CACJE Statement of Rally Protest for October 23, 1991 - 2010

STATEMENT FOR RALLY PROTEST
On Paris Peace Agreement October 23, 1991 -2010

October 23rd, 2010 is the 19th anniversary of Paris Peace Agreement on Cambodia (PPA) signed by 18 countries to end the conflicts between four warring Cambodian Parties in order to establish a lasting and true peace for Cambodian people and establish democracy and protect Cambodia territorial integrity.

The three main objectives of Paris Peace Agreement of 23rd October 1991 are:
  1. Supervise and monitor and enforce the full withdrawal of all foreign armed forces (Vietnam) from Cambodia in order to warranty Cambodia sovereignty and territorial integrity. Thereby, PPA prohibited foreign countries to encroach Cambodia territory and ingest in Cambodia domestic affairs.
  2. Organize and supervise elections to insure and establish democracy, and respect human rights and enhance Cambodia legal institution.
  3. Provide aids for Cambodian economic development.

According to the letter and the spirit of PPA of 23rd October 1991
  • Cambodian government which was elected by free and fair elections should cancel any treaty, any agreement which were against national interests, Cambodia sovereignty and territorial integrity and the unity of Cambodia (Chapter 1).
  • The Socialist Republic of Vietnam signatory of the PPA, thereby, was abided consequently by the PPA to respect Cambodia sovereignty and territorial integrity, hence, was prohibited to encroach Cambodia territory. (Chapter 2)
  • Cambodia government which is elected by free and fair elections must respect human rights and establish democracy and empower and enhance legal institution and freedom which were the basis of any democracy. (Chapter 3).

This year, we celebrate the 19th anniversary of PPA. During these last 19 years, the PPA of 23rd October, 1991 was irremovable, buried and put to death by Hanoi government and puppet government of Phnom Penh with the connivance of former Cambodian nationalist resistance on the borders. Their aim was simply to destroy Cambodia, her people and annihilate Khmer nation.

Not only the treaties between Vietnam and Cambodia of 1979, 1981, 1982, 1985 were not voided according to spirit of PPA, the puppet Phnom Penh government and the silly king of Cambodia aggravated the situation even more by signing the 2005 treaty recognizing all the unjust and ignominy precedent treaties with Vietnam for more twenty years and allowing by this the immigration of million Vietnamese to Cambodia. The massive Vietnamese immigration of several million aims emptying Cambodian countryside, villages and fields by killing their owners in order to grab their land, belonging, houses, cattle and fields.

For us abiding by the law, we, the people of Cambodia, are peace, freedom and democracy lovers, want to establish Cambodia sovereignty and genuine democracy. We, the people of Cambodia, proclaims solemnly that October 23, 1991 must be recognized officially as the Day of Cambodia Unity, the Day of Unity of all Khmer, all political parties, and all political movements. And the January 7, 1979 was the day we lived in infamy, the day where People Army of Vietnam had enslaved Cambodia since then until now. Therefore January 7 should be officially recognized as the day of infamy, the day where Vietnam was annexing Cambodia as slave.

The puppet government of Phnom Penh with the connivance of a group of political leaders without political will persevered to forget and be forgotten and put to death the PPA during these last 19 years. But the people of Cambodia which is the source of all power and the master of Cambodia reject categorically all attempts, all decision of puppet Phnom Penh government which are against the spirit of PPA of 23rd October 1991.

During these last 19 years, just after the signature of the PPA, Cambodia continued to be victim of the aggression, and violation of sovereignty and territorial integrity from the Socialist Republic of Vietnam (SRV), the Kingdom of Thailand and the Laos People’s Democratic Republic. All these three countries had encroached Cambodia territory. Especially, SRV Army continued to occupy Cambodia, thereby, put Cambodia under their thumb. Then, a shadow Hanoi government was set up. It is this shadow Hanoi government which is the real master of Cambodia which run Cambodia, dictate all Cambodian political decision, diplomacy, national security, defense, economy and finance. Even more, the Cambodian People Party (CPP) which holds the power through Phnom Penh government is a communist party. The authoritarian CPP is well known for its extreme abuses of human rights, grabbing people land and thwarting freedom of speech.

The people of Cambodia are the source of all power. The People Power is independent, hence, does not represent neither political party nor political leader. The People Power is a rally of nationalist leadership who knew so well political trick of our neighboring countries which were aggressing and violating flagrantly Cambodia sovereignty, and territorial integrity, is united to take action now:
  • Urge Mr. General Secretary of the United Nations to summon all the 18 signatories to reactivate the Paris Peace Agreement of October 23rd, 1991 on Cambodia in order to fully implement that Agreement.
  • Urge the signatories, especially the Socialist Republic of Vietnam, the Kingdom of Thailand and Lao People’s Democratic Republic to respect Cambodia sovereignty, independence, and territorial integrity as it was stated by the PPA. Indeed, according to the PPA, Vietnam, Thailand and Laos must not encroach Cambodia territory.
  • Urge Phnom Penh government to void any treaty, any agreement which were against Cambodia national interests, sovereignty, territorial integrity and unity and (PPA Chapter 3) urge Phnom Penh government to respect human rights and establish democracy and enhance legal institutions and freedom which were the foundation of any democracy.
  • Urge international community and especially the 18 signatories of the Paris Peace Agreement to take immediate action in order to establish a lasting peace and freedom and genuine democracy for Cambodia as it was stated by the PPA.

We, the People of Cambodia, hope that the official visit to Cambodia of Mr. General Secretary of the United Nations, Ban Ki-Moon, October 27-28, 2010 will bring political change in Cambodia and especially have confidence that Mr. General Secretary will put strong pressure on Phnom Penh government and the Socialist Republic of Vietnam, the Kingdom of Thailand and Lao People’s Democratic Republic to respect and integrally implement the Paris Peace Agreement of 23rd October, 1991.

CACJE Opposition Statement

The Cambodian Action Committee for Justice & Equity (CACJE) is:
  1. Opposed to the visit of former King Norodom Sihanouk – who will be accompanied by his family including his wife and son Norodom Sihamoni, the current king – to Vietnam on 22 June 2010.
  2. Opposed to the question raised by Son Soubert, the former member of Constitutional Council, who planned to have a joint administration by the Yuon and Khmer governments on the sovereignty of the territory of Koh Tral Island which belongs to Cambodia, as well as the territory of Kampuchea Krom belonging to Cambodia, based on the model of the Pyrenees region in the European Union which is placed under the joint administration of France and Spain since 1607 under an agreement between the French Emperor and leaders of the Spain movement.
  3. Absolutely opposed to the plan set by Touch Narim, the Kampong Chhnang provincial governor, who wrote a letter to ask the authorization from the Vietnamese embassy in Phnom Penh in which he promised to provide lands to 4,000 illegal Vietnamese immigrant families and to provide $10,000 to each Vietnamese family that agree to move out of the Chhnok Trou region in Kampong Chhnang to housings in the land area.

CACJE Declaration regarding the lifting of opposition leader Sam Rainsy's immunity

DECLARATION

“The lift of parliamentary immunity of Mr. Sam Raingsy, the leader of opposition Party is intended to threat and silence all democrats and is an act of slave of Hanoi.”

The Cambodian Action Committee for Justice & Equity (CACJE) solemnly condemns the Cambodian National Assembly which is neither more than a Vietnamese puppet Assembly of ghosts and pirates for their lift of parliamentary immunity of Mr. Sam Raingsy, the leader of the opposition Party.

This shameless act of the Vietnamese puppet regime of Phnom Penh violates the rights of the representative who was elected by Cambodian people.

This is not the first time that the Vietnamese puppet government of Phnom Penh used the armed forces, the judiciary power, and the Vietnamese puppet Assembly to silence, threat and punish nationalist democrats who dared to oppose Vietnam violation of territorial integrity and sovereignty of Cambodia.

According to the Cambodian constitution, the Vietnamese puppet government of Phnom Penh can neither to sue Mr. Sam Raingsy nor to lift his parliamentary immunity. Because as representative elected by Cambodian people, Mr. Sam Raingsy disposes all rights to carry all activities to defend and protect the territorial integrity and sovereignty of Cambodia against foreign and domestic enemy who sell our country.

CACJE notes that the reaction of Hanoi by dictating the Vietnamese puppet government of Phnom Penh to sue Mr. Sam Raingsy in court and the Vietnamese puppet Assembly to lift the parliamentary immunity of Sam Raingsy were the proof of the flagrant violation of Paris Peace Agreement of October 23, 1991 by Vietnam and such an agreement was well signed by Vietnam. Furthermore, through this lift of Sam Raingsy parliamentary immunity, Hanoi arrogantly proves Vietnam is swallowing Cambodia.

Therefore, CACJE appeals to all Cambodian People inside and abroad, all leaders, all representatives of the opposition parties to unify in order to form a government in exile, urge the Co-Presidents, and the signatory countries of the Agreement to fully implement the Paris Peace Agreement on Cambodia, October 23, 1991 and sue the neighboring countries of Cambodia such Republic Socialist of Vietnam in foreign courts for grabbing land and water of Cambodia.

CACJE's Sourn Serey Ratha disagrees with Sam Rainsy's characterization of 18 March 1970 ... what do you think?

Declaration

"October 23, 1991 was the second Independence Day of Cambodia and March 18, 1970 was the Liberty Day of Cambodian People".

The Cambodian Action Committee for Justice & Equity (CACJE) solemnly condemned the smear campaign of Hanoi and communist puppets who intended to induce Cambodian people in error about the truthful meaning of the events of October 23, 1991 and March 18, 1970.

CACJE categorically denounces Mr. Sam Raingsy, President of the Sam Raingsy Party (SRP) for having baselessly criticized the event of March 18, 1970. Mr. Sam Raingsy said, March 18, 1970 was the day where Khmer people started the civil war and the Khmer Rouge regime of killing field. Mr. Sam Raingsy intended not only to mislead the true meaning of that historic Day of March 18, 1970, but also shows his kowtow to Vietnamese puppets in power in Phnom Penh, under the authoritarian ruler Hun Sen.

CACJE solemnly reaffirms that April 17, 1975 was the day where the Khmer Vietminh and Vietnamese communists under Vietnamese communist leadership started their genocide against Cambodian people and the killing field of Khmer Rouge regime. Therefore, October 23, 1991 was the second Independence Day for Cambodia where the international community obliged the Socialist Republic of Vietnam to withdraw all their Armed Forces from Cambodia.

As for March 18, 1970 was the historic day where the Cambodian people kicked out the monarchy and feudality and replaced it by freedom as the coup of Ta Trasak Paem had put an end to the bloodline of Varam 680 years ago, in 1290.

CACJE remarked, the critic of Sam Raingsy about the event of March 18, 1970 that toppled Samdech Norodom Sihanouk from power was in the same vein of Mr. Hun Sen. Sam Raingsy used the same meaning and the same wording as Hun Sen. This proved that Sam Raingsy, Hun Sen and Norodom Sihanouk were from the same political group which hide the truth to Cambodian people and were soft and accomplices with Vietnamese puppets and royal feudality. Cambodian people and nationalists who had supported financially and by bulletin vote for Sam Raingsy should not trust him anymore.
