The French Court of Appeals has delayed until May 20 the verdict in a lawsuit brought against opposition leader Sam Rainsy by Cambodia’s foreign minister.
“There is no decision yet, because the court will need to take the case under further consideration,” Sam Rainsy told VOA Khmer Friday.
Sam Rainsy was found guilty in a lower court of defamation, for alleging in a memoir the minister, Hor Namhong, had colluded with the Khmer Rouge while supervising a Phnom Penh work camp under the regime.
Hor Namhong has said he was a victim within the Boeung Trabek camp, where several inmates died.
Hor Namhong brought four witnesses to testify in his favor, including Khmer Rouge historian Raoul Jennar, sources who attended a March 25 hearing in Paris told VOA Khmer. Around 50 Cambodians attended the hearing. Sam Rainsy said those who would have come forward on his behalf were afraid for the safety of their families in Cambodia.
“We regret that some of the witnesses who were in the Boeung Trabek correction camp dared not to step forward to be my witnesses,” Sam Rainsy said.
Hor Namhong declined to comment on the case, but a spokesman for the ministry, Koy Kuong, said Hor Namhong had attended the hearing in person.
“This is an important case in which he must try to make sure the French appeals court provides him justice,” Koy Kuong told VOA Khmer.
Sam Rainsy said Friday he had submitted additional evidence to the French court to defend his writing.
Hor Namhong is also among six Cambodian government officials who have refused to appear before the Khmer Rouge tribunal in Phnom Penh, claiming they did not want to create bias in the UN-backed court.

why is Sam Raingsy brought the Khmer Rouge issues to his mind, he have lots of works on the border issues to SAVE CAMBODIA FROM THE EXPANSION. Khmer Rouge was gone don't wast too much time and money for nothing.

You are wrong Sir, because if Sam can win in this procedure, it means that Hor 5 Hong is a khmer rouge and the other 5 persons as well. So the KR Court will easely to bring them to the court. And to show to the world that the actuly leader of Cambodia is then-khmer rouge.

Sam Rainsy is a very clever politician, calculated move. This is an important case, it is a significant ripple that will cause great waves in the Khmer Rouge tribunal that is currently taking place in Cambodia. These high ranking officers like Hor Nam Hong, Hun Sen, Heng Samrin, and Chea have refused to participate in the tribunal as witness or as defendant because they have power and immunity in the corrupted country!
Well! what ever Sam Rainsy appeals for french court to re look at the case is personal matter.
But ECCC is a UN court agreed by RGC, in order to find justice for so many cambodians. If Mr HOr and others refused to the court prove that there are things to hide from cambodians and also a court contempt.
There is NO other way to escape ECCC court and cambodians

Even Mr Sam Ransy cannot bring some more witness for his appeal, he should have more witness to signed affidavits to support his claim. From my reading about this court case is only at district level because Hor Nam Hong is not daring to sue Mr Sam Ransy at high Court level at all because of the cost of the court and of lawyers. I wish Mr Sam ransy can win his case so that former Khmer Rouge will not acting like careless anymore about their crimes against their people.

Think people. How could Hor 5 Hong survived as head of the Boeung Trabek camp? His son and his wife were head of the execution team. People were taken away under his list. If it were someone else, that person would had been imprisoned or executed along time ago, but not Hor 5 Hong. Anyone see the picture here? Conspiracy at its highest level? He needs to be questioned by the ECCC. What else Cambodian doesn't know about Mr. Hor and his cliques.
Khmer Rouge historian Raoul Jennar wasn't living in cambodia within khmer rouge regime at the time. what Raoul Jennar knew just wrote to what he was told. Hor 5 Hong could possibly paid Raoul Jennar to say what Hor 5 Hong wants.
As the matter of fact, Hor 5 Hong was the real Khmer Rouge chief in concentration camp in Boeung Trabek.

The fact remained still, why a head of the Boeung Trabek'sconcentration camp, father, son and wife emerged to be such a powerful elite of a new regime? If Hun Sen or Vietnam were so hateful of the Khmer Rouge, what the heck is Hor 5 Hong doing as Foreign Minister of a Vietnamese puppet regime. Was there something Mr. Hor did or knew during his time between 1975 and the end of 1978? Do you know how powerful a family such as Mr. Hor was during that time given his responsibility and title as chief of the camp, itself? A Vietnamese collaborator, protected and promoted? Something is really paculiar about his family during that questionable period. He needs to be questioned by ECCC.

You are right, Sam Rainisy has many job to do. Murderer during Khmer Rough regim is one of his job to find justice for Cambodian. And Hor 5HOng case, Hong himself brought this issue to French court. Hong tries to clean himself, but he is hopeless to win this case. Next if these people ( Hun, Heng, Sim, Hong, Chhun, Ka, Chhoeun) brave enough they will go to ECCC to clean themselves.

I know one thing about judging the case. There is always 50% love you and 50% hate you. The loser always say it was not fair. It doesn't matter what country are you living in.
Most of the blogers seam to favor Mr. Sam Rainsy and want him to win.
But, I have one question to ask these blogers, Do you trust this court ???????
Would you accept the verdict of this court ??????? eventhought the outcome maybe not what you wanted.
If you can answer these two question before the verdict, I would consider you as a fair person.
If you cannot answer these questions, it meants that you just want your way only.
Justic is base on fairness, not the outcome you wanted.

Raoul Jennar is from Belgium and he was sold to Yuon Hanoi for money. Raoul Jennar cannot find a decent job in his country, that is why he is sold.
Sam's calculated move to attempt to bring the H5H to KR trail? Too much dreaming the show trial is just show trial period. The buck stop at Hun Sen and Sihanouk. If two dont want it it won't happen no body can do a damn thing about it... Sadly
