Sam Rainsy Party member and former deputy commune chief in Kandal province, Meas Peng, was released on bail temporarily on Wednesday.

Peng, who was arrested allegedly without a warrant and then escaped from jail last September, was rearrested in June on his original charges of conspiring to use violence against a property owner.

Kandal Provincial Court investigating judge Lim Sokunthat told the Post yesterday that Peng has been released on bail temporarily because police have yet to prove his guilt in conspiring to use violence.

Peng will remain under control of the court during his bail. He is not allowed to leave the country and must appear at the request of the court, Sokunthat said.

WASHINGTON and PHNOM PENH - With prominent rights worker Chan Soveth summoned to court to face charges related to an ongoing secessionist crackdown, international and local rights advocates say they now fear a major backslide in the country’s civil rights.

Chan Soveth, lead investigator for the rights group Adhoc, has been summoned to appear before Phnom Penh Municipal Court on Aug. 24 and is accused of “providing assistance to the perpetrator” of a crime, which carries a maximum penalty of three years in prison under Cambodia’s criminal code.

Rights officials say the charges are related to the flight of a man named Bun Rotha, who is wanted in connection with a violent land protest in Kratie province in May, when authorities swept into the province’s Chlong district, Kampong Damei commune, forcing nearly 1,000 families to evict and shooting and killing a 14-year-old girl in the process.

Police later said the protest was linked to a secessionist movement in the province, a claim that has not been widely supported, and began making arrests of alleged ringleaders. Among four so far arrested was Beehive Radio owner Mam Sonando, who is accused of leading the movement through his Association of Democrats, a civic organization. He remains in jail awaiting trial, while his radio station, one of the last independent broadcast media outlets in the country, has struggled to continue its programming.

PHNOM PENH - Chan Saveth, a senior investigator for the rights group Adhoc, has received a summons from Phnom Penh Municipal Court to answer questions related to allegations he helped an alleged secessionist leave the country.

He is accused of aiding Bun Rotha, a village activist who helped organize a land protest in Kratie province in May that authorities have claimed was an uprising against the government.

That protest, which led to a violent crackdown by the authorities, and an alleged secessionist movement associated with it have been cited in the detention of Mam Sonando, the owner of Beehive Radio.

Chan Saveth, who is 44, said he appears to have been charged with crimes already, though the specific crimes remain unclear. “Based on the subpoena my wife read to me, it means I have been charged already, on what crime I don’t know,” he told VOA Khmer by phone.

More than 100 villagers protested in front of Banan district hall in Battambang province yesterday, demanding the release of six villagers who were arrested on Wednesday for allegedly accepting money to illegally divide state land.

The six suspects have been accused of advertising land and then defrauding settlers that migrated to the area after Prime Minister Hun Sen announced a nationwide land-titling scheme in June 14.

Hun Ty, the 57-year-old wife of the alleged mastermind of the scheme, Khoeun Sareth, 59, said her husband and the four others were invited to a “meeting” in Banan district on Wednesday that they never came back from.

Council of Ministers legal adviser Meas Sokun and her husband, soldier Kuch Prisovan, were charged and sent for pre-trial detention on Saturday after they were arrested last week for allegedly interfering in the work of youth volunteers sent for land measurement in Stung Treng province, a military official said yesterday.

Sao Sarem, deputy provincial commander of military police, said: “Both were detained (on Saturday) and charged with intimidation and unlawful interference in the performance of public functions.”

He said the charge was based on articles 607 and 609 of Cambodia’s penal code.

Military police in Stung Treng province arrested five government officials yesterday after they forcibly stopped student volunteers from measuring property lines as part of Prime Minister Hun Sen’s national initiative to help settle land disputes.

The volunteers, mostly university students, were measuring land for villagers in conflict with companies that had received economic land concessions in Samaki commune.

A deputy commander with the military police who didn’t want to be named said that five officials from the Ministry of National Defence and the Council of Ministers were arrested. He said some of them had positions as legal advisers to the government.

“The case involves high ranking officials – it is too difficult to find information as authorities are willing to keep information from spreading,” said Hour Sam Ol, an investigator for the rights group Adhoc in Stung Treng.

Children of imprisoned Boeung Kak lake women pleaded for their mothers’ release outside the Ministry of Justice yesterday.

The demonstration, which included more than 200 Boeung Kak residents and activist monk Loun Savath, was held on the eve of International Children’s Day.

It also coincided with more than 100 NGOs writing a letter to the World Bank asking it not to end its suspension of new loans to Cambodia.

Children sang about their mothers, 13 of whom were convicted to two and a half years in prison on May 24 after a three-hour trial, and called for the government to “free the 15”, who also include two who were arrested the day of the trial. All 15 are in Prey Sar prison.

Heng Sreyleak, 13, the daughter of Heng Mom, said the charges were “unjust”.

“All they were doing was protesting for the 12.44 hectares of land promised to them by . . . Hun Sen,” she said.

CAMBODIA: The culture of impunity and violence must stop

A Joint Statement by the Asian Human Rights Commission

Phnom Penh, 30th May 2012- We, Cambodian and International civil society organizations represented in this statement, condemn the use of armed force and escalating violence against citizens peacefully defending their land, labor and natural resources rights. We are referring to not only the events earlier last week on 22nd May, when dozens of peaceful Boeung Kak Lake (BKL) protesters were violently dispersed and two days later when fifteen (fourteen women and one male) BKL residents were sent to Prey Sar prison and charged and convicted of unfounded criminal offenses, but also the recent shooting incidents—the killings of environmental activist Chut Wutty in Koh Kong province and 14-year old girl Heng Chantha in Kratie province, and the shooting of three young women protesting for better working conditions in Svay Rieng province. These incidents are particularly disturbing because they indicate an increasing readiness on the part of security and military forces to use lethal force against civilians.

The year 2012 has already witnessed at least five such instances, not including numerous other human rights abuses. We are deeply concerned, shocked and saddened about this escalation of violence, particularly in disputes related to Economic Land Concessions (ELCs). Pursuant to Article 41 of the Cambodian Constitution and international conventions to which Cambodia is a party, all citizens enjoy a fundamental right to free expression, which includes the right to protect against decisions of public authorities that infringe on their rights and livelihood . In practice, the exercise of this right is all too often denied or met with violent repression.

Cambodian citizens have a right to live under the rule of law. They deserve to be protected, served with dignity and fairness based on universally agreed basic rights. Public authorities not only have a duty and obligation to ensure that a culture of impunity is never condoned but also must make fighting against impunity a priority. All instances involving the use of firearms against civilians should be promptly, thoroughly and impartially investigated. Investigations that find shootings to be “accidental” or the result of low-ranking officers acting on their own initiative should be supported by evidence gathered in a rigorous, transparent manner. At the very least, protection against threats and intimidation should be provided to witnesses and all victims should have access to effective judicial verdict and justice.

ភ្នំពេញៈ គណៈកម្មាធិការ​ប្រព្រឹត្តិកម្ម ដែល​បណ្តុំ​ទៅ​ដោយ​អង្គការ​សមាគម​ចំនួន ២២ អង្គការ​ធ្វើ​ការ​ផ្នែក​សិទ្ធិ​ស្ត្រី និង​សមភាព​យេនឌ័រ​ចំនួន ១៨ ព្រម​ទាំង​បណ្តាញ​សហគមន៍ ចំនួន ៨ បាន​ធ្វើ​ការ​ថ្កោល​ទោស​រដ្ឋាភិបាល ចំពោះ​អ្វី​ដែល​ក្រុម​ធ្វើ​ការ​បម្រើ​សង្គម​ទាំង​នេះ ហៅ​ថា ជា​អំពើ​រំលោភ​សិទ្ធិ​មនុស្ស​យ៉ាង​ធ្ងន់ធ្ងរ ដែល​បាន​ប្រព្រឹត្ត​ដោយ​កង​កម្លាំង​ប្រដាប់​អាវុធ​របស់​រដ្ឋាភិបាល ក្នុង​ការ​បណ្តេញ​ប្រជា​ពលរដ្ឋ​ចេញ​ពី​លំនៅដ្ឋាន ការ​បាញ់​សម្លាប់​មនុស្ស​ក្រៅ​ច្បាប់​ និង​ការ​ប្រើ​អំពើ​ហិង្សា​បង្រ្កាប​បាតុកម្ម​ដោយ​សន្តិវិធី​ ព្រម​ទាំង​ការ​ចាប់​ខ្លួន​ពលរដ្ឋ​រងគ្រោះ ដែល​តវ៉ា​ការពារ​ផ្ទះ​របស់​ខ្លួន​ យក​ទៅ​ដាក់​ពន្ធនាគារ ដូចជា​ករណី​ការ​ចាប់​ស្ត្រី​បឹងកក់​ចំនួន ១៥ នាក់​ដាក់​ពន្ធនាគារ។

នៅ​ក្នុង​លិខិត​ ចេញ​ពី​ម្សិលមិញ គណៈកម្មាធិការ​ប្រព្រឹត្តិកម្ម បាន​កត់​សម្គាល់​ឃើញ​ថា​ ការ​រំលោភ​សិទ្ធិមនុស្ស ដោយ​ការ​បណ្តេញ​ប្រជា​ពលរដ្ឋ​ចេញ​ពី​លំនៅដ្ឋាន​ការ​ប្រើ​អំពើ​ហិង្សា បង្រ្កាប​បាតុកម្ម​ដោយ​សន្តិវិធី និង​ការ​បាញ់​ប្រហារ​ជីវិត​មនុស្ស​ក្រៅ​ច្បាប់ ការ​ចាប់​ពលរដ្ឋ​ការពារ​ដី​ធ្លី​ដាក់​ពន្ធនាគារ​រដ្ឋាភិបាល​ខកខាន​មិន​ បាន​ស៊ើប​អង្កេត​ឲ្យ​បាន​ហ្មត់ចត់​ និង​យុត្តិធម៌​ដល់​ប្រជាពលរដ្ឋ​ឲ្យ​បាន​ពេញ​លេញ​នោះ​ទេ។ នៅ​ក្នុង​លិខិត​បាន​បន្ត​ថា​៖«​គណៈ​កម្មាធិការ​ប្រព្រឹត្តិកម្ម មាន​ការ​ព្រួយ​បារម្ភ​ជុំវិញ​បញ្ហា​ទំនាស់​ដី​ធ្លី ដោយ​រាជរដ្ឋាភិបាល ​បាន​ប្រើប្រាស់​កម្លាំង​ប្រដាប់​អាវុធ​ដើម្បី​ការពារ​ប្រយោជន៍​របស់​ ក្រុម​ហ៊ុន​ជា​ជាង​ការពារ​ប្រជា​ពលរដ្ឋ​ ហើយ​កង​កម្លាំង​ប្រដាប់​អាវុធ​ទាំង​អស់ មិន​បាន​អនុវត្ត​នីតិវិធី​ច្បាប់​ជាធរមាន​ឡើយ រីឯ​ស្ថាប័ន​តុលាការ​បាន​ចោទប្រកាន់ និង​សម្រេច​ផ្តន្ទាទោស​ដាក់​គុក​ប្រជា​ពលរដ្ឋ ដោយ​មិន​បាន​ឈរ​លើ​មូលដ្ឋាន​ច្បាប់​ឡើយ»។

«គ្មាន​ប្រជាពលរដ្ឋ​ណា​ម្នាក់​ដែល​ត្រូវ​ចាប់​ដាក់ពន្ធនាគារ​ដោយសារ​រឿង​ជម្លោះដីធ្លី​ទេ» នេះ​ជា​ប្រសាសន៍​របស់លោក​នាយក​រដ្ឋមន្ត្រី ហ៊ុន សែន ដែល​បាន​ថ្លែង​កាលពីពេល​កន្លងទៅ។ ប្រសាសន៍​នេះ​បានបញ្ជាក់​ច្បាស់​ពី​ឆន្ទៈ​របស់​ប្រមុខ​ដឹកនាំ​រដ្ឋាភិបាល​ដែល​មិន​ចង់ឃើញ​ពលរដ្ឋ​របស់ខ្លួន​ណា​ម្នាក់​មានទុក្ខ​ទោស​ដោយសា​រ​តែ​ជម្លោះដីធ្លី​ឡើយ។

ប៉ុន្តែ ទោះជា​យ៉ាងនេះ​ក្តី ការ​អនុវត្តន៍​​ជាក់ស្តែង​របស់​អាជ្ញាធរ​ និង​តុលាការ​មិន​បាន​ដូច​អ្វី​ដែល​លោក​នាយក​រដ្ឋមន្ត្រី​ថ្លែងនោះ​ឡើយ។

នៅ​គ្រប់​ទិសទី​ដែល​មាន​ទំនាស់​ដីធ្លី​រ៉ាំរ៉ៃ តែង​មាន​ពលរដ្ឋ​កំពុង​ជាប់ពន្ធនាគារ​ដោយសារ​តែ​បញ្ហា​ដីធ្លី។ របាយការណ៍​របស់​សមាគម​ការពារ​សិទ្ធិមនុស្ស​អាដហុក​បាន​បង្ហាញ​ថា មាន​ពលរដ្ឋ៣៣នាក់​កំពុង​ជាប់ពន្ធនាគារ​ដោយសារ​តែ​ជម្លោះដីធ្លី​នៅ​ទូទាំង​ប្រទេស។ ស្ត្រី​អ្នកភូមិ​បឹងកក់១៣នាក់​ដែល​ត្រូវបាន​តុលាការ​រាជធានី​ភ្នំពេញ​ផ្តន្ទាទោស​ឲ្យ​ជាប់ទោស២ឆ្នាំ​ក្នុង​ពន្ធនាគារ​កាលពី​សប្តាហ៍​មុន​គឺ​ជា​ឧទាហរណ៍​ចុង​ក្រោយ​មួយ​សម្រាប់​ករណី​ទំនាស់​ដីធ្លី​នៅ​កម្ពុជា។

Violent land evictions, unlawful prison sentences, shooting deaths and crackdowns on peaceful protests are all on a list of allegations a human rights group is voicing concerns about this week.

The Cambodian Human Rights Action Committee condemned the incidents in a statement released on Tuesday, calling on the government to conduct investigations and asking that protests aren’t met with force.

“The committee has concerns over land disputes, as the government uses armed forces to protect private interests rather than that of the villagers. We would like to appeal to the government to stop using violence to quell peaceful demonstrations,” the statement reads.

CHRAC specifically condemned what it said were armed forces defending the interests of companies without implementing effective legal procedures.
