No deal for SRP chief to return

THE head of the Senate has rejected a request from the opposition Sam Rainsy Party that its embattled president be allowed to return to Cambodia under renewed parliamentary immunity.

In a letter, Senate President Chea Sim wrote that the body’s hands were tied due to the Kingdom’s constitutional separation of powers.

“The Senate will not be able to intervene with the government in order to drop the complaints … because the complaints against HE Sam Rainsy are under the jurisdiction of the judiciary, which is separate from the legislative branch and executive branch,” said the letter, addressed to the SRP’s Acting President, Kong Korm.

Chea Sim’s letter, dated Friday, came in response to a request from Kong Korm on September 11, which said the Senate had a “duty” to try to broker a political compromise that would pave the way for Sam Rainsy’s return.

The SRP leader, who is in self-imposed exile in Europe, was sentenced to two years in jail after an incident in October last year in which he helped villagers uproot wooden demarcation poles near the Vietnamese border.

A verdict on two more charges – brought against him after he released maps showing what he claims are Vietnamese territorial encroachments – is set to be handed down at Phnom Penh Municipal Court on Thursday.

Yesterday, Sam Rainsy issued an appeal to “parliamentarians of all countries”, saying that his only crime was an “unyielding denunciation of corruption and human rights abuses” and an “unwavering defence of the people who have elected me as their representative”.

Senate Secretary General Oum Sarith declined to comment yesterday, but Council of Ministers spokesman Phay Siphan said that wiping away Sam Rainsy’s charges would set a “bad precedent” for Cambodia, despite the use of such arrangements in the past.

“Sam Rainsy wants to make a wave as a celebrity in the media, but he has to take the time to show that he has principles,” he said.

Hang Chhaya, executive director of the Khmer Institute for Democracy, said that unlike earlier cases, where Sam Rainsy’s spats with the government were resolved through compromises, officials were showing “no real urgency” to broker his return.

“I hope there will be some sign of resolution and Sam Rainsy will be able to come back,” he said. “I hope the issue can be resolved quickly.”

Either Sam Rainsy and his party are damn or pretending to be stupid by asking lots of wrong channels to intervene for Sam Rainsy's case. They should well aware that only Samdech PM Hun Sen can drop this lawsuit or forgives Sam Rainsy. The so called that there will be international intervene before 2012-2013 which paves the way for Sam Rainsy comes back to Cambodia is just a big liar, aim to encourage SRP supporters don't loose hope in the next election or run away from SRP.

Right now, Sam Rainsy looks like a mad dog which was hit by a big stick and crying out for help to save his political career in Cambodia, but unfortunately, he has no longer had any value in Cambodia's politic. Like it or not Sam Rainsy has to accept the reality: either stay in France or comes back to serve jail time in Cambodia.

Dear Khmer people especially those who had commented above,

I really appreciate you all critizing the one who were attempting to protect their motherland and urge them to go in jail. But when you die and reborn again, I beg you please don't choose to be born in Cambodia. I am afraid that Cambodia will become a second Champa because of you.

I think in this world, there is only one case cambodia that those who protect to homeland is seized to jail. But a siem spy was honnorably released and acompanied by khmer priminister. Moreover, have you ever heard that thai people were arrested because they protect their land from khmer or other countries?

I dont care what he had done, but what i see is that he was trying to protect my ancestor homeland. I must support him.

I have tremendous respects for both Mr. Sam Rainsy and Mr. Khem Sokha, and I believe these two respectable elders have lasting roles to contribute to Cambodia future. However, given the current circumstances, I humbly think it is time for them to pass on the torch and elect a new figure to head a merged opposition. The two gentlemen can act as honourable founders and personal advisers to the new leader.

I'm a younger generation willing and able to lead the new party, if asked. I will lead with strength and determination. I will take a pro-active and non-partisan approach to build the momentum. If I do not deliver results within five years, I'm committed to step down for a new leader.

It is grand time for all of us to be the master of our destiny. The nation can not afford to wait, and expects us to take our political platform to the next level. I represent the new generation of know-how, and together I have tremendous confidence in our abilities to do the right things for the country.

Indeed Sam Rainsy is smart and capable but coward. He can never be in equivalent with Aung San Suu Kyi. Mrs. Suu Kyi, as a leader, was willing to go to jail to protect her members while that troublesome Rainsy just fled whenever he had problem. He deserves retirement in France. We know the government is not perfect but we do hope that with EDUCATED young generations, there will be better change. Educated citizenry will have higher expectation from the government and will learn how to put pressure on the government. There will surely be change but that change will never happen thanks to your cursing the government. It will only happen with the engagement in the country's politics by educated, smart but not coward younger generations. Too much pessimism like you guys always shout out loud on this blog does not help Cambodia.
