THE REAL COURT IS IN HANOI
From 28 December, I will happily let the Svay Rieng provincial court, a branch of the CPP-subservient judicial system, prosecute me in absentia because its verdict is known in advance like with any kangaroo court.
It’s useless and meaningless to defend yourself before a servant. You’d better address the master. Therefore, I am willing to show up and to be prosecuted in person in Hanoi because my trial is a political one first ordered by Vietnam’s government (*).
I am accused of removing a border marker with Vietnam and, following the logic of the accusation, that border marker is a property jointly owned by Vietnam and Cambodia. Furthermore, Vietnam’s Prime Minister Nguyen Tan Dung was the first government official from the two countries to denounce my act and to call for my punishment (*).
Therefore, being now in a third country, both the Vietnamese government and the Cambodian government can prosecute me, and I can go either to Vietnam or Cambodia to be prosecuted for the alleged crime.
I accept to go to Vietnam and to be tried there, before a Vietnamese court in Hanoi, any time. There, with the Cambodian people and the international community watching from some distance and with serenity, I will be able to raise the real issue and to defend Cambodia’s interest. The real issue is not with Sam Rainsy; it is between Vietnam and Cambodia and is related to border encroachments and violation of Cambodia’s territorial integrity. I will denounce the unfair 1985 border treaty signed by a Cambodian puppet regime led by the same prime minister for 25 years. I will defend countless Cambodian farmers whose rice fields and other farmland are being seized by the Vietnamese authorities with the complicity of the Hun Sen government. I will invoke the 1991 Paris Peace Agreements on Cambodia and its provisions on Cambodia’s independence, sovereignty and territorial integrity. The effective implementation of the Paris Agreements will also help solve border disputes with Thailand.

One may remember that from the beginning of his political fight, Sam Rainsy said that he was not going to become an alibi to Hun Sen. I prayed that he was not going to be an alibi too long but he has been one for quite some time.
From no seat to 26 seats in the Cambodian Assembly, he has been fighting the wrong battle, the battle that has been set for him and other so-called oppositions just to become an alibi for Hun Sen and the CPP. Regardless of what he has done and will do the result would be the same--the CPP will always win and either Hun Sen or his replacement will be the next prime minister running Cambodia for Vietnam. The chance of having the current electoral processes changed is zero. The "50% plus one" formula is written in stone, so to say.
Ever since the Khmer Rouge regime was toppled by the Vietnamese armed forces, most of us know that the CPP and it members were merely the products of Vietnam. Some call them Vietnam's puppets, some name Phnom Penh's government as the Vietnam's backed regime, others name Cambodia as a Vietnam's vassal state and a few others brand members of the CPP as Vietnamese dogs. Regardless what they name Cambodia, she remains a country that is run by the CPP which has been heavily influenced-- if not fully controlled-- by Vietnam. Friends, I think the war is not the best option. The way to solve the problem in Cambodia is to provide Cambodians with access to neutral information. As we have observed, the state medias are only the tools to strengthen the CPP by manipulating the poor and those of disadvantaged groups who form the majority of Cambodia. So, if the poor and the disadvantaged majority in the country can access to neutral sources of information like those who are in this loop of communication, I think, Cambodia will change in the very near future.

It's laughable when Xam RainXy annouced that he is willing to show up and to be prosecuted in Hanoi. This is his new stunt and a big liar. It's the same way that he have annouced that he will take this issue to International Court and will come to Cambodia soon, but so far, there is no International Court and he doesn't dare to step in Cambodia's soil. There are 4 scenarios for Xam Rainxy's immediately future:
1. He is staying in France as he was before jumping into politics in Cambodia (go back to square one).
2. He goes to Thailand and ask his ally (Democrat party) to appoint him as economic advisor to Thailand's government and use Thailand as a base to attack to Cambodian government.
3. If he's a brave man, please come to face the Court in Svay Reang and prepare to accept the verdict as most people do. Don't be afraid to go to jail if he dared to commit the crime.
4. Waiting in France until the Court issued the verdict, if he was found guilty, he will bow his head to the ground and write a sweet letter to "APOLOGY" to PM Hun Sen as well as government, please let him come back to Cambodia to continue his political career likes PM Hun Sen forgave him in 2006. Xam Rainxy will use the word "National Reconciliation" as a pretext to save his coward act and ugly face.

Vietnam cannot extradite Sam Rainsy and forcibly send him to Cambodia because he holds French citizenship and a French passport. At worst, he will be sent back to Paris. Outside Cambodia, Cambodian Americans are treated as US citizens and Cambodian French are treated as French citizens. This is international law supported by diplomatic protocol.

But, to my observation, many Khmers who have returned from abroad tend to be quiet and "yes, sir" all the time in order to save their position. At this point though, I highly value Mr. Son Chhay who comes from Australia to genuinely serve his nation.

Believe me, Sam Rainsy will not go to Vietnam, knowing too well that he will have even fewer opportunities to fight. You guys must not get me wrong; it is too far from possible that I am a CPP tool.
