Persecuting Cambodia’s defenders

“To put it bluntly, the court case against the land owners and Mr. Sam Rainsy is a case of persecuting and prosecuting border defenders, while awarding traitors with plum positions within the government.”

The arrests of the two farmers and the issuing of an arrest warrant against Mr. Sam Rainsy is another classic example of the ruling Cambodian People’s Party (CPP) using the court as a political tool to crackdown and persecute victims and its political opponents.

At a glimpse, the court case against Mr. Sam Rainsy seems like a legitimate legal remedy to settle legal issue, but on the outset it is just a political tool and a front that hides behind the real motives to settle old scores, persecute patriots and crackdown on opponents of the ruling CPP. The case itself, if anything at all, is a political witch-hunt and a sheer attempt by the ruling CPP and Mr. Hun Sen to silence their critics in order to whitewash their failures and their incompetence to defend Cambodia’s borders and territorial integrity against foreign encroachments.

My rationale above was based on the irregularities in the court proceedings. The court, labelled by Mr. Sam Rainsy as the kangaroo court, was too hasty in issuing arrest warrant against Mr. Sam Rainsy without considering a delay request lodged by Mr. Rainsy’s lawyer or given time for appeal. Two farmers, the land owners whose lands were encroached by the border markers, were arrested immediately after they appeared in court, adding insults to injuries after their lands had been encroached by the border markers.

These irregularities have made the court vulnerable to accusations of acting as a political tool and a front of the ruling CPP to crackdown on dissenting voices and its opponents. The Sam Rainsy Party (SRP) went further by accusing it of acting as a state apparatchik to terrorise the population into stop exposing the traitorous border policies of the ruling CPP and any other issues that is embarrassing for the government and the ruling party itself. To put it point blank, Mr. Rainsy and the arrested farmers are the perfect scapegoats for the CPP’s and Mr. Hun Sen’s failed border policies.

The sheer injustices had been blatantly shown in this case. The two arrested farmers and the three farmers who went into hiding, were not only defending their rice-fields, but they were also defending the territorial integrity of Cambodia against foreign encroachments. On top of losing their lands to foreigners, like rubbing salts on top of an open wound, they have been further victimised by a jail term. To put it bluntly, the court case against the land owners and Mr. Sam Rainsy is a case of persecuting and prosecuting border defenders, while awarding traitors with plum positions within the government. My premonition is that we could see Mr. Sam Rainsy’s political career end here if there is no external pressures to find a political solution to this farcical legal show trial in order to facilitate his return home to Cambodia.

The border works are problematic from the start. Mr. Hun Sen and the ruling CPP have not been transparent in its border negotiations and border demarcations, particularly with Vietnam. The negotiations and demarcation works have been done in secrecy. Members of Parliament and journalists have been prevented from obtaining information and documents pertaining to border works and from visiting the demarcation sites.

Despite its denials, the government has for the first time publicly admitted that Vietnam had actually encroached on Cambodian territories. Mr. Var Kimhong, chairman of the Cambodian Border Commission, admitted in a meeting recently that Vietnam had violated Cambodian borders. He also said that Vietnam's unilateral decision to dig a canal to use as a borderline, after it invaded Cambodia in 1979, had violated the real locations of the borderlines between the two countries. "One more complicated issue is Vietnam's decision to dig a canal along the borders in 1979 that did not respect the real borderlines drawn on the maps. (Now), the local people who live on both sides of the canal must consider the dike and the canal as the real borderline between the two countries", Mr. Var Kimhong said.

If the government has already admitted that the border encroachments by Vietnam are real, then why did it persecute and prosecute Cambodian border defenders like Mr. Sam Rainsy and the poor farmers? There are several motives behind the court case against Mr. Rainsy and the farmers.

There are possible two aims here: First, to end the political career of Mr. Sam Rainsy and to destroy the SRP. Secondly, the government and the ruling CPP is trying to absolve its responsibility on border failures and to whitewash its traitorous border policies, in particular its policies toward the Vietnamese borders. The main aims of the CPP, and Mr. Hun Sen in particular, is to prevent the return of Mr. Sam Rainsy to Cambodia in order to weaken the SRP and eventually engineer its break up that will see the eventual demise of the SRP as has been seen in the case of other parties in the past.

A possible scenario is that the fate of Mr. Sam Rainsy’s party will be similar to the fates of the Son Sann Party and Funcinpec Party, if Hun Sen has successfully prevented Mr. Rainsy from returning back to led his party.

This is Hun Sen's strong political game with a stupid leader like Sam Rainsy. His stupid actions gave Hun Sen a legal stand to punish him. Sam Rainsy will end up to send another apologized letter to Hun Sen in order for him to go back to our home land Cambodia.

When will Sam Rainsy learn from his stupid repeated mistake? He is running out of time...........

I wondered, Why Sihanouk killed Sam Rainsy's Father? Because, Sam Rainsy's Father secretly involved with Thailand. Now the same case with Sam Rainsy involved with Thailand and provoked khmer against vietman. Soon he will be killed such as his father Sam Sary!
Be prepared a new song for Sam Rainsy for every school to sing...

Look like you two proud of what what Hun Sen achieve but forget to get the signal from Hun Sen that his time is near , stop doing bad, must do good to Khmer people. It take a big step for a man like Hun Sen to openly broadcast his family evil act on National TV and know the consequence.

My dear 11:57AM and 12:25PM, I don't really think that you're Khmers. I completely agree with this reasoning by Khmerization that this stupid political games played by the CPP are very dangerous to Cambodia. Everyone in this CPP government - NOT Cambodian government - is for his own pocket for the short run. Nobody cares too much about the future of this poor nation that eventually will be swallowed by Vietnam who put all these now 5-star generals as its tools and trying to hide the facts from the truth. How many illegal Yuon immigrants are living in Cambodia since the so-called 1979 victory? These Youns have more rights than our own citizens, don't you see that at all? I just don't understand why these CPP diedhards are so naiive not to see what will be coming. Sometimes I really feel ashame to be born as a Khmer because most cambodian leaders are so ignorant. They usually don't really care about the future of the nation but they rather are happy to serve any foreign bosses for their own financial gains. The Khmer-Kroms are struggling to have their rights respected by the same government that stole their lands and nobody in this CPP government helps them. If they happen to come to Cambodia they are treated like illegal immigrants and in the meantimes the youn illegal immigrants are welcomed with open arms. I believe that many of us who always visit this blog site are citizens of another country but we care about the fate of Cambodia more than some people living inside of the country because we have roots in Cambodia. We just want cambodia to exist for a long, long time for Khmers to enjoy. Do you think that Mr. Sam Rainsy came back to Cambodia for money? His family had a very confortable life in France and if he returns back to France now he would be fine too. I really respect the man for giving up that life in France and gets into politic trying to save Cambodia and helping the poors and powerless.

Oh well, I sincerely hope that the new year will open Hun Sen's and his friends' eyes to see things more clearly for the sake of Cambodia, my beloved motherland.

In fact, Sihanouk only tune down not too long ago when ah Hun Sh*t blasted Sihanouk for not talking nicely of his government. Sam Rainsy is never with Thailand, ah pler. Actually, ah Hun Sh*t is with Thailand as he embraces Thaksin and the RedShirts. Thais can come into Cambodia through poipet like that while Cambodians got killed just crossing over to work in Thailand. Ah Hun Sh*t is with Thailand, ah pler. Sam Rainsy is not an ordinary loser as you, ah pler. He does not ever need to get involved with the STUPID Cambodian politics and sh*t. However, it is his moral conscion that keeps him loving this country called Cambodia and these people called Cambodians. So ah pler better shut the hell up, kone mee sompeng oss sach niss veuy.

All Khmer people need to focus on the real issue at hand, which is Hun sen and the ruling party's abuse of the court system, to silence and lock up everyone that speaks out against their corruption and incompetent leadership! To the people who keep blaming Mr. Rainsy for the problem, you are out of line and you clearly lack logical reasoning! You are obviously out of touch with what is really going on in srok Khmer. Hun sen and his party is a cancer that is eating up Cambodia and it's people! We need to take extensive measure to heal the country, which will require the removal of the current leadership and all related entities that are in the business of crippling our people and our livelihood! We need to put in a new leader that will bring real democracy to Cambodia, that leader is
Mr.Rainsy!

Well written and rational analysis, Khmerization.

Hun Sen and the CPP are the real traitors who not only did not protect Cambodia's borders, but persecute those patriots who tried to protect Cambodia's borders.

Mr. Rainsy and the poor farmers were not only protecting their farmlands, but they were protecting Khmer lands, Cambodian territorial integrity and sovereignty as well.

Like Khmerization said, defenders of Cambodia's were always persecuted by the traitors Hun Sen and his CPP cohorts. Hun Sen and his CPP cohorts are willing to sell out to Vietnam just to protect their own interests and powers. They are the real traitors.

Sam Rainsy is leading the way for all khmer. Those who love being khmer, need to support him! Just critizing him is definetly not enough. Talk and criticizing is cheap.

Whatever the farmers did they didn't serve their cause by playing 'defenders' of the 'territorial integrity'. You are going overboard with your argumentation.
But you are right with one thing: this is to finally silence and remove Sam Rainsy from the Cambodian political scene.

The border demarcation with Vietnam is rooted back to 1960s, it cannot be solved overnight. Mr. Rainsey should be aware that,and to solve this problem, he should go through all legal and lawful means in order to avoid confrontation with this evil regime that always tries to destroy him in all circumstances. Mr. Rainsey has been a famous politician for almost two decades but he still not learn how to deal with Hun Sen regime effectely. He always went to visit borders frequently and perhap understood well about this issue. He can still visit the sites of violation and report those encroachment to the national assembly and invite all media to witness those encroachment so that the public and international community can better learn about this sensitive issue . furthermore, the Hun Sen regime and Vietnamese government have no pretext to prosecute and eliminate him from his political career that they have seen as a great threat to their traditional friendship between the two unequal neighbors. Mr. Rainsey should be smarter, wiser, well prepared to deal with this sensitive issue. He knew that the court is not independent, the government is not democratic, and even our nation is not fully independent from Vietnam yet. So he has to take precaution all every political move against this undemocratic regime. In this case, Mr. Rainsey fell into the legal trap of Hun Sen regime easily. The court accuses him of destruction public property and racial incitement not mentioned any border encroachment from Vietnam. So the Hun Sen regime easily flips the international issue into a domestic and local issue, putting him in jail because of destroying public property not protesting border encroachment. This is a lose lose situation for Mr. Rainsey; he and the farmers gained nothing from pulling out the border posts, but instead they faced servere jail term punishment from the bias court and Hun Sen regime. Finally, Mr. Rainsey may loose his political career and the farmers may not get back all their land. This is the last lesson Mr. Rainsey should learn before it too late. Most Khmer people still view him and his party as a sole vanguard for change and democracy for the future of our country, but if his party callapses, there is no real forces to challenge with the current evil regime.
