s concerns about men in power.
With Mu Sochua refusing to answer questions, the trial was essentially based on the report provided by each party during the court process. There was no argument in the case. After two hours of hearing, the judges announced that the verdict will be delivered on 04 August.

One would have to be either exceptionally naiive or extremely courageous to pursue a political vocation anywhere in the oppressive climate that is Cambodian politics. But when one happens also to be a woman, a mother and on top of that being allied to the only cohesive Opposition party in the country, the odds of winning any legal case are not that promising let alone a defemation lawsuit filed by the head of the ruling party Himself.
Both plaintiff and defendant are children of Cambodia; of her recent turbulent past and are both comtemporary in the evolving, cloudy chapter in their nation's history. But what divides them might be something far more decisive and fundamental than their mere personal opinion or distaste of one another which constitutes the backdrop to this saga that would otherwise be entirely comical were it not at the same instance symptomatic of a deep national malaise which has been crying out for cure, yet nonetheless has managed to evade clinical obligation and in so doing cheated the cause of every conscienable man.
Everyone in the country is aware of the untransparent and linear character of the nation's judiciary setup. In essence, the Court is neither a repository of justice nor injustice; its primary function is the fulfilment of Executive commands and wishes; an extension of systematic monopoly over the masses and organised dissidents alike through the olive branch of official corruption at all strata of society.
This reality, however, is not the sole legacy of the CPP or its foreign backer, but also of Cambodian feudalism that has formed and arranged socio-political conduct throughout the Khmer universe over the centuries, including the legal framework itself. If sleeze or corruption in public life is somehow more pronounced today, it is partly the culmination of past events and circumstances.
In purely PR terms, this legal spat is reflecting badly on the plaintiff/prosecution and regardless of the verdict, a sad indictment of the court systmem and well-being of Cambodian citizenry who deserve far better in their mundane, daily life.
It was a huge mistake to have dismissed Ms Sochua's charge and her compensatory (if slight) claim of 100 riel or so. After all, the accused, if found guilty, would not have to endure a moment in prison. That he decided to counter sue and use all the array of weapons at his disposal bespeaks of provoked reaction, one that appears disproportionate to the circunstances as well as the dignity of both parties.
And herein lies the truth in the age old maxim that power corrupts.
