Defamation case [against Soy Sopheap] appeal

General director of Nokorwat newspaper Touch Kongkea has appealed a court decision that rejected his accusations media baron Soy Sopheap defamed him and stole personal emails.
Touch Kongkea sued the Deum Ampil Media Centre general director last year for allegedly accessing private emails between himself and Lim Bunheng, president and CEO of rice-milling company Loran Import-Export Co Ltd.
The emails, which have been seen by the Post, pertained to a planned takeover of a radio station run by Soy Sopheap.
Phnom Penh Municipal Court threw out the charges three weeks ago, but Touch Kongkea’s lawyer, Chan Vichet, said yesterday that his client had appealed this decision on February 29.

THE former financial backer of the Deum Ampil Media Centre has presented her version of the events that led to its abrupt scale-back earlier this month.
Speaking after the official launch of the new Nokor Wat Media Centre, Sieng Chanheng accused Deum Ampil’s former director general, Soy Sopheap, of managing the company’s finances in a reckless manner and accepting bribes from businesses in exchange for favourable coverage.
“Soy Sopheap was not faithful to my company, which was the financial supporter of DAP,” said Sieng Chanheng, also the owner of the Heng Development Company.
On July 1, Soy Sopheap announced that Deum Ampil would suspend operations for Deum Ampil newspaper, Radio FM 93.75 and Morokot magazine, citing a lack of funds. The media centre’s website is still being updated.
He said at the time that he decided to go ahead with the suspension after he was asked by Sieng Chanheng to cut the total expenses of the operations in half, in part by laying off many of his 110 staff members.
Sieng Chanheng has denied asking Soy Sopheap to cut expenses, though she has acknowledged losing tens of thousands of dollars each month on her Deum Ampil investment.
At the launch of the Nokor Wat Media Centre on Friday, she said Deum Ampil’s finances were in order until Soy Sopheap assumed control of them from her daughter, former deputy director general Dim Sopheavy.
At that point, she said, Soy Sopheap began increasing salaries for his preferred employees and entering into arrangements with companies that allowed him to pocket tens of thousands of dollars.
“I always heard rumours that there were some companies or individuals paying money to DAP every month,” she said. “I never wanted a situation where when people paid you money, you wouldn’t write bad things about them.”
Last month, she said, she came across a list of 15 “groups” that had paid Soy Sopheap US$60,000. “I tried to correct him then, but he did not listen to me,” she said.
Soy Sopheap declined to answer questions for this article.
Sieng Chanheng went on to express regret that the two had parted on bad terms. “I like Soy Sopheap, who is brave and has courage,” she said. “That is why I invested in this media organisation with him – he had the knowledge, and I had the money to open DAP.”
Information Minister Khieu Kanharith said Friday that Prime Minister Hun Sen had requested that his ministry support the Nokor Wat Media Centre as it begins operations. He said this was evidence of the government’s interest in promoting “breaking news that the readers will like to read”.
Sieng Chanheng said Dim Sopheavy would assume the role of editor in chief of the new media centre, but that other top positions had yet to be filled.

On April 20, Soy Sopheap attended a land dispute meeting between authorities and villagers in Kampong Speu province’s Thpong district, during which, villagers say, he attempted to coerce them into placing their thumbprints on documents that they feared could later be used to cheat them out of land.VILLAGERS involved in a land row with the Heng Development Company in Kandal province’s Kandal Stung district publicly accused Deum Ampil News publisher Soy Sopheap of disseminating disinformation Tuesday after he published and broadcast stories that the villagers say demonstrated bias towards the company.
A print story, published Tuesday, quoted at length the owner of the company, Seang Chan Heng, as well as two letters issued on May 7 by Prime Minister Hun Sen’s cabinet.
The letters stated that on October 5 of last year, Hun Sen decided that the Heng Development Company was the rightful owner of the 200 hectares of disputed land because the company had obtained the proper land titles.
The Deum Ampil story also cited a letter from the Council of Ministers dated December 24, 2008, that reached the same conclusion. But the story did not include any quotes from villagers affected by the dispute.
Oeung Chanry, a village representative, said that Deum Ampil Radio had broadcast comments that also were akin to disinformation.
Soy Sopheap “accused the villagers of having sold that land already, but said that we wanted to take the land back so we could sell it again because now land is getting a high price”, she said.
She reiterated earlier claims that the cabinet’s letters were “fake”, and demanded that Soy Sopheap explain his actions.
Him Sophal, a village representative, said that Soy Sopheap should not make false accusations against villagers or take the side of companies involved in land disputes. “We plan to go to the Deum Ampil office to ask Soy Sopheap to explain why their story supported the company,” he said.
But Soy Sopheap denied his story was biased. “What I did was balanced because I took quotes from sources to write the story and I wrote what sources said,” he added.

Where Does Bun Rany Get the Money From?

It is not new about the news of high ranking Cambodian leaders or Chhumteav handing out gifts or alm to poor people or soldiers.
This one seems interesting like before but so unusual and I can´t help writing to enlight it to the public.
Well, the news is posted on the Deam Ampil News today about “ Chhum Teav Bun Rany Hun Sen to donate 7000 mosquito nets and 130000 rain coats to Cambodian soldiers stationing at Preah Vihear and at region 4.
My question is where does Bun Rany get the money to buy these stuff? Where is Cambodian Ministry of National Defense? What is Cambodian Ministry of National Defense doing?
The problem is that the budget for national defense has always increased since 2006 which accounted for $75,7 million (the national budget in that year was $926 million) to $300 million in 2008 and while the number of soldiers has been decreased from 111232 to 78232 after three time processes of demobilization from the World Bank pilot project in year 2000 and 2001 which accounted for 3000 soldiers, and in year 2003 which acounted for 30000 soldiers.
As we know the anual national budget for the Ministry of National Defense is accounted for $300 million out of the $1.4 billion national budget in 2008 and it is proposed in October 2008 to be increased by Hun Sen to the amount of $500 millions in the proposed national budget of $1.89 billion in 2009.
Why the Ministry of National Defense can´t afford to supply these stuff with such amount of the annual budget? Why our beloved soldiers still don´t have enough supply? Where are all the hundreds of million dollar gone? I mean if the budget is transparently expensed wihtout corruption, our soldiers will surely have a very high salary, equipped with up-t0-dated technological equipments, weapon and sufficient day-to-day supply. Furthermore, if our soldiers are really cared by and deserve the respect from the current leader, they will live like a soldier but not like a beggar who depends his survial on alm.
Actually, I really feel sad to read or hear such a news. I mean our solidiers are cheated again and again by the current leader- Hun Sen. As we know Hun Sen keeps saying that he pities on our soldiers, but in fact he never cares for their well-being and life.
It is heart-breaking to see our soldiers go out to fight against the siamese invasion walking with their bare feet, torn clothes, no proper miliary uniform, food , medicine and all other needed supplies. Sadly, we see no sign of help from the Ministry of National Defense and even Hun Sen as leader.
With this, in stead of helping our soldiers through the administrative system, Hun Sen and his cronies take a chance to beg money from the poor Cambodians in the country and even Cambodian oversea for help to the soldiers and they even try to manipulate the issues and show off their personal generosity through the politics of demagogue. And suprisingly, we have seen that all the high ranking officials from the Ministry of National Defense and others minsitries who went down to give personal donations or alm to our poor soldiers are surounded by dozens of personal bodyguards and mordern, expansive vehicles. I just wonder how do these officials earn the money and become so rich?
Now it´s enough and please stop cheating our sacrificing soldiers. Bun Rany please just do your job by helping the people who have suffered by flood, the poor who have no rice to eat and the evicted people who are in need right now.
To Hun Sen, please open your eye and open your ears and listen to us. If you are really a strong and clean leader as you always boasts, please help our soldiers, investigate the budget allocated for the National Defense Ministry right now to see where the money has gone and how it is expensed. And then punish the criminal before the real justice. Do it and prove it to us that you are a man and a true leader, but not just a scarecrow leader.
To Soy Sopheap, you are Hun Sen´s advisor, please help remind him about my request and help him improve his leadership for all. Please do it!

Spokesman calls Deum Ampil and Kampuchea Thmey reports a 'trick' to undermine the unity and message of factory workers.
A representative for several thousand workers from the Sky High garment factory in the capital's Dangkor district said Sunday that demonstrators protesting earlier this month against low wages and poor working conditions did not target the head of a Cambodian trade union, as local press reports last week suggested.
Chan Dary, 29, a representative for workers at Sky High, said Sunday that reports published in two Khmer-language dailies - Deum Ampil and Kampuchea Thmey - incorrectly stated that workers had filed complaints against Yun Rithy, head of the Khmer Youth Federation of Trade Unions, for inciting them to protest.
"We have never complained about Yun Rithy. This is a fairy tale spread by the owner of the [Sky High] factory to defame us and to deter influential people, NGOs or other organisations from assisting us," Chan Dary said.
Thousands protest
Workers are protesting against the factory, not Yun Rithy, Chan Dary said.
"We want the factory owner to agree to our conditions, which we feel are not difficult to implement. But they don't want to give in, so they they try instead to make us suffer," he said.
Sky High workers began their protest on August 24, with several hundred workers assembling in front of the factory. Last week, the number of protesters reached into the thousands.
Yun Rithy said Sunday he had no direct involvement with the protests and rejected claims that he influenced anyone to demonstrate.
"I don't know anything about it, and I have incited no one to do anything," he said. "I have only tried to help workers because we are an organisation that supports labour rights and benefits for workers, and in this I have done nothing wrong."
"These problems I cannot solve on my own. I can just investigate and urge [factory owners] to respect the labour law," he said.
Getting the story wrong
Keo Sarum, 27, a worker at Sky High, said local newspaper reports got the story wrong about
the protests.
"We did not collect thumbprints for a complaint against Yun Rithy, as the newspapers said. This was a trick by the factory owner in an attempt to divide the workers," Keo Sarum said.
"I would like to ask the publishers of [Deum Ampil and Kampuchea Thmey] where they got their information. Before they write something about us, they should come talk to us," She said.

Ministry of Information approved a licence for Mr. Soy Sopheap to open a radio station, but rejected the same application from the Sam Rainsy Party

Mr. Soy Sopheap (pictured), publisher of Deum Ampil newspaper and an anchorman for CTN TV, has been given a licence by the Ministry of Information to open a radio station, reports Radio Free Asia.
Mr. Soy Sopheap said that his radio, to be called Radio Deum Ampil, will serve the Cambodian nation and the Khmer people. He said: "We will be focusing on social issues and issues affecting our future. The role of our radio is to pay attention to all angles of the issues for the interests of our nation. What I think is that we must know ourselves first. When we know ourselves, we will know the values of our nation."
He added that his radio will not serve any political interests. He said: "The first Khmer newspaper was founded on 19th December, 1936. As a Khmer son and as a younger generation, I want to uphold the original aims of the birth of that newspaper. What I want to say is that we will not accept financial supports from foreigners or any political parties. These money (to fund the radio) come from our savings."
Mr. Son Chhay, MP from the opposition Sam Rainsy Party (SRP), said that the government has not been fair in giving licences to people to operate radio stations. He said the SRP had previously applied for a licence to operate a radio station but was rejected. Later, a member of the party applied for a licence to open a private radio station but was rejected on the grounds that there is no more frequency available.
Mr. Son Chhay added that it is unfair that the Ministry of Information approved a radio licence for a known supporter of the ruling Cambodian People's Party (CPP) when it rejected the same application from an opposition party. He said: "What is more important than this is that the Ministry (of Information) did not respect its previous words that there is no frequency available. But this time it provided someone with a licence, so it means that the ministry has lied and this will no doubt damage the reputation of the Ministry."
Mr. Son Chhay said that the Cambodian government is a government for all Khmer people, therefore it should approve a radio licence to all Khmers equally, but to just give licences to supporters of the ruling CPP only is very biased indeed.
When contacted on telephone by Radio Free Asia, Minister of Information Khieu Kanharith refused to make any comments by saying only that he is busy.

Thai soldiers arrested 135 Cambodians at the border areas

135 Cambodians had been arrested by 30 Thai soldiers on the Banteay Meanchey-Sakeo border areas, reports Deum Ampil newspaper.
Deum Ampil quoted Thai Asean News Network as saying that the 56 men, 50 women, 12 boys and 12 girls had been arrested on 12th May in an area on the Banteay Meanchey-Sakeo borders.
The arrests took place when the Thai villagers reported to the Thai authority that those Cambodians had illegally entered Thailand and had damaged their rice and potato crops.

Deum Ampil reported that, after the arrests, the Thai authority contacted the Cambodian authority to take back those illegal workers through mutual agreements between the two countries.

Mrs Mu Sochua agrees to stay in jail if she loses lawsuit against Mr. Hun Sen

Mrs. Mu Sochua (pictured), who had sued Prime Minister Hun Sen for defamation, said that she is not scared of a counter-suit from Prime Minister Hun Sen, reports Deum Ampil.
Early last week, Mr. Mu Sochua had indicated she would lodge a lawsuit against Mr. Hun Sen in the Phnom Penh Court for defamation related to his speech against her in Kampot a few weeks previously. Mrs. Mu Sochua considers the speech to be offensive, insulting and defamatory against her because she is the only female MP from Kampot.
Mr. Hun Sen was referring to Mr. Mu Sochua's altercation with an army general who was a member of Mr. Hun Sen's party during an election campaign in 2008. During the altercation, Mr. Mu Sochua had lost a button from her blouse. Mr. Mu Sochua said that during the altercation, the general had twisted her hand which caused the button of her blouse to loosen showing her bra. She sued the general for misdemeanor, but the case hasn't been resolved yet.
Deum Ampil news had just reported that at 8:30 AM on Monday 27 April 2009, Mrs. Mu Sochua had officially lodged her lawsuit against prime minister Hun Sen in the Phnom Penh Court.

Eight Cambodian villagers went missing while they went to cut trees near the borders with Thailand, reports Deum Ampil newspaper.
Deum Ampil reports that on 21st April, eight Cambodians went to cut trees in the areas located on the borderlines with Thailand in Tropeang Prasath of Ouddor Meanchey province. They have disappeared and failed to return.
Among the eight missing, one was credibly suspected to be shot dead by Thai border guards and the other seven were also suspected to be killed by Thai border guards.

Warrant for the arrest of Chea Sim's advisor for forgery

The First Phnom Penh court has issued an arrest warrant for Mr. Heng Uy Hok, advisor to Senate President Chea Sim (pictured) who is also president of the ruling Cambodian People's Party (CPP), for forging official letters and using fake documents from 2007 to 2008.
The warrant was issued on 12th March by Investigating Judge Chhay Kong for an arrest of 63 year-old Mr. Heng Uy Hok on charges of falsifying official letters and documents. He is also facing charges of conspiracy with Mr. Sor Chung Yun and Sor Chung Te to falsify documents claiming to be partners of Da Moul Il GC Ltd (spelling?).
Da Moul Il Ltd said the above three people did not have any shares in the company, but have falsified the documents claiming to be partners. Now the company has lodged a legal complaint to the Phnom Penh court against the trio.
On 25th June 2008, Judge Din Sothy had issued an arrest warrant for Sor Chung Te, but an arrest warrant for Sor Chung Yun has not been issued yet.
After the arrest warrant, Mr. Heng Uy Hok went into hiding. Currently, it is not sure if he still serves as advisor to the Senate preisdent as he is unable to be contacted for comments.

Heng Samrin's advisor accused of threatening American diplomats with weapon

An opposition MP has accused advisor to National Assembly president Heng Samrin (pictured) of threatening American diplomats with a weapon.
In a letter dated 11th March sent to Mr. Heng Samrin, Mr. Son Chhay, an MP for the opposition Sam Rainsy Party (SRP), has requested him to launch an investigation into an allegation that one of his more than 100 advisors has used a gun to threaten U.S diplomatic staff in February 2009, while they were jogging along the Phnom Penh roads.
The letter alleged that, on 14th February 2009, while the diplomats were jogging near the Ministry of Foreign Affairs, an armed man had threatened them with a gun. The man was later identified as Ob Sophy, an administrative officer in the Ministry of Foreign Affairs who is also an advisor to National Assembly president Heng Samrin.
Mr. Son Chhay cannot confirm whether the allegation was true. However, he appeals to the authority to launch an investigation into this allegation.
Mr. Touch Naroth, Phnom Penh Police Commissioner, told Deum Ampil News on 12th March that the police has launched an investigation and identified the alleged culprit as Ob Sophy. He said: "We have launched an invetigation and found out that he (Mr. Ob Sophy) is head of one of the departments of the Ministry of Foreign Affairs, but we have turned this case to the Ministry of Foreign Affairs to resolve it with the American embassy."
The police Commissioner added: "We have questioned him regarding the allegation and he said that he dropped the gun ( and tried to pick it up). But when we got a complaint from the U.S embassy, we turned the case to the Ministry of Foreign Affairs to resolve it with the American embassy."
Mr. Koy Kuong, spokesman for the Ministry of Foreign Affairs, said that he has not received any information regarding the case, but said that he will launch an investigation into the allegation.

Khmer authority detains a Thai Buddhist monk near Preah Vihear temple

A lone Thai Buddhist monk was arrested and detained by Cambodian authority for illegally entering Cambodia in an attempt to visit Preah Vihear temple and Wat Keo Sekha Kirisvarak pagoda on Friday.
According to sources, the lone Thai monk had travelled by a vehicle from Siem Reap and arrived at Dambon Kor Mouy near Wat Keo Sekha Kirisvarak pagoda at 10 o'clock at night time on Thursday 12th March.
The monk, who cannot speak or understand a word in Khmer, refused to answer any questions.
A Khmer official said that, this monk had entered Cambodia illegally on 3rd March through Boeng Trakuon border pass, travelled to Siem Reap and stayed there for a few days before arriving in Preah Vihear on Thursday night, the 12th of March.
The Cambodian authority detained him temporarily while reporting the case to the government.
At the same time, a Unesco official from Paris, Mr. Olabiyi Babalola Joseph Yai, president of executive council of UNESCO, has visited the Preah Vihear temple, which is the first visit by a senior official from Unesco.
On 13th July, 2008, three Thai Buddhist monks jumped over the border fence and crossed into Cambodia illegally and were detained by Cambodian border police. And on 15th July, Thai troops were sent to retrieve the arrested monks and hundreds more Thai troops were sent in afterward to occupy the temple areas which sparked border disputes until today.

60 police officers to be appointed as major-generals and brigadier-generals

According to sources, at least 100 police majors, colonels and brigadier-generals are nominated to be appointed as colonels, brigadier-generals and major-generals.
The sources said that 20 brigadier-generals will be appointed as major-generals, 42 colonels will be appointed as brigadier-generals and 34 majors will be appointed as colonels.
The list of the promotions had already been prepared awaiting for a sub-decree and a royal decree to be officially signed.
Two former police officials, Mr. Ney Chary and Mr. Tham San, who have resigned from the police force to take up positions of deputy governors of Kandal and Koh Kong respectively, will be appointed as brigadier-general and major-general respectively.

One Thai soldier arrested for illegally entering Cambodian territories

A Cambodian military source said that one Thai soldier was arrested on 27th February near the Khmer-Thai border in Anlong Veng for illegally entering Cambodian territories, reported Deum Ampil News.
Deum Ampil News reported that the lone soldier has explosives wrapped around his body and he also carried a map.
The source said that the lone soldier was arrested at a Cambodian military camp near the O'Kra-Nhoung frontline about 1 kilometre from Choam Sra-Ngam Checkpoint on the top of Dangrek Mountain.
The Deum Ampil News reported that, while the Cambodian soldiers were quietly guarding the border frontline, they suddenly saw a lone Thai soldier carrying a backpack walking through the bush towards the Cambodian frontline which make them very suspicious. Immediately, the Cambodian guards went to question him on the spot. But upon seeing the Cambodian guards, the lone Thai soldiers tried to run into the bush but was chased and arrested by the Cambodian soldiers at 5:30 in the afternoon.
After he was arrested, the Cambodian soldiers body-searched him and found many explosives in his backpack. Among the explosives found were eleven 69-type land mines, one bomb trigger and a pistol.
After questioning him, the Cambodia soldiers assumed that this lone Thai soldier brought the mines into Cambodian territories with the intention of laying them on Cambodian soil to cause injuries to the Cambodian soldiers. By 28th February, this Thai soldier has not been released yet as they were waiting to question him further and waiting for an intervention from the Thai side.
The arrest of this lone Thai soldier happened two days after 4 Thai soldiers were arrersted by the Cambodian soldiers for illegally entering Cambodian territories. The four Thai soldiers were subsequently released after the Thai side made a request.
A few months ago, Thailand had lodged a formal complaint to the Ottawa Anti-Mine Convention against Cambodia, accusing it of continuing to lay land-mines which have injured a few Thai soldiers when they crossed into Khmer territories. But the Cambodian side had always maintained that "the land-mines that the Thai soldiers stepped on were old land-mines left behind by the civil war between the Khmer Rouge faction and the Phnom Penh government during the 1980s." They added that those land-mines were not newly-planted.
