After a brief détente, a fight over the Prey Trolach community forest in Battambang province that has its citizen guardians and the Forestry Administration pitted against the military is back on, those working to protect the area from illegal logging said yesterday.

Since it was deemed a community forest in 2004, the 1,335-hectare area in Roka Kiri has been legally managed and protected by villagers living there.

But community representatives told the Post on August 1 that shortly after a national land-titling scheme was announced in June, soldiers, police and others had rushed into the area, seizing a final opportunity to clear forest and falsely claim it as their property.

John Macgregor, a project adviser for the livelihood group After the Flood, said the land grabbers had been pushed out by district authorities backed by police and the forestry cantonment on August 8 after the story was publicised – but not for long.

Villagers who allege authorities and armed forces in Preah Vihear province have been burning their houses and clearing farmland of 400 families, to create a social land concession, protested yesterday, calling on intervention from Prime Minister Hun Sen.

The 5,557-hectare SLC in Kulen district’s Srayang village is supposed to house the families of 160 disabled soldiers, government sources say.

Representatives of the 200 villagers protesting said they had lived on 2,000 of those hectares since 2002, when they received written commune council recognition that they were farming the area but no formal land titles.

Preah Vihear provincial authorities recently announced they needed around 5,500 hectare in “social land concessions” to provide to retired government soldiers.

PHNOM PENH - Representatives from some 370 families arrived at the Phnom Penh administration building of Prime Minister Hun Sen on Monday, calling on him to intervene in a land dispute in their home province of Preah Vihear.

Leaders of the group said they are being ousted from their homes along National Road 64 to make room for government land for retired soldiers.

Chea Yean, 60, from Sroryong village, near the border with Siem Reap province, said authorities had already begun to bulldoze the land, leveling villagers’ crops.

Nineteen families from Pursat province’s Prangil commune, plagued by a long-running land dispute with developer Pheapimex, are in despair now that student volunteer surveyors cannot help them reclaim land they say is rightfully theirs.

Villager Tes Chhieng Ly said that the residents would be forced to take protests to higher levels, after their plans to plead for help from student volunteers measuring their land were thwarted by Wednesday’s policy backflip by Prime Minister Hun Sen.

“Now, we don’t know what to do because volunteering youths are told that they have no obligation … we seem hopeless,” Chhieng Ly said.

Prime Minister Hun Sen on Wednesday revealed he had revised his land titling program – announced in June – which aimed to alleviate land disputes by employing over 2,000 university students, at $7 a day, to demarcate villagers’ land in state forests, former timber concessions and economic land concessions.

The amendment means students will no longer measure disputed land and has prolonged the original six-month timeframe of the project.

More than 200 villagers rallied outside Muk Kampoul district hall in Kandal province yesterday demanding titles to land they said 200 families had occupied since 1979 but that a company had cleared in 2006.

The villagers say the company CT Mart cleared 86 hectares of their land in Sambuor Meas commune’s Peang village to build a dam, preventing them from planting their dry season paddy there ever since.

Chhay Chhun, a representative of the protesters, said the land had been flooded as ruling party Senator Ly Yong Phat began building a nearby satellite city.

“We occupied the land for a long time, but did not make titles, and [then] the company showed its land title. We protested at all places, but there were promises only,” he said.

In Lum Phat district’s Seda commune, the message from villagers attending yesterday’s Cambodian Center for Human Rights’ land forum was clear: We’ve been duped.

The mixed Khmer and ethnic minority villagers said they were coerced into accepting the phenomenally low price of US$150 per hectare of land from the DM Group and other private plantation companies and were forced to thumb-print documents leaving them with effectively no legal recourse – and no land – plunging the semi-nomadic community into even greater poverty and uncertainty.

Kuch Moly, a Funcinpec lawmaker who sat on the three-person panel at the forum alongside Seda commune chief Thom Phain, rebuked villagers for filing complaints when they have already accepted compensation.

He and fellow lawmaker Ou Chanrith, from the opposition Human Rights Party who also sat on the panel, were handed a complaint thumbprinted by 29 families whose houses had been burned to the ground by the DM Group in June of last year.

Another alleged “secessionist” involved in a land dispute was arrested yesterday in Pursat province’s Veal Veng district, where villagers said authorities continued a prolonged forced eviction that has led to the destruction of some 500 homes.

Three other men accused of attempting to create an autonomous state in Krapouie commune’s Kampong Kdey village evaded a force of military and regular police officers who stormed the village and began dismantling homes.

Pursat provincial police chief Sarun Chanthy declined to name the arrested suspect who he alleged had taken money from and granted land titles to recently arrived migrants despite having no authority to do so.

Inner city students enlisted into Prime Minister Hun Sen’s nationwide land-titling program have been getting a taste of the rural life and some of them are ready to come home.

Prepped with a two-day crash course in surveying, more than 1,000 youths have been dispatched across the Kingdom to help tackle the innumerable land disputes that have long simmered around the country.

The volunteers are part of the premier’s ambitious scheme to measure 1.2 million hectares of land in six to eight months for 350,000 families affected by economic land concessions.

They may be decked out in army fatigues, but these youngsters are far from battle hardened, and the conditions, as well as the work, are starting wear some of them down.

Authorities in Stung Treng province have released the names of five government officials whom they arrested on Tuesday in Samki commune for interfering with a corps of youth volunteers sent to measure land as part of the prime minister’s national initiative to grant property to Cambodians displaced by land disputes.

According to Sao Sarem, the deputy provincial commander of the military police, the officials are Meas Sokun, a legal adviser to the Cambodian People’s Party; Kuch Prisovan, her husband and a lieutenant colonel in the Royal Cambodian Armed Forces; Van San, an RCAF colonel; Meas Kearithy, an RCAF soldier; and military police officer Prak Sith.

Three of them were released yesterday due to their limited roles in the incident, he said.

“We currently only detained the couple Kuch Prisovan and Meas Sokun, who seriously insulted the student volunteers working on [the initiative] of the Premier Hun Sen, and their car contained loads of land dispute-related documents,” he said.

Hundreds of people from 10 villages in Svay Rieng province’s Krasaing commune claim that Mittapheap Rubber Tree Company has been clearing parts of their community-owned forest illegally for more than a year.

On Tuesday, residents involved in the land dispute took matters into their own hands.

About 200 of them descended on a bulldozer as it was busy tearing up a cassava farm, according to a village representative.

After the driver fled, one villager with bulldozer-navigating skills piloted it to the Forestry Administration, where it was handed over to officials.

Synopsis: 5 government officials working at the Council of Ministers and the Ministry of Defense were arrested after they disputed with CPP land volunteers. These volunteers were sent out to distribute lands to villagers involved in land disputes with a company that received land concessions in Dong Kralor, Samaky commune, Stun Treng province. The authority refuses to provide the names of the officials arrested and it only indicated that some even work as government lawyers.

“The district governor said that when I identify how much land I have, the young people will provide land to me according to the amount of land I have, but the young people do not dare to trim land for villagers if the company does not allow them”

Adorned in new military uniforms, about 400 more young volunteers who have been enlisted into Prime Minister Hun Sen’s ambitious national land-titling scheme departed from Diamond Island yesterday armed with measuring tapes, computers and GPS units.

The budding surveyors are the latest group of some 2,000 students being dispatched across the country to measure land for families who claim to live in areas overlapping economic land concessions, though details of just how this will be implemented have been murky.

Im Chhun Lim, senior minister for the Ministry of Land Management, told the assembled volunteers yesterday they had six to eight weeks to help officials grant 1,200,000 hectares to villagers nationwide.

Prime Minister Hun Sen said yesterday 700 volunteers from the Cambodian People’s Party had fanned out across eight provinces to measure properties and provide titles to villagers who have been displaced by land disputes.

Speaking to about 10,000 villagers in the Kroch Chhmar district of Kampong Cham province, the premier said that 700 out of a total 1,100 volunteer youth were already deployed at Kampong Cham, Kratie, Rattanakkiri, Mondulkiri, Kampot, Banteay Meanchey and Battambang provinces in cooperation with local authorities.

“[Their] obligation this time is to resolve problems [villagers have been having while living] on the state land, including forestry concession, economic land concession and the state land where the villages were illegally occupied,” said Hun Sen. “I will hand over land certificates for the villagers after the process is done in order to ensure that villagers have legal rights to own the land.”

Prime Minister Hun Sen’s June order that land be cut from economic land concessions and returned to displaced villagers – a move that has alternately inspired gratitude and scepticism – now has a high-profile public face: one of his sons.

Hun Manith, deputy chief of Hun Sen’s cabinet and his third-oldest child, was appointed deputy secretary-general of the National General Secretariat for Land Disputes, according to an entry in the Royal Book released on June 15.

The appointment makes Manith second-in-command of the agency, which was tasked by the premier with measuring and granting land to people displaced by land disputes.

Sam Rainsy Party spokesman Yim Sovann yesterday expressed hope that Manith would help displaced villagers, but added that a lot of young Cambodians had the experience and ability to hold such positions, and lamented the fact that such opportunities in Cambodia were in the hands of one individual.

Two hundred representatives of more than 500 families from Preah Vihear made the long journey to Phnom Penh yesterday to seek Hun Sen’s intervention in a bitter, long-standing land dispute involving the now-defunct NGO Drugs and Aids Research and Prevention Organisation.

In 2007, DARPO was granted more than 500 hectares of land by the government to distribute to poor villagers living in Preah Vihear’s Kantuot village.

However, villagers were already living on the land DARPO was granted, a problem that was compounded when the NGO then sold the bulk of the land to a handful of families from Preah Vihear and Phnom Penh.
