The Cambodian ministry of Justice plans to push the Svay Rieng provincial court to summon opposition leader Sam Rainsy soon in order to question him about the destruction of public properties charge, a criminal offense, leveled against him recently.
The exact schedule for the issuing of this summon has not been set yet.
Ang Vong Vattana, the minister of Justice, said during a press conference held at the council of Ministers on Monday 16 November that: “Following the lifting of [Sam Rainsy’s] immunity, the prosecutor of the Svay Rieng provincial court will summon H.E. Sam Rainsy for questioning, this is not an actual questioning, it’s only for him to reply about the rule of the accusation, and also to collect evidences for the investigation.”
Keo Thea, the Svay Rieng provincial court prosecutor, said that he cannot tell the schedule of Sam Rainsy’s summon.
Keo Thea said: “I cannot provide the information for you, this is H.E. Sam Rainsy’s immunity. It depends on the MPs. How the National Assembly moves forward, I don’t know. Therefore, I cannot provide the information to you.”

Var Kim Hong said: “In Svay Rieng province, Mr. (Sam Rainsy) ordered his group to pull and destroy the 6 stakes for the border post, they (stakes) surrounded the area to plant the post that our technical group is looking for a proper location in order to install the permanent border post.”
On the other hand, opposition leader Sam Rainsy said over the phone from France: “In Cambodia nowadays, it is very strange: those who are faithful to the nation, those who are faithful to the people, they are met with problems, but those who oppress the people, those who destroy the nation, those who sell the nation get away free, and they also obtain high position.”
Sam Rainsy did not provide the schedule for his return to Cambodia yet.
Immediate reactions from high-ranking government officials came on the same day that Sam Rainsy saw his parliamentary immunity lifted by the National Assembly. The immunity lifting was made to allow the Svay Rieng provincial court to summon Sam Rainsy for questioning on the charge of destroying public properties in Samrong commune, Chantrea district, Svay Rieng province on 25 October 2009.
Cambodian government border experts indicated that Cambodian and Vietnam have planted more than 100 posts in 9 provinces bordering the two countries. The two sides plan to install all the border posts before the end of 2012. A total of 370 border posts will be planted.

Speaking at the Council of Ministers on Monday evening, Var Kimhong, senior minister in charge of border affairs, said the Assembly had suspended Sam Rainsy’s immunity because he destroyed border markers agreed between the two countries.
He said the border posts were placed on the basis of treaties signed in 1985 and 2005, and that although land had been ceded to Vietnam in some areas, it was compensated by gains elsewhere.
“We did [border demarcation] by bipartisan agreement.... We did not allow Vietnam to take action based on their own decisions,” he said.

The CPP government should do an enquiry to the legitemcy of Sam Rainsy claimed, UN Boarder representative should be onsite. To determine if the Boarder post is Planted in Cambodian Soil. IF SO Vietname is violating and Sam Rainsy immunity should be return.
Now Sam Rainsy should have Record of where the post was planned.
