Why does the government just care about the company, and not about their villagers?
Mondulkiri province - A combined force of police, soldiers and military police last night set a deadline of 8am this morning for villagers in Mondulkiri province’s tiny Rayum commune to leave their homes or face forcible eviction.

Authorities, who have surrounded the village for a week, say the villagers’ homes sit on land belonging to a Vietnamese rubber company, and that any homes still standing this morning will be demolished. Joint forces burned more than 50 homes on Tuesday and Wednesday, and today’s ultimatum has many villagers fearing for their safety, residents say.

Tha, 27, who declined to give his family name for fear of retribution, said that eviction forces tore down a number of homes yesterday, as authorities searched for three wanted village representatives that they accuse of instigating confrontation.

Mu Sochua calls out Aussie mining firms

Opposition parliamentarian Mu Sochua has taken aim at Australian mining companies eyeing the Kingdom’s resources, travelling to their home soil to lobby the halls of power.

Mu Sochua cited fears that Australian companies awarded exploration concessions in Ratanakkiri and Mondulkiri provinces will treat ethnic minorities there with the same disregard they had shown to their own country’s indigenous groups.

I cannot be in Australia and not speak about mining companies that are part of the devastation of Mondulkiri,” she said in an email yesterday.

Cambodia's King, PM Make First Trip On Bus To Far Eastern Province

PHNOM PENH, Jan 10 (Bernama) -- Cambodia's King Norodom Sihamoni, Prime Minister Hun Sen and other cabinet members are making their first trip together on a bus to far eastern province of Mondulkiri near Vietnam border, Xinhua news agency reported.

Sry Thammarong, minister attached to the prime minister, said on Tuesday that Prime Minister Hun Sen is accompanying King Norodom Sihamoni and are joined by other cabinet members in a visit to Mondulkiri province, some 520 km east of Phnom Penh.

He said the two-day trip"is intended to see the real lives of people living in remote provinces and to inspect the rural development especially infrastructure as well as distributing some gifts to villagers".

Indigenous families’ 6-year title wait ends

After nearly six years of fighting bureaucratic red tape, three indigenous communities on Wednesday became the first to receive communal land titles, more than a decade after the passage of laws making such ownership possible.

Three indigenous villages, comprising 329 families, in Ratanakkiri and Mondulkiri province are the first communities in the Kingdom to receive communal land title under the much-applauded, but poorly implemented, 2001 Land Law.

“Indigenous representatives attended a ceremony chaired by the minister of land management in Ratanakkiri on Wednesday,” the ILO’s Sek Sophorn said.

“They are so happy the title grant will enable them to maintain their land and culture.”

Judge beaten, left lying on road in Mondulkiri

Seven men severely beat a judge in a vicious attack at a restaurant in Mondulkiri province on Sunday, before dragging him into a car, driving him 10 kilometres and dumping him on the side of a road, a court official said yesterday.

Ya Narin, president of Mondulkiri Provincial Court, said Meng Tony was recovering in hospital with serious head and face injuries.

The humans rights group Adhoc said witnesses told them the attackers had guns and suspected them of being illegal loggers and the sons of high-ranking officials.

Ya Narin said a group of men attacked the judge while he was enjoying a drink at the invitation of friends at Angkor Forest Restaurant and Guesthouse in Sen Monorom Town.

Mondulkiri: A provincial judge was beat up by a group of powerful and influential people and he was thrown into a car that sped away. The case created quite a surprise in the middle in Mondulkiri city as such situation never happened in the past. The incident took place at 4PM on 04 December 2011 at the Angkor Forest restaurant located in Trom village, Monorom commune, Sen Monorom city, Mondulkiri province. Meng Tony was the judge who was beat up and he was recently transferred there from Phnom Penh. Prior to the incident, the judge and several of provincial officials went to eat and drink at the restaurant above. Then the party which created the incident also went in to the restaurant also. At 4PM, both parties became drunk and the party that created the incident pulled out a hand gun, pointed it at the judge, then beat up him severely. Meanwhile nobody dare intervene at all. After the judge was beat up and injured, he was taken to a car that sped away. The witnesses called the cops, but it appeared that the cops knew the identity of the culprits, that’s why they did not care much about the case. During the trip to Phnom Penh, the judge was able to jump out of the car. Up to now, nobody dare indicate the identity of the culprits and up to now, it is not known if the victim, the judge, filed a complaint in the case yet.

China firm plans bauxite processing plant in Kratie [-Another involvement by the shady Herdos Hongjun Co.]

China's Erdos Hongjun planned to build a bauxite processing plant in Kratie province as part of the company’s US$1.5 billion venture in the Kingdom’s northeast, provincial officials said yesterday.

The plant would serve Erdos’s mine in neighbouring Mondulkiri, an exploration licence for which was granted by the Ministry of Industry, Mines and Energy, according to a list of mining companies operating in the province obtained by the Post.

Kong Pisith, director of the Ministry of Industry, Mines and Energy’s Mondulkiri office, confirmed yesterday that Cambodia International Investment Development Erdos Hongjun Aluminum Company had set up an office in the province last year and was exploring a 360-square-kilometre bauxite concession.

The impact of rubber plantations by Socfin-KCD on indigenous communities in Bousra, Mondulkiri

Socfin-KCD: who is behind the joint venture?

Socfin-KCD is a joint venture registered as a company in Cambodia and owned 80% by Socfinasia and 20%77 by KCD (Khaou Chuly Development). Socfinasia is a holding company created in 1972 and headquartered in Luxembourg. Socfinasia’s main activity is to manage portfolio holdings focused on the exploitation of over 50 000 ha of tropical palm and rubber plantations located in South-East Asia. Socfinasia has 12000 employees and had a turnover of 280 million euros in 2010. 55% of Socfinasia is owned by Socfin (Societé Financière des Caoutchoucs), previously Société Financière Luxembourgeoise (Socfinal).

Socfin is a company created in 1959 and headquartered in Luxembourg. Both Socfin and Socfinasia are listed on the Luxembourg Stock Exchange. Some of the group’s holdings in Africa have been targeted for alleged human rights abuses on plantations. The table below indicates Socfin’s shareholders. Amongst them, Bolloré Group (France) holds 38,75%, in addition to Belgian families Fabri and de Ribes. The Fabri family owns one third of what is referred to as the “Empire Rivaud”, a financial power which owns millions of hectares in plantations in Africa and Asia and which is led by Jean de Beaumont and Edouard de Ribes (the latter being on Socfinasia and Socfin’s boards of directors).

In addition to Socfin SA (53,96%), Bolloré Group (France) holds 21,75% of Socfinasia SA. Other shareholders (24,29% unidentified shareholders) are front companies located in tax havens which would be linked to the Fabri and Ribes families, themselves sitting on the board of Bolloré Group. Listed on the Paris Stock Exchange, Bolloré is a French investment and industrial holding group headquartered in Puteaux, France, and its principal activities are in sectors such as logistics, energy distribution, plantation, and media and communications.

With the exception of Mr. Luc Boedt and Mr. André Balot (on Socfin’s board), Mr. Hubert Fabri, Mr. Vincent Bolloré, Mr. Robert de Tehux de Meylandt et Montjardin (represented by Mr. Cédric de Bailliencourt), Mr. Eoudard de Ribes, and Mr. Philippe de Traux de Wardin all sit on both Socfin’s and Socfinasia’s boards of directors.

In addition, Mr. Hubert Fabri is President of Palmeraies de Mopoli (owning 4,49% of Socfin) and also represent TwoSun Fin Establishment (owning 11, 24% of Socfin) on Socfin’s board of directors. Edouard de Ribes has the authority to represent Geselfina (owning 23,05% of Socfin) as well as holdings and companies pertaining to Bolloré’s group on Socfin’s board.

In 2010, Socfinasia realized a net profit of 137,28 million euros (on a turnover of 280 million euros).

Due to the complex and multi-layered structure of holding companies owning 80% of Socfin-KCD’s joint venture, it is difficult to assess the degree of control exercised by Bolloré’s group on Socfin-KCD. However, available information tend to confirm that the company is exercising significant operational (Vincent Bolloré, Chief Executive Officer of Bolloré Group sits on both Socfin and Socfinasia’s boards) and financial control over the joint venture (Bolloré’s group directly detain 21,75% of Socfinasia and owns 54% of Socfin, in turn detained at nearly 40% by Bolloré’s group. See table above on the shareholders’ structure).

Khaou Chuly Group is registered in Cambodia and is said to be the largest Cambodian construction company. Founded in 1955, Khaou Chuly Company was, after the Khmer Rouges regime, rebuilt after the Khmer Rouges regime under the name of Khaou Chuly MKK, in partnership with the Japanese company MAEDA. According to the company’s website, “many of the company’s current projects are internationally funded by overseas agencies including the EU, Japan International Cooperation Agency (JICA), SCA, US Agency for International Development (USAID), Australian Agency for International Development (AusAID), etc.” The activities of the group include construction (engineering, buildings and public work, schools, universities, railways, dams, airports..), holdings (in agribusiness, consulting strategy, building materials, cement factory and fashion and accessories through Dhammarangsi Holding), surveillance services and pool construction and maintenance (with French company Piscines Desjoyaux). Mr. Khaou Chuly, a Sino-Cambodian tycoon, is the Chairman of Khaou Chuly Group and also a private adviser to Prime Minister Hun Sen. His son, Khaou Phallaboth is co-founder and President of the Group. Khaou Phallaboth and his relatives maintain close relationships with governmental figures. Khaou Phallaboth is also the former son-in-law of Chea Xim, brother-in-law of CPP minister Sun Chanthol.

In 2007, Khaou Chuly Group and Socfin announced a joint venture representing US$20 million. In February 2009, the operational management was transferred from KCD to Socfin. This was confirmed by the mission team during its mission.

Illegal mining is sprouting like mushrooms

Synopsis: Several mining operations are taking place in Mondulkiri under the supervision of Chinese technicians and workers. Some of these mines have been in operation in the past 6 years. However, it is unclear whether these operations are legal or not. Officials from the ministry of mining and energy indicated that more than 120 exploration licenses were issued, however, only 2 to 3 companies are allow to start the mining operation. Therefore, it appears that companies who hold exploration licenses continue to use them to continue their illegal mining operation. Currently, Chinese companies are mining for gold and platinum in Chikreng district, Siem Reap province. Villagers in the mining areas were evicted from their homes and fields. Mining operations are usually accompanied by a drop on the quality of life due to pollution of soil, water and forests.

Son Chhay asks govt to end companies’ land-grabbing against minority

Summary: SRP MP Son Chhay asked the govt to stop private companies from grabbing land owned by Cambodian ethnic minorities, he also asked for an end to land concessions and the return of these lands to the govt.

The companies involved in the land-grabbing are: Heng Development, Heng Brother, Hun Veasna Investment, Chang Ly and Try Pheap.

Pav Homphan, the Ratanakiri [CPP] provincial governor, rejected Son Chhay’s claim and he said that the companies do not violate the villagers’ land.

Adhoc provincial officials said that land concession granted by the govt affect rice fields and farmlands belonging to villagers because govt officials close their eyes to the violations.

Pen Bonna of Adhoc added: “If they [villagers] were not affected, they will not protest. We have seen that in all land concessions, there were protests.”

Dy Chivoandara, a representative of the violating Try Pheap companies, denied these violations.

Navuth of Veasna Investment denied his company’s violations but said that after the lands were transferred to a Viet company, the latter could have perpetrated the violations.

SRP MP Son Chhay and SRP team visiting Mondulkiri


SRP MP Son Chhay (front row) and SRP activist Keo Phirum (standing in the back) took a picture with SRP councilors in Mondulkiri. The photo was taken on August 6 during a workshop on public health conducted by SRP team led by Son Chhay with assistance of Keo Phirum and Seng Mardi in Keo Sema district Mondulkiti province. The workshop is being conducted in 4 northeast provinces to study the health and land-grabbing problems faced by indigenous people such as Punong and Jarai etc.

The team is also working on a video documentary on the loss of indigenous ancestry land to the foreign companies. The video will be shared online sometime soon.
