A community forest in Battambang is being snatched up by opportunistic military and police officials seizing on the national land titling scheme as a final chance to secure territory, its longtime custodians and the groups that support them have said.

The 1,335-hectare Prey Trolach commune community forest in Roka Kiri district was established with local officials in 2004 and has since gained national recognition from the Ministry of Agriculture Forestry and Fisheries.

But since July 2, using pesticides to kill grass and bushes which are then burned before trees are felled and bulldozers brought in to finish the job, officials have cleared and grabbed between 150 and 200 hectares of the area, according to two NGOs working in the area.

Nhov Nharn, Director of Ockenden Cambodia, said low-level provincial officials had arrived shortly after Prime Minister Hun Sen announced the land titling scheme on June 14 to meet the Community Forestry Management Committee.

Fighting Corruption at Local level-Vote for Sam Rainsy Party Candidates

Corruption in Cambodia is at all levels. At commune level, over-charging villagers who need the most basic but vital documents such as birth and marriage certificates can cost up to US$20-$25. Even to ask permission to hold a wedding can boost the price up to US$50. For most villagers, this means selling chickens and pigs and even cows in order to get their commune chiefs to provide them with these documents. Officially, a birth certificate is free for the first 30 days. A marriage certificate costs US$1.00.

An anonymous group on Saturday filed a corruption complaint with the Anti-Corruption Unit against senator Sok Kong’s Sokimex company’s management of the Angkor Wat temple complex.

The complaint, dated March 10, alleges Sokimex has siphoned the majority of funds recouped from tourist entrance fees to the world heritage site and that the contract between the government and Sokimex is “irregular” and lacks transparency.

If [ACU head Om Yentieng] does not take legal action and investigate, this means that [Om Yentieng] and Prime Minister Hun Sen are leaders who are as corrupt as [Sokimex] too, it is like a proverb saying ‘a toad selling ringworm medicine’,” the complaint states.

Om Yentieng could not be reached for comment yesterday, but ACU spokesman Keo Remy welcomed the complaint filed by anonymous people and guaranteed that despite the anonymity of the complaint, an investigation would ensue if it was worthy.

Buot Chinda’s brother Sam Sinat said seven Bavet police officials also visited his family on Wednesday and offered his family “a gift from Deputy Prime Minister Men Sam An” of 2 million riel, about US$500, in return for not filing a complaint.
Bavet town governor Chhouk Bandith is the man who gunned down three unarmed women at a protest last week, Interior Minister Sar Kheng alleged yesterday, saying an official complaint had been filed against him.

Outside an unrelated conference, the minister told reporters the governor would be arrested imminently in relation to the shootings at the Kaoway Sports Ltd shoe factory in Svay Rieng province’s Bavet town during a February 19 protest of about 6,000 people.

“Related to the arrest of a suspect or not, it is not the duty of the Ministry of Interior, it is the duty of the court, but it will not take longer than one week because we have to do it clearly,” he said.

Allegations have steadily surfaced against the high-profile suspect since he told the Post last Tuesday he was aware of accusations against him which he categorically denied.

Anonymous police officials have previously told the Post that Chhouk Bandith became enraged and accidentally shot the three women while attempting to fire warning shots after a protester threw a rock at his head.

More than 200 villagers from Kandal’s Kien Svay district gathered in protest yesterday to urge the National Authority for Land Dispute Resolution to resolve their long-standing dispute with a CPP official.

The protesters assembled in the Samrong Thom commune brandishing photos of the prime minister and his wife, encouraging authorities to find a resolution to the dispute, in which they claim to have lost more than 1,000 hectares of farmland.

Village representative Hem Sopheap said more than 850 families lost their land in 2005, when Lok Hour, a Phnom Penh Municipal Council member and former deputy cabinet director for senate president Chea Sim, took possession of the land, forbidding villagers to continue farming.

Later in 2005, Prime Minister Hun Sen had sent a letter to the NALDR instructing it to find a resolution for the villagers, but nothing had been done, Hem Sopheap said.

Synopsis: A CPP activist, who is local official in Stung Treng province, claimed that his freedom of expression is threatened by CPP party officials who want to remove from his position as an elected official. On 11 January 2012, Ros Lach, the 2nd CPP councilor in Anlong Phe commune, Thalabrivat district, Stung Treng province, expressed his concerns about his personal safety because local CPP officials threatened him and they have prepared paperwork to remove him from his position as commune councilor. He claimed that he voiced out his opinion during seminars and public forum organized by the civil society and he criticized the inaction by the local authority against logging of precious wood, as well as deforestation. All these issues affect CPP party officials, that is why his life was threatened by the wood trader and local CPP officials have prepared paperwork to remove him from his position. “They are silencing me, they restrict my freedom, they want me to follow their plan, i.e. to follow the path they set for me. This is a restriction on my political freedom rights, on my work rights, as well as on my freedom of expression rights.”

The corruption trial against four former high-ranking members of Senate president Chea Sim’s inner coterie accused of engineering scams involving hundreds of millions of dollars will begin next week, a court official said yesterday.

Phnom Penh Municipal Court judge Te Sam Ang said the trial against the four – accused of defrauding at least 51 foreign companies in scams that date back almost a decade – would commence on Tuesday.

“So far, their cases have been completely investigated. They will be put on trial on December 20,” he said yesterday.

Chea Sim’s former chief of protocol, Pheng Kunthea Borey, is accused of masterminding the scams – allegedly charging companies to secure the Senate president’s signature for a number of fake humanitarian and development projects.

Last week two young women who dealt with a powerful development company to negotiate for housing for destitute families were handed stacks of US dollar bills by the owner of the company- as “gasoline money” .

The two young women responded: “We have money for our own gasoline. This is corruption money and we do not need it. We work with MP Mu Sochua. We work for justice and dignity for our people.

The message from the two young women is clear: “We do not accept corruption as part of business”.

Join them in showing the ugly face of greed and corruption that get support from CPP backed officials and company.

On November 21, 2011, two SRP activists, Mr. Nhoem Seyha and Ms. Meach Koy, the councilors of Angkor Barn commune in Kong Meas district, K Cham province, were comforted, persuaded, and bribed by Ms. Oem Sy Thae, Secretary of State of the Ministry of Women Affairs and Veteran to vote CPP in the up-coming Senate Election.

WHY THE HUN SEN REGIME RELIES MORE AND MORE HEAVILY ON EXTERNAL BORROWINGS

The economic situation in Cambodia is artificial, fragile and explosive based on the following facts (from F1 to F7):

F1 : A dollarized economy. The country’s money supply is composed of US Dollars for up to 95% and Riels for only 5%. The exchange rate (1 US Dollar = around 4,000 Riels) is totally artificial, being easily manipulated given the respective amounts of Riels and Dollars in circulation. Because it is pegged to the Dollar, the Riel is overvalued compared to the currencies of our neighbouring countries and commercial partners after taking into account the differences in inflation rate in the different countries (caution: official statistics in Cambodia are manipulated for political reasons). The dollarized economy and the overvalued Riel contribute to a loss of competitivity for Cambodia’s economy which in turn contributes to a huge trade deficit and a large unemployment.

F2 : High inflation rate, meaning increasing cost of living. This seems paradoxical given F1 because inflation tends to be low in countries with an overvalued currency. But the high inflation in Cambodia is largely due to compulsory bribes in the production and distribution processes, other forms of financial extortion and commercial monopolies based on government systemic corruption.

Inflation is an insidious form of wealth transfer from the weak and the poor to the powerful and the rich, whereas the ongoing land grabbing is a direct and brutal form of such a transfer.

F3 : High and increasing unemployment rate partly due to the dollarized economy (see F1) but also to demographic factors, inappropriate education system, corruption-related hindrances to foreign direct investment and poor economic governance.

F4 : Deteriorating living conditions because of high inflation and low salaries for workers, employees and civil servants. Farmers’ income also suffers from government corruption and neglect and the absence of any consistent agricultural policy (by comparison see SRP political platform for agriculture). Hidden and disguised unemployment is a major cause of poverty (see F3).

F5 : Huge trade deficit (imports of goods and services larger than exports). The main cause for such a deficit is low productivity and declining competitivity associated with the dollarized economy (see F1).

F6 : Continuous fiscal (or State budget) deficit. Because of government corruption (loss of State revenues, unjustified increase in State expenditures that are always inflated) the fiscal deficit is persistently high and needs to be covered by international assistance, increasingly by borrowings from foreign institutions and countries.

F7 : Increasing borrowings from foreign institutions and countries, such as China over a recent period (see F6). This continuously contributes to the dollarized economy (see F1). External borrowings feed corruption, allow continuous fiscal and monetary irresponsibility on the part of the CPP-led government that is in a position to indulge in vote buying (donations and patronage system). Thanks to the increasing amount of non-transparent external borrowings in foreign currencies, secret amounts of Riels could also be illegally printed by the CPP for corruption and election purposes without notably affecting the exchange rate (see F1). Therefore, external borrowings play a pivotal role in maintaining the CPP in power by preventing a deterioration of the fiscal deficit (see F6) and a worsening of the balance of payments (see F5) that would result in dramatic consequences for the economy and for the CPP political domination (see F2, F3 and F4).

A high number of civil servants are “trapped” in their allegiance to the ruling party, forcing them into acts of corruption in order to keep their jobs, a leading Cambodian analyst said Thursday.

Lao Mong Hay, a longtime political analyst and former researcher for the Asian Human Rights Commission, told “Hello VOA” that public employees have to contribute money to the Cambodian People’s Party and work to expand grassroots support, an expensive endeavor that is difficult to maintain on a legitimate salary.

“This is a mechanism that breeds corruption,” he said. “Based on their salaries, they are not able to afford [such contributions]. Therefore, they have to find extra sources of income, which means accepting bribes or embezzling from the national budget.”

Killing Field tourism: Haunting memorial or gratuitous commercialism?

Visitors to Choeung Ek, Cambodia's most infamous Killing Field, learn about the Khmer Rouge's murderous past in graphic detail, but locals don't benefit

From 1975 to 1979 an estimated 1.4 million Cambodians were killed under the despotic rule of Pol Pot and the Khmer Rouge.

The executions took place on what have become known as Cambodia's Killing Fields. The best known of these is Choeung Ek, 17 kilometers from the center of Phnom Penh. Here, an estimated 17,000 men, women and children were butchered by the Khmer Rouge.

It is a suitably grim and eerie memorial to those who died, an Auschwitz-Birkenau for Asia.

But unlike the Holocaust memorial, Choeung Ek is not a UNESCO World Heritage site and today questions are being raised about the benefit of Killing Field tourism for local inhabitants.

Choeung Ek is run by Japanese company JC Royal, which pays the Cambodian Government an annual US$15,000 levy for the site. Meanwhile, the five million survivors of the Khmer Rouge era appear to derive little benefit from it.

Many live on less than US$1 per day, an injustice that adds to the upset caused by delays in punishing the perpetrators behind Cambodia's darkest era.

Asian NGOs condemn defamation suit on activist

More than two dozen Asian civil society groups have condemned the conviction of Sam Chankea, a Cambodian human rights defender, for the exercise of his right to freedom of expression.

We, the undersigned human rights NGOs, human rights defenders and women human rights defenders of Asia, deeply regret the conviction of Mr. Sam Chankea, provincial coordinator of the Cambodian Human Rights and Development Association (ADHOC).

Mr. Chankea is a human rights defender active in land rights issues in Kampong Chhnang province. He was charged with defamation under Article 305 of the New Penal Code by the KDC International Company, a development company allegedly owned by Lauk Chumteav Chea Kheng, the wife of the Minister of Mining and Energy in Cambodia. On 25 January 2011, the Kg. Chhnang Provincial Court ruled against Mr. Sam Chankea and ordered him to pay a 1 million Riel fine and an additional 3 million Riel in compensation. If he does not pay the 4 million Riel (approximately US$1,000), he faces imprisonment.

Mr. Sam Chankea was charged for defamation by the KDC International Company because of a statement he made during a radio interview on Radio Free Asia (RFA) on 26 December 2009. In this interview he expressed his opinion on an ongoing land case in Kampong Chhnang between 108 families and the KDC International Company. There is a pending case between the families of Kampong Chhang and the KDC International Company, but still, the KDC International Company sent in its machinery to undertake land levelling. Mr. Sam Chankea considered the activity of land levelling by the KDC Company as an unlawful act. He stated that “what the company has done is an act of violation since the court has yet to rule on the merits of the case. Therefore the company should suspend the activity and await the ruling on the merits of the case”.

Little Information Known About Oil, Gas: Survey

Eight years after Chevron found crude oil off Cambodia’s coast, the American company has yet to begin full production. In remarks in April, Prime Minister Hun Sen said he wants the oil giant to begin production by 2012 or risk losing its rights.

A new survey suggests that many of Cambodia’s smaller business entrepreneurs are not fully aware of the development of the extractive industry.

The survey, initiated by Cambodians for Resource Revenue Transparency and issued Tuesday, found that out of 548 companies, most had little knowledge of the sector and that information was lacking in both the media and the business community.

However, observers say development of these resources, especially in oil and gas, will require good management and will affect many businesses.

“There are few that know where petroleum is being explored, what companies have obtained licenses,” said Neou Seiha, who led a survey for the Economic Institute of Cambodia.
