Land disputes flare in Kampong Speu

Kampong Speu Province - VIOLENCE erupted Thursday morning in two separate land disputes in Kampong Speu province – one in Oudong district and the other in Thpong district – resulting in the injury of more than 20 villagers and police, as well as the torching of a company’s offices.

An early-morning altercation between authorities and 88 families at Oudong district’s Phnom Touch commune broke out when the authorities tried to carry out a Supreme Court-ordered eviction of the families from a 65-hectare plot of land, villagers said Thursday. Twelve villagers and 14 local police were hurt in the brawl.

At about 6:45am police attempted to forcibly evict the residents so that they could bring in equipment to tear down their houses, but the eviction was thwarted by locals who attacked police with stones and bamboo clubs, and disrupted their advance with burning tyres, villagers said.

The police responded by beating them with batons and firing their weapons in the air and into trees where villagers had displayed photographs of Prime Minister Hun Sen.

The land in Phnom Touch commune is claimed by the Meng Keth Company, owned by Taiwanese businessman Kuo Sheng. According to a copy of his citizenship request letter obtained by the Post, Kuo Sheng, 62, was granted Cambodian citizenship in 2001 after Hun Sen wrote to then-King Norodom Sihanouk recommending that he be naturalised due to his positive attitude and his role in developing Cambodia.

However, Sun Bun Chhoun, a village representative, insisted that the villagers haven’t sold their farmland to any businessman, and that they would give up their lives to protect it.

Describing the incident Thursday, Sun Bun Chhoun said, “The police did not explain; they just tried to tear down our houses”, adding that eight villagers were seriously hurt after being beaten by the police with batons.

According to another villager, San Mean, about 400 villagers and 150 police were involved in the incident.

“They shot at me, but the bullet just barely caught my ear … the police pushed a pregnant woman to the ground.... They did not care about villagers’ lives,” he said.

The altercation ended around 10:30am when the police withdrew to a nearby location with their equipment – including a fire engine and two excavators. Villagers, fearing the authorities would return, continued guarding their homes rather than take their injured to the hospital, he added.

“We have been here since 1979,” San Mean said, adding that he implored the authorities to stop trying to take over their land.

Ky Dara, a representative of the Meng Keth Company and a partner of Kuo Sheng, says his company bought 223 hectares of land between 1997 and 2000, and that they plan to plant acacia and coconut trees, and build a factory.

“If they say that they have lived there since 1979, please show us a copy of the land documents and we will provide them compensation, because since 1985 our government has released land documents to all Cambodian people,” he said.

“We have tried to avoid violence. We invited the villagers to negotiate, but they did not come, so now I have no idea what will happen to them,” he said, adding that one prosecutor was also injured in the altercation.

“We’ve decided to stop for a while and will find another way to settle this problem later,” he added.

Kampong Speu Governor Kang Heang said: “It’s a simple case: If the villagers beat the police, the police will beat them back.” He added that the authorities are looking to arrest several ring leaders they say are responsible for instigating the protest.

Ouch Leng, a land programme officer for the rights group Adhoc, said that according to his organisation’s research, the Meng Keth Company did not have the proper legal documents, and simply was trying to use force to take over the land at Phnom Touch commune.

“The authorities should not be using violence to settle these problems,” he added. “They should find a peaceful way to settle the issue.”

Company office torched

In a separate incident Thursday, about 500 villagers from Omlaing commune in Kampong Speu’s Thpong district burned down an office belonging to the Phnom Penh Sugar Company, owned by Cambodian People’s Party Senator Ly Yong Phat, after failing to come to resolve their dispute with the business.

The disputed land in Thpong district is part of a 9,000-hectare concession to the company. Meanwhile, Ly Yong Phat, who owns sugar plantations in Koh Kong and Oddar Meanchey provinces that were developed following evictions, has also confirmed he will participate in a controversial partnership between businesses and the Cambodian military that some observers say could see soldiers used to further the aims of the private sector.

Suon Ly, a villager who joined the protest outside the offices, said people from 11 villages came to speak with company representatives about the land dispute, but that when nobody emerged to talk with the group, they decided to torch the company’s office buildings.

Suon Ly added that this is the third time they have tried to speak with representatives of the company.

Governor Kang Heang earlier this month tried to reassure villagers that the concession would not affect their farmland.

Villagers say the company originally offered compensation of US$200 per hectare of rice farmland and $100 per hectare of plantation land, but that as a group they decided to keep their land because they need it to grow rice, which is essential for their livelihoods.

Adhoc’s Ouch Leng said that the villagers “burned down five office buildings” because the authorities and representatives of the company had failed to respond to their requests for negotiations.

Chhean Kimsuon, a representative of Phnom Penh Sugar Company, refused to comment on the incident, and Senator Ly Yong Phat said he had not yet heard about the fire.

Kang Heang could not be reached for comment on the Thpong district dispute.

Don't hold portraits of Hun Sen. He won't do anything to help nor better your lives. Prior, you've done that before in times of despair and bleakness with portraits of Sihanouk and he did nothing to bring upon you salvation. You still live in misery to this day.

Ta Prum also eats frogs.

One day all of the frogs from an area where frogs were hunted badly for food by human. Worrying about the devastation of the frog specy they one day decided to hold a demnonstration and went to seek an intervention from Ta Prum.

Some frog representatived arrive, Ta Prum greats and ask what can do for them. The frog reps have nothing to complaint or mention because the can see that next Tap Prum's there a plate of fried frogs. Then they went back with tears.

Bad mistake CPP. The CPP may be getting richer, but they are digging themselves into a larger grave. It won't be long before children of the CPP families are kidnapped and tortured and their houses set on fire. CPP politicians and military generals abducted and assassinated. Once again we will also see bodies of Vietnamese floating along the Mekong River.

When you steal from your own people, they will have nothing...no hope and no future. Once you've taken away their land, their hope, and eventually their dignity, ...it will come to a point when they no longer have anything else to lose. When that happens, they will do anything out of desperation, despair and anger.

Just a warning to you Hun Sen and the CPP and their families.

So now a few villagers have realised that they need to get physical to protect their lands. Before long there will be more villagers doing the same thing. And soon, there will be weapons on both sides of the conflict.

And who caused all of this? The CPP governmebt and their cronies. Greed feeds upon greed, and they never seem to have enough. Ly Yong Phat is now considering donating to the armed forces, and soon those forces will do whatever he asks of them. Oppression will increase and conflicts will develope to civil warfare once again. But according to some CPP supporters, Cambodia is not that bad.I guess if you have money and land, and the army behind you, it is not that bad. If you don't, well it's a different story then.

It's ashamed to see the brawl between the villagers and police officers. In terms of land dispute, the police men were just doing their job. These villagers should have a legit documents to show to the court that they are land owners. True, they have lived there since 1979! Don't they know that they should have proper document to protect themselves? How long have they lived on this land? Common sense!

Even in U.S, if you don't have a deed in your name as a homeowner/lot, the state or the business would take control of your home/lot. Unless you have a paper in your name to prove that's it is a legit. If you have nothing to prove to the court, you can be evicted. The law doesn't have any pity on the poor. The law in any country is always sided with the rich and powerful people. Luckily, in U.S, before you 're evicted from your home, the court would give you 3 to 6 months. Thanks god! However, the law in Cambodian is different from U.S. In this case, these villagers are screwed! Hope, these issues will be resolved peacefully! Please villagers, don't do stupid thing! Take the money and leave! Start your life from scratch! The law is the law!

Sometime when they took everything from and you have nothing else to lose, it's time to fight back with what you got. These useless gov't is like a school bully; they will try and break you. It's time for the villager to protect their vested property and make that sacrifice if necessary. Show them that you got nothing to lose!

5:43, yes I agree- land title is at the heart of this issue. Without it the courts have no choice but to rule against them, but, I urge the RGC to reopen the registration period to allow those who have occupied the 5 years required by the Land Law of 1993 to register. The 2002 Land Law that cut off this period, also allows the cadastral authority or Ministry of Land Management to issue Title of Possession which can be treated as Title of ownership in these kinds of disputes.

The problem is that many leaders believe that if they listen/care too much to the poor, there is no development. they see the way of development in China. Some projects, like three gorge dam, chinese government evicted millions of people. it is very unfortunate for the poor.

It's their policies for the future on Cambodia is to destroy Khmer slowly. .. Fucked up Hun Sen has no fucking policies to help the Khmer people but for his own pocket and families and his corrupted government. We need to fight for our freedom and the future of Cambodia. So, what is khmer PM doing? where is people's right and justice? gov't needs to have the skill of morality,integrity and professionalism because at the end of the day justice will always be prevailed or the righteous will live forever and the wicked will be terminated. The money to finance this budget of social justice comes from the taxation of company profits and foreign enterprises and incomes of the rich and taxes on non-agricultural land as the land of villas and luxury hotels.

It's high time the rich and powerful in Cambodia to think about establishing a welfare and employment systems to address the plight of the poors and unemployed.

For the stability and well-being of all people, a society must guarantee basic needs of its most vulnerable population. The small costs of providing basic needs to the poors will allow the rest of the society to grow.

The second most important obligation of the government is the development of employment that would promote both high education/vocational training and job market so that the burden of guaranteeing basic needs will sustain.

The government is responsible to establish and promote rule of laws, equal justice, transparency, fair taxation, good public services, civic duties among everyone, private and public sectors.

With or without legal documents/title deeds, ordinary people will always be at grave risk under existing system - just ask the jailed farmers in Svay Rieng.

Recent legislations passed on expropriation is designed to neutralise any protest over perceived violations of civil rights in this specific area by inserting references to 'national interest'. Alas, all known seizures of people's properties, either along international borders or in the interior of the country can now be legitimately expiated within this pretext of national interest, security and development.

Putting blame on people's 'ignorance' is also another unhelpful excuse. Is it not the job of local party officials and authority to educate and inform people of changes in legislation effecting their rights and property?

The CPP is renown for its disciplined, mobilised party network - there is not a breach/disturbance in its structure somewhere in the country that goes unreported and relayed to the leadership, including land encroachments by neighbouring states.

Land disputes have been a recurring burden for many citizens, even without powerful interests getting involved. This is dated back to the arbitrary nature of land and property appropriation that took place in the wake of the overthrow of the Pol Pot regime, when the country's displaced population resumed semi-permanent settlement in places of their own choosing, often with local authority's de facto permission and knowledge. In this case, it would be specious and hypocritical of the authorities to force them off their land with little or no compensation - sometime without consultations whatsoever - never mind that such instances amount to direct violations of civil liberty.

I do feel, however, that in some cases, it would be in genuine national interest and development to relocate settlements - among these are river bank houses with toilets and bathrooms built over open water and other urban shanty towns, provided that fair compensation and or alternative arrangements - new places or houses to move into - have been met. Most people will accept an offer of just solutions.

The phenomenon of floating villages could also be kept in check. Khmer people may live in stilt houses, but they rarely form floating settlements since most rely on farming and other forms of petty trading rather than fishing for subsistence - fishing had traditionally been the preoccupation of the Chams, but even they could not match the scale of today's fishing communities. The Chams were also a mobile people; living on boats, they seldom stayed long in any one location, allowing fish stock to regenerate and be constant source of food supplement for local people.

This co-existence between the Chams and the Khmers was one of the reasons why there had been little or no ethnic tension between the two peoples of any note.

Cambodia is attracting international tourism for a variety of reasons and while cracking down on organised sex industry is a welcome move, the country's prestige and image could improve with democratic reforms and better governance.

The current political instability and tension in Thailand could offer Cambodians ample warning and lesions about the kind of institutional changes that could either lead to longterm stability, or one that will be interspersed with sporadic violence and military coups.
