Villagers in Svay Rieng province’s Romeas Hek district declined a meeting yesterday with local authorities out of fear for their arrest yesterday, instead choosing to extend their protest over a rubber plantation into a fourth day.
“All the villagers were afraid that the authorities would arrest their representatives, so I did not allow the other representatives to join the meeting,” community leader Chap Sophat said yesterday.
Hem Sokun, Romeas Hek district deputy governor, said yesterday he had called the community representatives to negotiate a peaceful solution to the issue.
“I wanted both sides to succeed together to avoid a dispute, but if they did not come, how could I settle it?” he said.

The Phnom Penh municipal court will hold a hearing in the case of opposition leader Sam Rainsy who was accused of map falsification and disinformation on 08 September, i.e. tomorrow. The government sued Sam Rainsy on 26 February after he published public documents proving that Vietnam encroached on Cambodian territories in Svay Rieng province. Chuong Chou-ngy, Sam Rainsy’s defense lawyer, told reporters on 07 September that Sam Rainsy did not break the law as he was accused of. Chuong Chou-ngy said that on 08 September, he will ask the court to drop the charges against Sam Rainsy and he plans to show 2 important documents proving that Sam Rainsy did not falsify any map, nor was he involved in disinformation. In January, the Svay Rieng provincial court sentenced Sam Rainsy in absentia to 2-year of jail time for uprooting border stakes in Chantrea district. The Appeal court will reconsider this case on 05 October.

The Cambodian Appeal court plants to open a new hearing in the case of opposition leader Sam Rainsy and that of two Cambodian villagers on 05 October after two successive delays.
Opposition leader Sam Rainsy and two Cambodian farmers are accused of destruction of public property and incitation to racial discrimination.
There were 2 successive delays in the hearing already due to (1) the two Cambodian farmers, Mrs. Meas Srey and Prum Chea, were not present during the hearing while they are important witnesses in the case, and (2) when the two farmers were brought to court, lawyer Sam Sokong was absent from the country and the two farmers refused to take another lawyer as his replacement.
Chuong Chou-ngy, Sam Rainsy’s defense lawyer, told RFA on 01 September: “I am prepared to defend H.E. Sam Rainsy at the Appeal court according to the law.”
Regarding the complex issues above, Chan Sok Yeang, the defense lawyer for the government and, in particular, that of the Svay Rieng province’s Chantrea district authority, indicated: “They delayed the case twice already, therefore I am prepared, I was prepared since the very first time.”
Currently, the two farmers are incarcerated, whereas opposition leader Sam Rainsy is living in self-exile in France.
Sam Sokong transferred the defense of the farmers to another lawyer once already, however, he indicated that he already sent his request to the Appeal court to continue defending his clients again.
Sam Sokong said: “I sent the request letter to defend my client once again to the Appeal court on 27 August. When I sent the request, the court accepted it officially already. I’m just waiting for the hearing date.”
Sam Sokong was absent for 3 weeks during the hearing date because he had to travel to East Timor to attend a human rights training.
SRP MP Yim Sovann, SRP spokesman, indicated that this case is political: “[The lawyer is] defending them in order to encourage them because this judgment is extremely unfair, it is a political case.”
On 27 January 2010, the Svay Rieng provincial court sentenced opposition leader Sam Rainsy in absentia to 2-year of jail time after charging him with destruction of public properties and incitation to racial discrimination simply because he uprooted border stakes located at border post 185 in Koh Kban village, Samrong commune, Chantrea district, Svay Rieng procine on 29 October 2008.
The Svay Reing court also sentenced the two Cambodian farmers, Mrs. Meas Srey and Prum Chea, to 1-year of jail time each for their participation in the uprooting of the border stakes. The farmers charged that these stakes were planted on top of their rice field.

Man kills five relatives in Cambodia
Phnom Penh, Aug 20 (DPA) A Cambodian man killed five family members and injured three others after they prevented him from raping his 16-year-old sister-in-law, local media reported Friday.
The man, identified only as Nang, then hanged himself.
Police said the crime, which took place Thursday in south-eastern Svay Rieng province near the border with Vietnam, was among the worst the country had seen in years.
Provincial police chief Prach Rim told the Phnom Penh Post newspaper the victims were related to Nang.
“The attacker had raped his sister-in-law twice before, and he tried to rape her again, but was apparently stopped by his family,” he said.
“They then fought together, and the attacker locked the doors of the house and stabbed his family members to death before hanging himself,” Prach Rim said.
Police said Nang murdered his wife, his 2-year-old son, his mother-in-law and two of his sisters-in-law. His daughter and nephew were injured, as was the sister-in-law he tried to rape.
Last month a drunken soldier murdered three people and injured four during a rampage in nearby Kampong Cham province after arguing with his wife.
The head of one prominent local human rights organisation said he was worried the issue of domestic violence is not being taken seriously in parts of Cambodia.
“It seems everyone sees this kind of violence as normal,” said Thun Saray, the head of Adhoc.

Big Victory For Cambodia Regarding Border Issue

BIG VICTORY FOR CAMBODIA REGARDING BORDER ISSUE
I am extremely pleased to learn that our Government has finally recognized that the so-called temporary border post # 185 made up of six wooden poles which I pulled out in Svay Rieng province on October 25, 2010, was not a real and legal border marker. Moreover, officials from the Council of Ministers have specified in official documents submitted to the Court that that so-called temporary border post was actually located at a distance of “approximately” 516 meters from the real and legal borderline!
The corresponding official documents including a detailed map with precise measurements, are presented here.
The Government and I have now reached the same conclusion regarding border delineation in Samraong commune in Svay Rieng province’s Chantrea district. We all base our assessment and measurements on the French-era SGI 1/100,000 Map that has been deposited at the United Nations since 1964. My related work and the enlightening report by Professor Régis Caloz are presented here.
This is really a big victory for Cambodia when it comes to ensuring the respect for our country’s territorial integrity as enshrined in the 1991 Paris Peace Agreements and in the Kingdom’s 1993 Constitution.
At least on this specific point of the borderline, all Cambodians from all political parties agree with the Government decision to officially dismantle the fake and illegal border post # 185 which I suppressed last October when helping Khmer farmers defend their rice fields against land confiscation associated with border encroachment. Similarly, the nearby and also fake and illegal border post # 184 was suppressed by the Cambodian and Vietnamese authorities themselves last November.
There are two automatic implications from the above Government “technical” decision:
1- The two Khmer farmers who have been arrested following the October 25 incident, Ms. Meas Srey and Mr. Prum Chea, must be immediately released from prison. They did nothing wrong when helping me pull out the above-mentioned six (commercially worthless) wooden poles that had been illegally planted on Ms. Meas Srey’s rice field, i.e. on a private land without the consent of its legitimate owner.
2- All Khmer farmers including Ms. Meas Srey and Mr. Prum Chea, who have lost their land because of “technical errors” in the border demarcation process in the last few years, must be given back their property.

Temporary Border Post Sits Well Inside Cambodian Territory: Sam Rainsy

TEMPORARY BORDER POST SITS WELL INSIDE CAMBODIAN TERRITORY
In your article "By Video, Sam Rainsy Courts International Support" (January 29, page 1), you wrote, "Mr Rainsy pointed again to maps created by the Sam Rainsy Party."
I would like to stress that the SRP has not "created" any map. The ones we have recently presented are well-known official maps used and put forward by the Royal Cambodian Government itself. They are the French-era 1952 1/100,000 map and the US Army 1966 1/50,000 map. The 1952 map was deposited at the United Nations by the RCG under then-Prince Norodom Sihanouk [in 1964] in order to help secure international guarantee for Cambodia’s borders as inherited from the French colonial administration.
The SRP technical work on this issue is rigorously based on the above-mentioned official maps and consists of a two-step demonstration that anybody with good faith can easily follow or check:
1- Go on the spot, meaning to the exact location of the "temporary border post #185" in Svay Rieng province which I pulled out on October 25, and get the exact and precise geographic coordinates of that spot using a GPS device. The data collected are also known as GPS locations.
2- Locate on the maps the precise position of this "temporary border post #185" according to its geographic coordinates as collected from the GPS device. This can be done manually using a simple computer-designed grid as shown in SRP document "How to manually position border posts on a map," available at http://tinyurl.com/ycmw48z . The same result can be obtained more quickly by using specific computer programs.
The result is clear and irrefutable: The "temporary border post #185" sits well inside Cambodia’s territory, at a distance between 250 meters and 300 meters from the legal border with Vietnam as delineated on any of the two existing official maps.
Therefore, I did not pull out any real and legal border post, and the accusation against me and two Cambodian farmers, victims of land grab associated with border encroachment, is groundless.
Any independent map expert anywhere in the world could certify the accuracy of the SRP presentation provided the geographic coordinates (collected at Step 1) are accurate. The methodology itself (used at Step 2) would be acceptable by all.
Therefore, in order to allow a transparent assessment and a fair judgment, the government should publicize, and the court should ask for, the GPS locations of the concerned "temporary border post #185" and those of similar alleged border demarcation markers in the immediate vicinity.
At my trial on January 27, a representative from the government Border Committee denied my lawyer’s request that the court be given the geographic coordinates of "temporary border post #185" because, he said, this data is "confidential and secret."
But anybody now (journalists, diplomats, observers, ordinary citizens) can obtain this "confidential and secret" data by going on the spot with a GPS device. They will see by themselves where the truth stands. They will help uphold justice.

THE opposition Sam Rainsy Party has released what it says is evidence of Vietnamese border encroachments into Cambodia’s Svay Rieng province, in an area where party president Sam Rainsy joined villagers in uprooting temporary border posts in October.
The evidence, which was posted on the SRP’s Web site on Sunday and is to be presented by Sam Rainsy in a radio broadcast at 6pm tonight, suggests Vietnam border markers 184, 185, 186 and 187 are located inside Cambodian territory, according to French- and American-drawn maps.
In a statement released on Saturday, the SRP says Sam Rainsy has been assisted by historians and geographers from several countries in a bid to prove the border markers sit well within Cambodia’s legal borders. The SRP president is to be tried in absentia along with two local villagers at Svay Rieng provincial court on Wednesday in connection with his removal of the posts.
“We want the Cambodian people to realise the bad faith and incompetence of the current Cambodian government ruled by the Cambodian People’s Party, and we are seeking justice for the villagers currently being detained at Svay Rieng provincial prison in relation to the uprooting of the border-demarcation posts along with opposition leader Sam Rainsy,” said SRP spokesman Yim Sovann.
Cheam Yeap, a senior CPP lawmaker, said that Sam Rainsy’s appearance on the radio show would not erase his crime, adding that he has to take responsibility for his behaviour.
“If the upcoming trial at the provincial court issues a guilty verdict, he will have to respect the law … and his political life will end in the country,” he said on Sunday.

All the alleged border demarcation posts examined in our study (# 184 through #187), including the one Sam Rainsy uprooted last October (# 185), are illegal because they were fraudulently erected well within Cambodia’s territory. The wooden poles were wrongly planted between 300 meters and 500 meters from the legal border as defined in French SGI 1952 1/100,000 maps deposited at the United Nations by the Royal Cambodian Government under then-Prince Norodom Sihanouk in March 1964. The French-drawn maps are corroborated by US Army 1966 1/50,000 maps as far as the international border is concerned in this portion of Cambodia’s Svay Rieng province.
We have got satellite pictures of the border areas and GPS locations/geographic coordinates of all the fraudulent border markers. We have used state-of-the-art computer programs (available upon request) to convert the GPS locations of the fraudulent border markers into UTM coordinates so as to precisely position those fraudulent border markers on the above-mentioned maps.
Any question related to the defense of Cambodia’s territorial integrity can be asked directly to opposition leader Sam Rainsy during the radio call-in show scheduled for tomorrow.

We have used state-of-the-art computer programs (available upon request) to convert the GPS locations of the fraudulent border markers into UTM coordinates so as to precisely position those fraudulent border markers on the above-mentioned maps.
Any question related to the defense of Cambodia’s territorial integrity can be asked directly to opposition leader Sam Rainsy during the radio call-in show scheduled for tomorrow.

Lies reported by the Svay Rieng police commissioner

On 26 October 2009, Mr. Prach Rim, the Svay Rieng province police commissioner, sent a report to the Svay Rieng provincial governor about the case of uprooting of border stakes located in Koh Kban Kandal village, Samrong commune, Chantrea province, Svay Rieng province. In his report, the commissioner detailed about the stakes uprooting activity and all the people who were allegedly involved in this act.
The report by the police commissioner listed the names of a number of people who did not even attend this Kathen ceremony, yet they were accused of participating in the uprooting of the border stakes. Therefore, this report is a total lie.
Using this same lying behavior, the Svay Rieng police commissioner went on to defame and twist a group of SRP MPs who went to seek truth in the border post planting in Samrong commune, Chantrea district, Svay Rieng province, on 14 December 2009. The Svay Rieng police commissioner reported by exaggerating the truth and claimed that the SRP MPs used violence against police officers causing 15 of them to be injured.
The Ministry of Interior (MoI) should review the action and the activities of the Svay Rieng police commissioner who has a tendency to lie, to not respect police independence, to undermine the public belief and confidence in the public institutions that must be faithful in their service to all citizens and that are devoid of political discrimination. If the MoI still continues to preserve commissioners like Mr. Prach Rim, the MoI will continue to receive reports filled with lies and it cannot find the truth to resolve problems for the victims. Furthermore, innocent bystanders will be victimized forever and no light of justice will be provided to them as long as the MoI continues to nominate people who lack honesty and who lie, such as Mr. Prach Rim, as police commissioners in this province.

As previously planned, on Monday 14 December, 21 SRP MPs went to visit Cambodian-Vietnamese border posts in Svay Rieng province. However, when the opposition MPs walked over to border post no. 185 – the one that Mr. Sam Rainsy led villagers to uproot on 25 October – 20 to 30 cops prevented them from approaching it.
A melee and pushing match between the cops and the local villagers took place on Monday afternoon when the Svay Rieng provincial police authority set up a barrage along rice fields to prevent SRP MPs and opposition activists from approaching this disputed border post. However, the incident did not cause any injury. At the end, the group of local villagers and SRP MPs succeeded in reaching the border zone at the rice field location where Mr. Sam Rainsy led a group of villagers to uproot the border stakes 2 months ago.
During the one-day trip to the Svay Rieng border, the group of 21 SRP MPs visited border post no. 152, located in Romduol district, and the border stakes for post no. 185 located in Chantrea district, Svay Rieng province. Yim Sovann, SRP MP and SRP spokesman who also traveled with the other 20 SRP MPs, indicated that the villagers all complained about the loss of their rice fields due to the planting of border posts with Vietnam. At Wat Ang Romdenh Pagoda, located about 300-meter from border post 185, the Cambodian authority also prevented the monks from building anything there as well.
The complaints made by local villagers led Mr. Sam Rainsy to lead a group of local villagers to uproot 6 border stakes out of their rice fields on 25 October. However, the Svay Rieng authority sued Sam Rainsy immediately. Regarding the complaints by local Cambodian farmers about the loss of their rice field lands, Cheang Am, the Svay Rieng provincial governor, indicated that according to the border delimitation work between Cambodia and Vietnam based on maps, there are some regions that encroached into Cambodian territories and some regions that encroached into the Vietnamese territories as well.
