PP court says no extradition for Sam Rainsy

THE president of Phnom Penh Municipal Court said Wednesday that there were no plans to ask for cooperation from France in securing the return of opposition leader Sam Rainsy, who faces charges related to his claims of Vietnamese border encroachment.

Chev Keng said the court had taken no steps to expedite the return of Sam Rainsy, who was charged in March, although his lawyer has said that a warrant was issued for his arrest on May 28. Sam Rainsy is currently residing in France.

“I have not received any report related to Sam Rainsy’s case from the investigating judge, and so far I have no plans” to request that the French government hand him over, Chev Keng said.

Koy Kuong, spokesman for the Ministry of Foreign Affairs, said on Wednesday that the government may choose to push for Sam Rainsy’s return using “diplomatic channels”, noting that there is no extradition treaty between France and Cambodia.

But he said that any request for cooperation from France would need to come from the court, and would also need approval from his ministry and the Ministry of Justice. “It’s up to the court,” he said.

Interior Ministry spokesman Khieu Sopheak said Wednesday that law enforcement officials are actively working on finding a way for Sam Rainsy to be returned.

He declined, however, to elaborate on any particular methods that were being considered.

“We are the executive branch, which has to follow the court’s verdict,” he said.

Svay Rieng provincial court in January sentenced Sam Rainsy to two years in prison for his role in uprooting border posts in Chantrea district last October. Sam Rainsy and other lawmakers from his party have said that the posts were placed in Cambodian territory.

The Phnom Penh Municipal Court laid its charges in March in connection with maps Sam Rainsy released after the verdict, which he said offered proof of his encroachment claims.

M.sam rainsy committed a defamation against M.Hor Nam Hong in his books" roots in stones " published in France.
That is why m.rainsy sam is condemned by the French Justice.

M.sam rainsy also held these slanderous comments against M.Hor Nam Hong in Phnom Penh.
The Cambodian judiciary is competent and can be seized by M.Hor Nam Hong.
The French and Cambodian justices are independent.
Mr. Hor Nam Hong can prosecute Mr. sam rainsy today to the Cambodian courts for defamation and ask $100,000 of damages because it is a very serious libel against the honor of a person

SR may be highly educate in France, but he lack logic in his thinking. He do not have common sense to be a good politician. His actions may be designed to please those who are dislike Phnom Penh regime, but in the end, it accomplish nothing for Cambodian people.

What is up with Cambodia court?

When SRP requested to investigate and trial those who threw grenade into the 1997 demonstration and the case of Pisith Paleka.

Why did they drag this case? How come?
Then when Mr. Sam Rainsy done something to protect the Cambodian sovereignty the PP court suddenly charge Mr. for being instigate the friendship between Vietnam and Cambodia.

This is truly with the influence of one mad man behind this.

When some law-makers found out that the neighboring, Vietnam, encroach Khmer territory and take our people's land, Hun Xen and his clans oppose to that. They appear to be clearer and clearer as tritors of the Khmer people. I wonder how Cambodian historians would write recent Khmer history if they do not spin the facts around to please Hun Xen, the commander-in-thief and Exective Director of corruption?

If the King didn't deliver any message from Chinese leader to Triet, King is certainly used by Triet to speed up his imperialistic attempt over Cambodia. It exactly through the propaganda of "friendship", "good neighbor" or "cooperation" etc.

The Triet's word about "good neighboring" is useful for Vietnam only as Cambodia has lost competitiveness to Vietnam in all fields:

1. Cambodia has no investors and contingents in Vietnam at all. But Vietnam has pursued full potential in both political, social and economical collateral in Cambodia.
2. Cambodian illegal immigrants to Vietnam have been repatriated mercilessly, but illegal Vietnamese immigrants in Cambodia have been taken care very well by the Cambodian authority, including seeking an appropriate land for them to resettle.
3. Khmer Kampuchea Krom people have been neglected by the King whose pseudonym is Father of all Khmer Children, but his trip to Vietnam left his children in Khmer Krom in a dark position.
4. King's visit to Vietnam is coincident to the pressing issue of border markers and border encroachment which opposition leader has been trialed as well as the farmers have been jailed...so indirectly King's visit this time is to intensify the punishment of those Khmer compatriots.
5. Every aspect of political changes in Cambodia is unusually favoring Vietnam at the expense of Khmer's death for its future such as "paying gratitude to Vietnamese soldiers who come to liberate Cambodians from Khmer Rouge" which this phrase has become a well-known propaganda in Cambodia among youths and some unknown people to vote for the CPP. Of course, the international communities and the UNs have already condemned that the presence of Vietnamese troops in Cambodia was the invasion, not the liberation.


All few aforementioned points critically displays the unfaithful "good neighboring" repeatedly mentioned by the Vietnamese leaders.

King Sihanouk and Hun Sen have been failed into this trap unconsciously. While King Sihanouk visited Vietnam, Hun Sen has been fooled by his intelligent advisers about the main cause of the war originated by Lon Nol's coup detat. Hun Sen's statement is just part of his blindness because he didn't realize that his speech is to make more divisions among Khmers, and it will benefit more to the foreigner.

Lon Nol has been already dead like Pol Pot, but why Hun Sen has used these two regimes as the pretext to the media and public curiosity? Of course, the coup detat was not Lon Nol only. It was the trend of the cold war, and Lon Nol had become a tool of this trend. If Sihanouk didn't escape to Russia and China, how can Lon Nol be able to defy him? If the US didn't confront with the China and Russia in that situation, how can Lon Nol be able to attain a coup? If Southern Vietnam didn't incorporate with Lon Nol, how could Lon Nol be able to accomplish the coup? -- all these critical thinking and seeking things outside the box must be inserted into Hun Sen's ears from right to left, and from left to right several times.

This example can apply well to the issue of Pol Pot. Pol Pot came to power because of the help from Vietcong and China. This is the fact! The atrocity committed by Pol Pot is not worse than those perpetrators whom created the Pol Pot at the beginning.

Hun Sen is just the top divider among Khmer compatriots. He is a jerk of foreigner. All his speech is rational for Kmeng Wat and uneducated mad dogs only. His irritating speech to Surya Subedi, the representative of the UNs is unacceptable among Khmer intellectuals. But only those monkeys in the power who have applauded Hun Sen.

The ignorance of Hun Sen will disclose more facts until the land of Angkor Borei are totally controlled by the smarter people.

The war in Cambodia winned by the communism, not the west ediology at all. Please look at what the Sihanouk did/do with the west countries by holding the sponsor's money from the westerners on behalb of Cambodian People. During Cambodians are hungry for the west democracy, the west look only and also more discussion but die are the Khmer people. For instance, I lost fast all my family mumbers because of fighting against communists until 17th April, 1975. Now, If France can not do nothings, all Khmer must works with China and Youn as our brothers but when westener give us money we take for building new Villas and more wifes, please don't hear them and What the destiny of Cambodia to be is equal. That is the real story for us.

The French government would be stupid enough to extradite Mr. Sam Rainsy to Cambodia.

The KR trial has revealed to the world how much the dictator Hun Xen has influenced the outcome of the trial. All international judges and lawyers have too much obstacles to conduct the trial because of the influence of the Hun Xen regime.

- If it is a political case, no government on Earth would extradite Mr. Sam Rainsy. Go back to school if you don't know what I mean?

- If Cambodia's Oil is dictator Hun Sen's personal properties?! And dictator Hun Sen does whatever he wants with it. Then this clearly proves dictator Hun Sen personally owns Cambodia as his personal company--that dictator Hun Sen uses Cambodia to feed his family, his gangsters, his killers, his Vietcong agents in Cambodia, etc. The world community should have enough evidence to put dictator Hun Sen on trial in similar manner to Saddam Hussein of Iraq, Robert Mugabe of Zimbabwe, Than Shwe of Burma, Kim Jong-il of North Korea, Omar al-Bashir of Sudan, and the list goes on!

Hun Sen also a terrorist during the 1997 grenade throwing into the demonstration crowd near the Assembly building. And FBI got the hint and related to Hun Sen and Hok Lundy 100%. Why didn't Cambodian file complaint or charge against these two individual?

Hun Sen is the one to blame and need to be arrested and imprison him for life.

As the charging of Mr. Sam Rainsy in PP is a political use of the judiciary, the Cambodian government would be stupid to bring attention to the case and give Mr. Sam Rainsy a stage from which to voice his opinions. Therefore, there will be no extradition of Mr. Sam Rainsy nor will there be even a request.

Mr. Sam Rainsy could easily be sued for defamation in PP but then so could Father Christmas and Buddha. It would mean nothing in regards the legal rights and wrongs.

I think the French court's decision to award the prosecution a nominal sum of 1 euro should be an indication of how seriously the French court regarded the charges against Mr. Sam Rainsy. It would be interesting if the Cambodian judiciary brought to case and found in favour of the prosecution for a huge sum of money, particularly when publishing the book in France or another foreign country does not as far as I'm aware break Cambodian law. (If someone could correct me here, I would be pleased and interested.)

The grenades killed over 10 people at the Pagoda. Sene Sane's son was injured by the grenades including 10 other people. I did not know that they would be using the hand grenades against the innocent demonstrators. I was not a party to it. When the grenades exploded, I was at the office of Net Sa Veun talking to him about how Hun Sen had met Hoc Lundy. After that the police were alerted to the explosions and that is when I knew that something bad happened. I only found out that after the grenades exploded. The police were called upon to investigate who was responsible for the bombing, but they did the investigation superficially and were trying to cover the track than to find the person responsible.

During my time at the Anti-Narcotic Bureau, I discovered evidence showing Hun Sen's people being involved in drug trafficking. I went to see Hun Sen with a view to bringing it to his attention. He took me to the cellar of his house which was nicely decorated. Hun Sen asked me whether I knew the names of the people who were into the drugs. I replied that I knew and I told him one name Mon Routy whom I was sure was involved. I suspected other men of Hun Sen were also involved, but I was not 100% sure. Hun Sen did not make any comments. Then Hoc Lundy then arrived with Huy Piseth, Chief of the Hun Sen's bodyguards and distracted my discussion with him. We then talked about the opposition party's protest. Hoc Lundy said to Hun Sen, ' why don't you use hand grenades.' Hun Sen said that it was a good idea... "I can send Seth to do it and he is a good operator." He authorized Hoc Lundy to pay for Huy PiSeth to do the job. Hoc Lundy answered that he would put together the money to pay them. He suggested that I met with Seth. After that, Hoc Lundy ordered me to find the money (US$ 100000) to give to Huy Piseth. The money came from the police.

On 30/3/97, the opposition leader Sam Rainsy led a demonstration calling for the reform of the justice system in Cambodia. The demonstration was held in front of the Assembly of the Nation. I was near the Pro Tom Pagoda and witnessed what happened. My staff took me on his motorbike to see the big protest outside the Assembly. 2-4 minutes after we arrived, I heard a big explosion and people crying and screaming. Then I saw four men running away from the scene. I recognized only two of them that were: Mr Phan Sary Colonel and Mr Ourn Cham Nane Commander; both of them were Hun Sen's men. I did not know the other two. They ran towards the Prime Minister' house. I followed them there to see what they ran away like that for. I talked to General Huy Pheseth and told him that I saw four of his people running away from the scene and that they should not have thrown the grenades. He told me to keep quiet and don't talk to any body. But I was angry and upset. I need to speak to somebody about it. I went to see Hoc Lundy who I considered at the time as my friend. I felt that I had to report to Hoc and could not understand why Hun Sen chose to kill so many people. But he told me the same thing to keep quiet and not to tell anybody about it. Amongst the people who were killed or injured was an American. I understand the American Government sent people to Cambodia to investigate.

In 2003 Phan Sary came to see me in my office. He admitted to me that he was the person who threw the grenades. He said that he was very sad because he killed so many people. He complained that Hun Sen used to pay him money to have things done. When he was in trouble nobody seemed to care about him He said that he did what he did because Hun Sen ordered him and he had to please him. He acknowledged that he killed a lot of people before. He said that he now did not even have money to support his children. I recorded the conversation.
