No compensation from property developers for Cambodians

More than 4,000 families are about to lose their homes in Phnom Penh, Cambodia because of a development arrangement.

People in villages around Lake Boeng Kak have been told a real estate development in a lake will require long-term residents to move out.

The lake dwellers have been warned their lack of land title will mean the largest real estate development scheme in the country, covering 133 hectares, will take over the area.

Shukaku, a company linked to Lao Meng Khin, a senator with the ruling Cambodian People’s Party, is in charge of the project.

Residents, who do not know how to oppose the move, are resigned to having to move on, although plans are afoot for human rights groups to ask for foreign donations to fight the development.

Lake dwellers have claimed historic use of the land, saying when the Khmer Rouge regime was in charge, most of Phnom Phen’s population was forced to leave the city.

When the regime was ousted, people came back and took over vacant land on the lake.

Until now, no one had challenged their right to be there.

The forced seizure has come about because the dwellers lack proper title documents, a problem shared by most Cambodians.

Sadly these people apply again and again for land papers which is their right under Cambodian Land law but the govt even take bribes for doing this paper work and then in effect do not give them the land papers and the communities have no recourse, they take the govt at their word (because we have to respect authorities in Cambodian culture). Even when they have land papers these govt persons who are backing the private companies win the court cases as they have more money to pay the judiciary. This is the reality for so many evictees in Cambodia..

I don't know in which country you currently live, but if you do live in Cambodia, you must be in some high-walled, barb-wired residence with servants running around to fulfill your every need, perhaps even spoon feed you. Because, you don't really have any idea about the reality in Cambodia at all. There are 2 types of documents- one is the proper land title paper saying the land belongs to you. The other is just a paper recognising your occupation of the land. To go from being recognised as an occupier to recognised as owner is difficult, if not impossible altogether. And then there are the bribes. Most people live with just being occupiers, hoping that one day they will be proper owners. They never see their dreams come true. The money they earn does not allow them to save for any purchase of land in their future. So where do you think they can go? Move to the next piece of unoccupied land and go through the same process? Before you blame them 12.11PM, find out the real reasons. And have some compassion for those less fortunate than you, my friend, because some day you may find yourself in their situation.

remember, this lake is state property; so, state can decide to develop for the benefit of the nation, not the squatters on the lake property, ok! you know also the lake is so polluted, so the gov't is cleaning it up by developing it into a nice park and nice part of the city of phnom penh, the cosmopolitan, metropolitan city of cambodia and the world, you know! of course, if it's up to the illegal squatters on the lake property, nothing is changed or developed and cambodia and phnom penh will continue to look dilapidated and rundown, poor, unsightly, etc... but no, the city authority and cambodia cannot allow that to stay undeveloped, ok! now go on with your life at your new relocation, ok! don't fight with authority!

A good government is the same as a good parent or good parents. They must find reasonable solutions or ways to help poorer children not just kick them out of their places.

There are alot of public areas, even a park that these people settled in hoping someday the govt. will change their minds and grant them land titles. At the same time they are all well aware that they may be kicked out anytime.

Both the people and govt. are at fault. The govt. should kick them out the moment these people come to settle onto the land and not wait 5, 10, or even 20 years later to do so. And these people should have never settled there the first place when they know damn well that they will never be granted ownership to the place.
Back in the late 80's or early 90's, everyone was granted a plot of land with land titles. What happened was that a lot of them sold their land and move onto the government's land because they don't have to pay a dime for it. Now that the govt. want their land back and pay them a small fee, they refused. They want the full value of that land, which have never belonged to them in the first place.
