Heng Chheang, former deputy general director of the Anco Brothers Company, was brought by prison security guards yesterday for questioning to the Phnom Penh Municipal Court over fresh allegations of defamation and fraud filed by Senator Kok An last year, officials said.

Investigating judge Ly Lipmeng said Chheang, who is serving a three-year jail term at Prey Sar prison for breach of trust, was questioned over the allegations relating to statements he made to local media outlets during the tempestuous proceedings against him last year.

“Although I have already questioned him, this investigation is not completely done yet – I will continue investigating him,” the judge told the Post by telephone yesterday, but would not comment in any greater detail.

Chheang and his wife, former university rector Kolap, were sued last year by An for allegedly embezzling more than US$58 million from the Anco company.

The right-hand man of a convicted former Phnom Penh municipal police chief had turned himself in after six years on the lam and was being detained in the Prey Sar correctional centre, officials confirmed yesterday.

Correctional centre chief Sun Lean said Hang Vuthy, 42 – nicknamed Yumareach, or “chief of all devils”, for his vigilance in arresting criminals while a policeman – had turned himself in at rights group Licadho’s head office on Friday.

Hang Vuthy had confessed to hiding in six provinces since a jailbreak with 11 other prisoners in 2006 while awaiting trial on murder charges, Sun Lean said.

A land spat has erupted between two high-ranking government officials in the seaside tourist town of Kep.

Nhem Morokat, under-secretary of state of the Ministry of Women’s Affairs, has filed a complaint against Kep town governor Ngin Ngin Da, alleging he faked documents in order to steal 2,628 square metres of land that belongs to her.

“Ngin Ngin Da, Kep town governor and his wife who are the dupers have faked [what] is my property and one line of public road,” she said yesterday.

In a complaint late last month, she asked the provincial court to prevent Ngin Ngin Da from selling, renting, building on or making land titles for the plot that she argued had belonged to her since 1991.

The jail time is piling up for the former head of Chea Sim’s bodyguard unit.

A week after earning a 10-year sentence from Phnom Penh Municipal Court for crimes including forgery and illegal weapons possession, a military court on Friday sentenced Lieutenant General Chhoeun Chanthan to 26 years in jail and ordered him to pay well north of US$3 million to parties affected by various embezzlement schemes.

Chhoeun Chanthan’s conviction and sentence stemmed from charges including breach of trust, embezzlement of state property and illegal distribution of weapons.

Summary: On 16 February 2012, the Phnom Penh municipal court sentenced Chhoeun Chanthan, the former commander of Chea Xim’s bodyguard unit, to 10-year of jail time on multiple charges. He was also fined by 2.5 million riels ($1,250). He was charged with illegal arm possession and issuing illegal arm licenses. Puth Theavy, Chhoeun Chanthan’s defense lawyer, said: “First of all, as a bodyguard commander for a top leader, he was sentenced to 10 years of jail time just because he has at home 4 or 5 guns left over from his mission and he did not store them at his base. As for the false documents, there is no proof to charge my client. In summary, I cannot accept the sentence of my client’s crimes.”

A military court on Wednesday began the hearing of the former bodyguard chief of ruling party president Chea Sim.

Chhoeun Chanthan was arrested with three other bodyguards in August 2011 and charged with faking documents in a $2 million embezzlement scheme, as well as possession of illegal weapons. A verdict is expected next week.

Police seized weapons and ammunition in an Aug. 13 raid last year in Phnom Penh’s Chamkarmon district.

Senior Minister Sun Chanthol has lodged a criminal complaint with Phnom Penh Municipal Court against his father-in-law, his brother-in-law and wife, and his father-in-law’s stepdaughter for masterminding a plot to rape and murder his wife and nine-year-old daughter in 2010, government lawyers said yesterday.

The criminal complaint is the latest twist in the high-profile dispute amongst prominent businessman Okhna Khaou Chuly’s family.

“My client, Sun Chanthol, has directly submitted his criminal lawsuit against [his in-laws] to the Phnom Penh Municipal Court,” lawyer Pal Chandara told the Post by telephone yesterday. “He has sued them for masterminding the attempted murders and rapes of his wife and his nine-year-old-daughter in 2010.”

Cambodian Senate President Chea Sim’s disgraced former adviser has been sent back to Phnom Penh Municipal Court, this time for questioning in a civil case related to projects for which she has been convicted of fraud, her defence lawyer said yesterday.

Pheng Kunthea Borey’s defense lawyer, Muong Sokun, told the Post that the former high-profile socialite is the subject of a civil complaint by a Royal Cambodian Armed Forces officer involved in the construction of the Samdech Chea Sim Hospital.

The hospital is one of five humanitarian projects for which Pheng Kunthea Borey and four others have been convicted of committing fraud and extorting hundreds of millions of dollars from investors.

Banteay Meanchey provincial court on Thursday sentenced Cambodia’s former anti-drug czar to life in prison for corruption in an alleged drug-trafficking scheme.

Moek Dara, the former secretary-general of the National Authority for Combating Drugs, was arrested along with an aide, Chea Leng, in January 2011, and accused of abusing his post to gather hundreds of thousands of dollars in bribes and organizing drug trafficking.

A third defendant, Mor Deurn, was tried in absentia and given 25 years in prison.

The three were fined a total $500,000, an amount equal to that they allegedly took in bribes.

Cambodia's former anti-drug head gets life sentence for corruption, drug trafficking

BANTEAY MEANCHEY, Cambodia, Jan. 5 (Xinhua) -- A Cambodian court on Thursday convicted the former head of the National Authority for Combating Drugs Lt. Gen. Moek Dara of corruption and organized drug trafficking and sentenced him to life in prison and fined 220,000 U.S. dollars.

His two subordinates: former Colonel Chea Leang, chief of the anti-drug department's money laundering office, was also sentenced to life in jail and fined 21,000 U.S. dollars, and Morn Doeun, who remains at large and was tried in absentia, was sentenced to 25 years in jail and fined 34,000 U.S. dollars.

In addition, the verdict read by the presiding judge Ith Samphos at Banteay Meanchey Provincial Court said all of their properties including land, houses and cash are confiscated.

A court official says the former head of Cambodia's anti-drug trafficking agency has been sentenced to life in prison for drug-related corruption.

Prosecutor Phan Vanrath says the Banteay Meanchey provincial court on Thursday sentenced former police Lt. Gen. Moek Dara for taking bribes and masterminding drug trafficking.

Moek Dara was secretary-general of the National Authority for Combating Drugs before his arrest in January 2011.

His aide Chea Leng was sentenced to life in prison on the same charges. Former anti-drug officer Morn Deurn, who remains at large, was sentenced in absentia to 25 years.

The court, about 300 kilometers (190 miles) northwest of Phnom Penh, fined the trio nearly a half million dollars — the same amount they took in bribes.

Senator Kok An has withdrawn a civil suit seeking more than US$63 million from the husband and wife convicted last month of breach of trust for embezzling funds from his company Anco Brothers, Phnom Penh Municipal Court President Chiv Keng said yesterday.

“He has withdrawn his civil lawsuit against Heng Chheang and Tep Kolap, but he has included [his demand for repayment and compensation] in his criminal lawsuit,” Chiv Keng told the Post.

The request for $5 million in compensation and repayment of more than $58 million has been added to the criminal suit that will be heard at the Court of Appeal, Kok An’s lawyer Long Dara said.

Heng Chheang, former Anco deputy general director and his wife, Tep Kolap, former rector of the Phnom Penh International University, were found guilty last month of embezzling $34 million from the company between 2008 and 2010.

December 27, 2011 PHNOM PENH, Dec. 27 (Xinhua) -- Cambodian Senate President Chea Sim's former protocol chief Pheng Kunthea Borey on Tuesday was convicted of fraud and was sentenced to four years in jail, according to the verdict of the Phnom Penh Municipal Court.

Borey's three accomplices: two Chea Sim'former advisors, Police Lt. Gen. Chan Kosal and Lt. Gen. Ponlork Ho, were sentenced to four years each in jail, and Khieu Bora, Chea Sim's former cabinet member, was sentenced to three years in jail.

The four have been charged stemming from allegations they engineered scams involving hundreds of millions of dollars from more than 50 foreign companies in almost a decade-long scam spree in which they allegedly charged companies for getting Chea Sim's signature for humanitarian and development projects, some of which were fake.

Civil case heard against one-time ambassador [-Peal Si Peal]

The former Cambodian ambassador to Brunei was tried in absentia on Friday in a civil case against him on allegations he embezzled more than US$430,000 in state funds.

Nan Sy, who was ambassador to Brunei until May this year, was charged with the construction of a Cambodian Embassy in Brunei in 2008. Despite the Ministry of Foreign Affairs dispersing periodic payments totaling $432,876.65 to Nan Sy to cover the construction costs of the embassy, in May the ministry was smacked with an unpaid bill by the construction company engaged to complete the building.

“Nan Sy has been charged with breach of trust and exploiting the state’s money,” Phnom Penh Municipal Court judge Te Sam Ang said on Friday.

A former military official accused of pretending to be an aide to Anti-Corruption Unit chief Om Yentieng in order to extort money from police officers and other officials confessed to the crimes in the Phnom Penh Municipal Court yesterday.

Chea Sopheap, a former major in the Royal Cambodian Armed Forces, was charged with fraud and creating a false identity as a public official after allegedly extorting amounts as high as US$3,000 from high-level provincial police and government officials across the country.

Chea Sopheap, also known as Chea Sovannarith, told the court he had learned the trick from a journalist named Neng who previously worked for the “Nation Newspaper” but had since disappeared.

“I decided to ask for money from these people because I had known that they had been involved with corruption or other irregular activities,” he said.

THE son of a two-star general from Prime Minister Hun Sen’s bodyguard unit was charged on Saturday in Phnom Penh with stealing a car, slapping fake licence plates on it and possessing an illegal weapon, police said.

Seang Sok, deputy prosecutor of the Phnom Penh Municipal Court, said fourth-year law student Chea Dina, 24, the son of Major-General Chea Dara, faced five years’ jail and a US$2500 fine if found guilty.

“I have charged him with three offences. He has been sent to Prey Sar Prison to await trial,” he said.

Mondulkiri: A provincial judge was beat up by a group of powerful and influential people and he was thrown into a car that sped away. The case created quite a surprise in the middle in Mondulkiri city as such situation never happened in the past. The incident took place at 4PM on 04 December 2011 at the Angkor Forest restaurant located in Trom village, Monorom commune, Sen Monorom city, Mondulkiri province. Meng Tony was the judge who was beat up and he was recently transferred there from Phnom Penh. Prior to the incident, the judge and several of provincial officials went to eat and drink at the restaurant above. Then the party which created the incident also went in to the restaurant also. At 4PM, both parties became drunk and the party that created the incident pulled out a hand gun, pointed it at the judge, then beat up him severely. Meanwhile nobody dare intervene at all. After the judge was beat up and injured, he was taken to a car that sped away. The witnesses called the cops, but it appeared that the cops knew the identity of the culprits, that’s why they did not care much about the case. During the trip to Phnom Penh, the judge was able to jump out of the car. Up to now, nobody dare indicate the identity of the culprits and up to now, it is not known if the victim, the judge, filed a complaint in the case yet.
