The second Samrong commune councilor was summoned by the Svay Rieng provincial court to provide clarification next week on the destruction of public property and incitation charges leveled against Mr. Sam Rainsy.
On Wednesday 16 December, the Svay Rieng provincial court summoned the second Samrong commune councilor, who was elected under the SRP banner, for questioning in relation to the charges of destruction of public property and incitation for racial discrimination leveled against opposition leader Sam Rainsy for alleged act he committed last October.
The summons ordered the commune councilor to come in for questioning and clarification on 22 December 2009.
40-year-old Pov Pheap, the commune councilor summoned by the court, received his summon on Wednesday. He indicated: “The court summoned me as a witness to provide clarification on 22 December in Svay Rieng. This is regarding the case which took place on 25 [October], the day when President Sam Rainsy organized a kathen ceremony.”

Pov Pheap: This I must go because the summons clearly indicated so, it even bears an [official] stamp, I must show up.
SRP MP Yim Sovann, the spokesman for the SRP, commented by saying: “I am confident that the SRP will absolutely not be scared because the SRP still claims that what Mr. Sam Rainsy did, he did it on a plot of land belonging to villagers. These stakes are planted on land belonging to a villager [i.e., a private property].”
Nget Nara, a facilitator for the Adhoc human rights organization in Svay Rieng province, said that two laymen from the Wat Ang Romdenh pagoda located in Samrong commune, Chantrea district, Svay Rieng province, were also summoned by the court for questioning soon.
Nget Nara said: “Two other pagoda laymen were also summoned. Regarding this case, I will follow up all additional acitivities to find out the dealing of the court and the legality of this case. I will also follow up on all additional activities [related to this case].”
The court action to summon a large number of people as seen above takes place at a time when it also announced the charges against Sam Rainsy: destruction of public property, incitation for racial discrimination. The court is currently investigating this case.
Sam Rainsy saw his parliamentary immunity lifted on 16 November after he pulled out 6 border post stakes along the Cambodian-Viet border on 25 October. The lifting of Sam Rainsy’s immunity was conducted so that he could face the charges leveled by the court. Sam Rainsy uprooted these border stakes after listening local villagers who claimed that these stakes were planted in encroachment of their rice fields.
The uprooting of the stakes took place on the same day the SRP organized a kathen procession to the Wat Ang Romdenh pagoda, located in Samrong commune, Chantrea district, Svay Rieng province. During the ceremony, two pagoda laymen belonging to the pagoda committee received the donation from the SRP kathen ceremony even though they were threatened [by the authority] ordering them not to accept the donation.

Will Xam RainXy become an economic advisor to Abhisit's government?
According to PM Hun Sen's speech yesterday, Xam RainXy's political career is on the line now. If the Court found him guilty and PM Hun Sen refused to write a pardon letter to King Sihamoni, Xam RainXy has no way come back to Cambodia. Will Xam RainXy dare to serve jail time in Cambodia? I don't think so.
The more Xam RainXy dares to jump too high, when he falling back it will hit him very painful.
I will put my house and bet that when Xam Rainxy has run out of option and no where to go, he will bow his head to the ground and writes the letter to "Apology" to the Cambodian government, please let him comes back home in Cambodia. What ashamed?
