The US cannot press Cambodia for the return of opposition party leader Sam Rainsy, Council of Ministers Press and Quick Reaction Unit deputy president Keo Remy said at a snap press conference yesterday morning.
Former Sam Rainsy Party member Remy, who is now a secretary of state in the ruling Cambodian People’s Party, criticised the attempts of the trio at the head of the new opposition party to persuade US Congressional and State Department officials to assist in Rainsy’s return for the 2013 election.
“Cambodia is an independent state, not a subordinate country of any country. I regret some leaders have a manner as a puppet,” Remy said. “I can say that there is nothing that can put pressure on Cambodia.
“Related to politicians, the [CPP] led by Samdech Techo [Hun Sen] has always compromised many times since the time of Funcinpec.

Foreigners working at the Khmer Rouge tribunal were responsible for embroiling the court in chaos that was akin to incitement, government officials said yesterday at a snap news conference.
Press and Quick Reaction Unit deputy president Keo Remy called the conference to attack criticisms of alleged public statements by Prime Minister Hun Sen about the guilt of one of the tribunal’s three elderly accused, who are being tried for crimes against humanity and war crimes.
“There is nothing wrong in expressing that Nuon Chea is a killer and was involved in genocide during the Pol Pot regime,” Keo Remy told about 10 journalists.
“[Nuon Chea defence lawyer Michiel Pestman] is taking the opportunity to bring in political issues at the KR tribunal to cause chaos,” he said, adding: “I found that the chaos was always made by some foreigners [at the tribunal].

Today, approximately ten former Sam Rainsy Party (SRP) members who loudly defected to the Human Rights Party (HRP) in 2011, announced their decision to finally join the Cambodian People’s Party (CPP). There are commune and district councilors and a former senator among them: Vann Sivoeun, Morn Yeang, Prak Vandy, Om Phosda, Lon Sokthai, Chea Bun Ngak, Boeun Sokha, Horn Ravy.
Before them, two more prominent professional defectors looking for personal benefits had followed the same political itinerary (from SRP to HRP to CPP): Kem Sokhon (a brother of HRP president Kem Sokha) and Keo Remy (a former Funcinpec then SRP National Assembly member and now an adviser to CPP Prime minister Hun Sen).
Before the January 29 senatorial elections, many HRP representatives had reportedly tried to entice SRP commune councilors to vote for the CPP.

As they did a few years ago with Prince Norodom Ranariddh when he was having an extramarital affair before his divorce from Princess Eng Marie Ranariddh, the CPP plans to have somebody sue Kem Sokha on the basis of the 2006 law on monogamy. Referring to articles 7 and 10 of the law, a judge can send Kem Sokha to prison for a period from one month to one year and to make him pay a fine from 200,000 to 1,000,000 Riels.
Following various wrongdoings, General Nhiek Bun Chhay and other Funcinpec leaders are also being blackmailed by the CPP into openly or secretly serving Hun Sen’s party.

At the end, the Cambodian Supreme Council of Magistracy (SMC) refused to nominate Judge Laurent Kasper-Ansermet as the International Co-Investigating Judge as was requested by the UN. This refusal led to a verbal clash between the UN and the Cambodian government whereby, the UN Secretary-general accused Cambodia of breaching its agreement, meanwhile a Cambodian official scolded the UN of issuing wrong comments that will affect discussions between the two sides on Tuesday. This is a new tension for the KR Tribunal.
The UN reported that the Cambodian government officially informed the UN on Thursday that the SMC decided not nominate Judge Laurent Kasper-Ansermet as the International Co-Investigating Judge as requested by the UN. This decision was based on the alleged judge’s ethics violation. Martin Nesirky, spokesman for the UN Secretary-general, declared on Friday that the decision not to nominate Judge Laurent Kasper-Ansermet is a breach of the agreement between the government and the UN signed in 2003. Article 5 of this agreement stipulates that in the case of vacancy for the position of the International Co-Investigating Judge, the person who will be nominated to this position will be the reserved International Co-Investigating Judge. Martin Nesirky still pushes on the Cambodian government to nominate Judge Laurent Kasper-Ansermet.
In reaction to this problem, Keo Remy, the vice-chairman of the Press and Quick Reaction Unit (PQRU) of the Council of Ministers, expressed his regret about the successive comments made by Martin Nesirky. He told RFI today that Martin Nesirky shouldn’t comment too much about this problem ahead of Tuesday’s official meeting. Keo Remy said that Martin Nesirky’s comment is considered as a pressure on Hun Xen’s regime.

The Supreme Council of Magistracy is under no obligation to approve the Khmer Rouge tribunal’s reserve co-investigating judge and will not be forced to make a decision, Council of Ministers’ spokesmen from the Press and Quick Reaction Unit said at a snap press briefing yesterday.
Any media or rights groups reporting that the SCM “must” approve the UN-nominated judge and urgently hold a meeting to give this approval are simply incorrect, Keo Remy, vice-president of PQRU, said.
“I would like to inform that now we have nothing to do besides wait for the decision made by the Supreme Council of Magistracy. We wait to see the result come out from them,” Keo Remy added.

Synopsis: On 16 January 2012, Keo Remy, the secretary of the Council of Sinisters and vice-chairman of the Press and Quick Reaction Unit (PQRU or known more recently a P-sCREW-up), held a press a urgent conference where he stated that Hun Xen was not involved in the nomination of the reserved International Co-Investigating Judge as the Phnom Penh Post reported on 16 Jan 2012. The Post report indicated that Hun Xen was involved in the nomination of Judge Laurent Kasper-Ansermet. Keo Remy added: “I am requesting that the Phnom Penh Post write an apology or publish a correction because, regarding the candidacy of Mr. Laurent Kasper-Ansermet as the International Co-Investigating Judge is not connected with the PM, it is the sole duty of the Supreme Council of Magistracy.”

If Hun Xen is not involved in the nomination of Judge Laurent Kasper-Ansermet, why would he suggest prudent consideration of the judge’s activities?
Therefore, it can be safely concluded that Keo Remy is a LIAR, just like Hun Xen, his boss.

Peace agreement
A government official yesterday criticised opposition politicians and certain NGOs for reportedly accusing the government of not respecting the Paris Peace Agreements, struck in 1991.
Keo Remy, deputy spokesman for the Press and Quick Reaction Unit at the Council of Ministers. said at a press conference in the capital yesterday the government had successfully followed the Paris Peace Agreements of October 23.
“The United Nations just helped for the national election but the Cambodian government finished the civil war in this country,” he said. “We cut off October 23 from the [holiday] calendar because we have a lot of holidays [already].”
On the 20th anniversary of the accords on Sunday, opposition leader Sam Rainsy said via video from Paris that the ruling party did not respect the Paris Peace Agreements.

Cambodia's new anti-corruption unit names first suspect

Cambodia's new Anti-Corruption Unit has named its first suspect, a prosecutor of a provincial court, in what many see as the first test of the much-criticised unit.
Police arrested the official and two of his bodyguards on Monday morning in Pursat province. The exact reasons for his arrest are unclear, but local human rights workers say he's notorious for corruption and for shooting up a restaurant three years ago.

COCHRANE: When Cambodia's Anti-Corruption Unit was formed three months ago, many critics of the government predicted it would be a toothless tiger, a way to be seen as tackling corruption while carefully managing who is targeted.
So when Om Yentieng, the head of the unit and advisor to Prime Minister Hun Sen, personally led police to the house of its first suspect, it was clearly a declaration of intent.
Spokesman for the Unit, Keo Remy, says there has been a positive response to the Unit's first arrest.
REMY: Yeah we got support, more support from the people. From Phnom Penh and in the civil servants, military police and sometime from everywhere they call me and they're very happy. Even in the Office of the Council of Minister they appreciate that.
COCHRANE: This year, Cambodia ranked 154 out of 178 countries on Transparency International's corruption index.
In April, the Government passed an anti-corruption law that had been 15 years in the making and created the Anti-Corruption Unit headed by the Prime Minister's advisor.
The Unit's first case involves Top Chan Sereyvuth, a local court official who's well known to Nget Theavy... the Pursat province coordinator for human rights group ADHOC.
NGET: There are many stories about him. He used to shoot his gun at people, threaten people and conduct illegal business.
COCHRANE: In 2007, the Asian Human Rights Commission reported that a journalist was assaulted by military police after investigating allegations Mr Top had fired five rounds into a restaurant after becoming intoxicated.
Last year, local media reported his involvement in a long-running land dispute that was moved to the Pursat court from another province where Mr Top had previously worked as a judge.
Keo Remy from the Anti-Corruption Unit, didn't say exactly what charges would be used against Top Chan Sereyvuth but he said there were plenty to choose from.
KEO: Sometimes he used his bodyguards and brother in law to be police justice to arrest someone in Pursat province and the other case that involves with corruption case. Most of the people in the province they want to see the judge in the province to punish that guy.
COCHRANE: Son Chhay, an MP from the opposition Sam Rainsy Party, said the case will be a test of the government's resolve on corruption.
SON: To have this guy arrested is quite a surprising thing. We hope that it will be the genuine one, not the political one. The government should not hide any evidence, any information regarding to this particular prosecutor.
COCHRANE: Son Chhay said the opposition had been concerned about the recruitment of staff to the Anti-Corruption Unit, alleging family and friends of senior officials had been hired in a way that didn't bode well for transparency.
But Thun Saray, the head of human rights group ADHOC welcomed the arrests as a good first step.
THUN: In the first instance we cannot do everyone. But this kind of medium fish, we can have some hope the big fish also should be scared to do the corruption acts. And the small fish, they also worry about their safety if the Anti-Corruption committee try to work effectively.

REMY: It's not only one. It's not the first time. There's going to be more.

The government says it now has a five-year strategy to fight corruption that will allow new agencies to punish perpetrators of graft.
The strategy, released by the National Council for Anti-Corruption last week, includes provisions for prevention and punishment, as well as a plan to raise awareness.
The new policy is the result of an anti-corruption law that was passed earlier this year.
“We're using a zero-tolerance principle in our fight against corruption,” said Keo Remy, a spokesman for the anti-corruption body. “This means that there are no exceptions, no matter how big or small a case is.”
Keo Remy said the strategy is built around integrity, accountability and confidentiality, which will encourage public participation.
The in the near-term, officials will began to educate people about the anti-corruption law and the penal code, he said. By early next year, government officials, lawmakers, judges and heads of non-governmental organizations—even security guards for the anti-corruption council—will have to declare their assets.
“Our main goal in doing all of these is to boost our economic growth,” he said. “We want to build confidence among big investors and promote the living conditions of the people.”
Anti-corruption officials have been “carefully recruited,” he said, and can be punished for a range of ethical offenses, including having meals with alleged offenders. Infractions are punishable with up to five years imprisonment, for leaking information to informants.

THE Kingdom’s newly formed Anticorruption Unit is scheduled to release the first report on its progress in combating corruption later this week, after holding meetings today with civil representatives to discuss graft complaints submitted by the public.
Keo Remy, newly appointed spokesman of the National Anticorruption Commission said that the ACU’s president, Om Yentieng, would meet with NGO workers today.
“I don’t know about the topics of discussion, but I think that they may potentially discuss the work that the ACU has done so far, such as a mechanisms for safeguarding individuals who to file a complaint to the ACU,” he said.
He added that following the meeting, the ACU planned to release its first public report, if the NAC is able to finalise the ACU’s most recent internal progress reports. “I think that if the report is approved by the NAC, we will be able to release it on September 28 with the participation of the media,” Keo Remy said.
The Civic Alliance for Social Accountability, a coalition of 11 nongovernmental organisations, confirmed that it planned to meet with graft officials today to submit a compilation of corruption complaints against 80 officials accused of levying illegal road taxes.
San Chey, the Cambodia-based network fellow of the Affiliated Network for Social Accountability in East Asia and Pacific, a regional umbrella group, said that at least 10 members of the coalition would attend the talks in order to seek its full cooperation in fighting against corruption in Cambodia.
“We will discuss with the head of the ACU about the possibility of being a partner of the ACU and submit corruption complaints related to road tax collection filed by Cambodian people in 14 provinces,” he said.
San Chey said that road-tax collection agents had forced people to pay as much as US$1 million in illegal road taxes every year. “We have to be a partner of the ACU in order to make sure that our work will encourage government’s tax agency to change their behaviour,” he said.
