Synopsis: About 40 Boeung Kak residents showed up at Hun Xen’s residence on Wednesday 15 August 2012 with the aim of handing over a petition to Hun Xen’s wife to ask for her intervention in taking care of a Phnom Penh police officer and the deputy district governor of Daun Penh. The residents accused these two rascals of using violence against a Boeung Kak woman and this led to her miscarriage. However, the residents’ attempt was not successful as the cops protecting Hun Xen’s house immediately chased them away.

I am expressing my deepest concern along with Cambodian and International Civil Society Members,I call for the dismissal of Phnom Penh Deputy Police Chief Phuong Malay based on his unacceptable, facetious and offensive reaction to the lawsuit taken against him for his alleged role in the miscarriage of a female protester who was kicked in the stomach by a member of his police force.

On 27 June 2012, the pregnant woman, Bov Srey Sras, had joined a group of supporters in attempting to march to the Court of Appeal where the BoeungKak 13, amongst them her sister, were having their case heard. Despite the supporters acting within their rights, a violent clash with police took place. Not only was Bov Srey Sras brutally mistreated by officers in this clash, causing her to lose her baby, but when she announced that she was suing the three men she believes responsible, amongst them Phuong Malay, the Deputy Police Chief publicly insulted and degraded her. In yesterday’s edition of The Phnom Penh Post newspaper (01 August), Malay is quoted as follows:

“Is the victim old or young, and does she sue me to return her kid? I want to tell her that if she wants to get back her kid, I am also young.”

Unethical and insulting to women was how Boeung Kak victim Bov Srey Sras yesterday described a municipal deputy police chief’s comments about her miscarriage.

The 25-year-old, who lost her unborn child after a police officer allegedly kicked her in the stomach outside the Boeung Kak 13’s appeal trial on June 27, said she felt sickened by comments deputy municipal police chief Phoung Malay made on Tuesday after she announced she was suing him.

“For me, what Phoung Malay said is an insult to all Boeung Kak women,” she said yesterday. “And it is unethical behaviour that is insulting to women nationwide.”

In response to Srey Sras filing a complaint to the Phnom Penh Municipal Court against Malay, Daun Penh deputy governor Sok Penhvuth and an unknown officer who kicked her, Malay told the Post he did not know what kind of compensation she was seeking.

“Is the victim old or young, and does she sue me to return her kid?” he said on Tuesday. “I want to tell her that if she wants to get back her kid, I am also young.”

The comments infuriated the Boeung Kak community, which yesterday demanded an apology.

A deputy police chief being sued for his alleged role in a pregnant woman being kicked in the stomach outside the appeal trial of the Boeung Kak 13 in June said yesterday he did not know what compensation the woman, who miscarried, wanted.

“Is the victim old or young, and does she sue me to return her kid?” Phnom Penh municipal deputy police chief Phoung Malay said. “I want to tell her that if she wants to get back her kid, I am also young,” he said.

Bov Srey Sras, 25, from Boeung Kak’s village 21, said she was suing Malay, Daun Penh deputy governor Sok Penhvuth and an officer who kicked her, claiming they are all responsible for inflicting “intentional violence”.

“I am suing them for my own justice and for the justice of my two-month-old unborn baby who was killed by police,” said Srey Sras, the sister of Bov Sophea, one of the 13 women on trial.

“Violent crackdowns have increased”

More than Cambodian 400 anti-riot police officers have completed training in the suppression of protests and dismantling of roadblocks, raising fears among rights groups and workers’ unions that the authorities may use excessive force against demonstrations.

Phnom Penh police chief Touch Naruth said however that the specially trained force from among officers from eight districts of Cambodia’s capital Phnom Penh will not be used to “crack down” on protesters.

“We should not use the words ‘crack down,’” he said, adding that the group’s training provided by Cambodia’s Ministry of the Interior and National Police Commission has been focused mainly on deterring demonstrators from violent protest.

“We should say ‘prevent,” he said.

Call for intervention for the release of union activist - 11 July 2012

Dear National and International Partners and Stakeholders,

I am President of the Cambodian Confederation of Unions (CCU) would like to appeal to all of you to involve and intervene on the case of illegal arrest of our union activist, Mr. Rong Panhan, Officer of the Cambodian Alliance Trade Union (CATU) since this morning around 09:00am at in front of the Botum Vattay pagoda on 11 July 2012 without appropriate reason soon after our CCU submitted its petition to the Cabinate Office of Prime Minister.

This morning, 11 July 2012, Cambodian Confederation of Unions (CCU) and Cambodian Alliance Trade Unions (CATU) mobilize workers from Tai Nan Factory (former Tai Yang) in Phnom Penh capital with the purpose of requesting the Government to engage in providing possible solution to the workers' demand on other benefits according to the labor law. 

However, the officer of CATU, Mr. Rong Panhna, was beaten seriously on his head caused bleeding and also arrested him by the municipal authority and now not yet release. 

Therefore we would like to call for help make possible intervention into this case from national and international human right groups or organizations including United Nations High Commissioner Office for Human Rights in Cambodia, International Labour Organization (ILO) and International Trade Unions Confederation (ITUC) in order to free Mr. Rong Panhan from the illegal arrest.

ជាមួយ​គ្នា​នេះ ក្រុម​គ្រួសារ​ស្ត្រី​រងគ្រោះ​ឈ្មោះ​បូវ ស្រី​ស្រស់ ដែល​ត្រូវ​សមត្ថកិច្ច​នគរបាល​ចម្រុះ​ វាយ​បង្រ្កាប​ដោយ​ហិង្សា​រហូត​ដល់​រលូត​កូន​ពីរ​ខែ​ក្នុង​ផ្ទៃ​នាង​ នោះ គ្រោង​ដាក់​ពាក្យ​បណ្ដឹង ​ទៅ​តុលាការ​រាជ​ធានី​ ដើម្បី​ទាមទារ​ឲ្យ​សមត្ថកិច្ច​នគរបាល​ខណ្ឌ​ដូនពេញ ទទួល​ខុស​ត្រូវ​លើ​ករណី​នេះ​ផង​ដែរ។​

ភ្នំពេញៈ ក្រុម​ស្ត្រី​អ្នក​ភូមិ​បឹងកក់ ដែល​ទើប​តែ​ត្រូវ​បាន​ដោះ​លែង ​ចេញ​ពី​ពន្ធនាគារ មិន​ត្រឹម​តែ​មិន​បាក់​ស្បាត​ប៉ុណ្ណោះ​ទេ ថែម​ទាំង​គំរាម​ប្តឹង លោក កែប ជុតិមា អភិបាល​រាជធានី​ថែម​ទៀត ប្រសិន​នៅ​តែ​មិន​ព្រម​បែង​ចែក​ដី ដែល​លោក​នាយក​រដ្ឋ​មន្ត្រី​ផ្តល់​ឲ្យ​ពួក​គាត់​ជាង ១២ ហិកតា ឲ្យ​បាន​គ្រប់ៗ​គ្នា​ទេ​នោះ​។

អ្នក​ស្រី​តុល ស្រីពៅ អតីត​អ្នក​ទោស​ក្នុង​ជម្លោះ ដី​ធ្លី ដែល​ទើប​តែ​ត្រូវ​បាន​ដោះ​លែង​ ចេញ​ពី​ពន្ធនាគារ​ព្រៃ​ស កាល​ពី​យប់​ថ្ងៃ​ពុធ ជាមួយ​និង​ស្ត្រី​អ្នក​ភូមិ ១២ នាក់​ផ្សេង​ទៀត បាន​និយាយ​កាល​ពី​ម្សិល​មិញ​ថា អ្នក​ស្រី​នៅ​តែ​មិន​អស់​ចិត្ត ចំពោះ​ទង្វើរ​បស់​អាជ្ញាធរ ដែល​បាន​ចាប់​អ្នក​ស្រី និង​ស្រ្តី​អ្នក​ភូមិ​បឹង​កក់​ជាង​ ១០ នាក់​ទៀត យក​ទៅ​ដាក់​គុក​ទាំង «គ្មាន​កំហុស»​។ អ្នក​ស្រី​បាន​បន្ត​ថា ពល​រដ្ឋ​ក្នុង​សហគមន៍​បឹង​កក់​ទាំង​អស់ ត្រូវ​បាន​គេ​បំបិទ​សិទ្ធិ​សេរីភាព​ ដោយ​គ្រាន់​តែ​ទៅ​មើល អ្នក​ភូមិ​ក្នុង​សហគមន៍​ជាមួយ​គ្នា​សង់​ផ្ទះ​សោះ ត្រូវ​បាន​អាជ្ញាធរ​ចាប់​យក​ទៅ​ដាក់​គុក អស់​រយៈ​ពេល​មួយ​ខែ​បីថ្ងៃ​។ អ្នក​ស្រី​ថ្លែង​ថា​៖​«យើង​មិន​សុខ​ចិត្ត​ទេ យើង​នឹង​ប្ដឹង​ប្រឆាំង​នឹង​លោក​ កែប ជុតិមា ប្រសិន​បើ​គាត់​មិន​ដោះស្រាយ បោះ​បង្គោល​កំណត់​ព្រំ​ប្រទល់​ដី ១២,៤៤​ ហិកតា ដែល​ប្រមុខ​រាជ​រដ្ឋាភិបាល​ផ្ដល់​ឲ្យ​យើង​ខ្ញុំ ជា​ប្រជា​ពលរដ្ឋ​តំបន់​បឹងកក់ ឲ្យ​បាន​ច្បាស់​លាស់​ទេ​នោះ ហើយ​បើ​សិន​ជា​គាត់​នៅ​តែ​កាត់​គ្រួសារ​ប្រជា​ពលរដ្ឋ​ណា​មួយ​ចេញ​ពី​គម្រោង ដែល​ត្រូវ​ទទួល​ប័ណ្ណ​កម្ម​សិទ្ធិ​ពី​ចំណែក​ដី​នេះ​»។
