CAMBODIA'S CONSTITUTIONAL CRISIS ENDANGERS GOVERNMENT’S FOREIGN CREDITORS

Current and future lenders risk their loans being cancelled

Plans by the Cambodian opposition to withdraw deputies from the country's national assembly are set to trigger a constitutional crisis that will create risks for current and future lenders to the corrupt Hun Sen government.

The opposition Sam Rainsy Party (SRP) will reduce membership of the national assembly below the necessary quorum of 120 by resigning some of its deputies. The move will leave the government unable to legally validate the country's budget or to ratify loans.

Cambodia's constitution demands that international government borrowings must be subject to the scrutiny of the national assembly. The government has already overridden this principle by pushing authorizations to borrowing through the assembly en bloc rather than on a loan-by-loan basis, so effectively writing itself a blank cheque amounting to US$1.1 billion, or 10% of GDP, for 2011 alone. Details of the actual loans contracted are kept secret from the assembly, undermining its prudential role and making international lenders complicit in violating the country's constitution.

External borrowings allow continuous fiscal and monetary irresponsibility by the Cambodian People's Party (CPP)-led government, rampant government corruption, an undemocratic patronage system and the practice of buying votes. State misuse of funds greatly diminishes the beneficial impact of loans on the country’s population, but not the costs of repayment.

Article 76 of the country’s constitution states that the National Assembly consists of at least 120 members. Article 90 states that the Assembly shall approve the national budget, state planning, loans, financial contracts, and the creation, modification and annulment of tax.

The SRP solemnly warns current and future international lenders to the Hun Sen government that borrowings contracted without the necessary ratification are illegal. A future legitimately elected government would reserve the right to cancel such loans.

The Constitutional Councils have clearly interpreted the article 76 of the Constitution since 2003, but a convicted criminal Sam Rainsy is still shamelessly interpreted it in his own way and lies to the public that in order to ratisfy the loan and approve the national budget, the Parliament requires necessary quorum of 120 MPs (sic).

The article 76 of the Constitution states that the national assembly consists of at least 120 memebers means in every election, the Cambodian Parliament has to elect at least 120 MPs. But the National Asembly requires only quorum (50% +1 = 62 MPs) to conduct the meeting to approve the budget and other laws. Indeed, Cambodian constitution doesn't have crisis, whenever it has established, it will go on until the new one is elected by the people in general election.

In Cambodia, only Constitutional Councils has soley right to interpret the Constitution and other laws. The meaning of the Constitution is not up to fugitive Sam Rainsy said or somebody else interpretation. Thus, if SRP is brave, let resign all its MPs and we can see whether the Parliament can approve the budget or not? And will Cambodia has a constitutional crisis as convicted criminal lied?

there is no controversy that the Const. Council is an extension of the communist CPP. It's decision is an intrepetation. The SRP has its own interpretation. SRP is right. Common sense. If a car need four wheels to work, drive; the car cant go without four wheels.

Shamless decision of CPP's Const. Council on the so-called Package legislation is another shitty example. The council ruled that because the Package Law is above constitution, it had no jurisdiction to accept and rule on its constitutonality. Clearly, the law was made in obvious violation of the 1993 constitution by the Members of CCP/FUN members of N.A. the Package law was not constitution, not above constitution (well, if it was the const., it violates the constitution.

What SRP should have said is the current government whose life/mandate arises from the unconstitutional Package Legislation, is unconstituional, illigitimate; illegal (that is, instead relying/using the 1993 constitution to form the 2008 government, the CPP used the unconstitutional Package Legslation to form the current government). Any dealings with/loans to CCP govenment is illegal; your loans will not be repaid.

Rainsy was convicticted by the CPP court for pulling the border stakes. The fact is every one at the pulling site knew that Sam Rainsy did not even touch the any of those damned stakes.

A convicted criminal Sam Rainsy can lie only to a stupid person like you, but most Khmer people inside the country and educated Khmer in overseas won't believe the madness of fugitive Sam Rainsy at all.
